Obama warns 'unelected' Supreme Court against striking down health law

President Obama, employing his strongest language to date on the Supreme Court review of the federal health care overhaul, cautioned the court Monday against overturning the law -- while repeatedly saying he's "confident" it will be upheld.

This could well be just an attempt at damage control. As others have posted, the pi**y demeanor is a major clue.

I tend to believe that Obama holds the losing hand. Otherwise he wouldn't need to do a risky maneuver and alienate the SC that hasn't yet officially delivered a decision.

If Obamacare is winning then Obama would have said that he totally respects the SC and is absolutely sure that it will do the right thing.

It was theorized that Obamacare is winning and Obama is just posturing. However it is a very risky act, and very few among "his people" will even understand what he just did. It would be far more profitable to build on the positive, stress success and agreement and approval (for a change.) Additionally, Obama wouldn't need to do it so quickly after the SC had a vote. He'd have months to exploit this situation, and it would be closer to the elections too. The timing suggests that Obama is still trying to affect the SC's ruling - that's the only explanation for the haste.

dumbo’s unelected remark might just work. Civics isn’t taught in school anymore, so half the people in the country might not even know the SC is an equal branch of govt.

Apart from the four “usual suspects” I wonder which of the justices understand that they are,in a sense,being threatened by Osama Obama himself.

Strange how things we say can come back to bite us in the ass. obama’s mimicking Republicans/conservatives. When judges make decisions we don’t like, we aren’t shy about playing the activist/unelected card.

Someone has suggested that Justice Kagan has leaked the vote results and that’s why zero is so overconfident. I hope this isn’t true, or she should be prosecuted like the traitor she would be!

Such a supremely stupid utterance. Almost every single Justice comes up through the Federal circuit, nominally chosen by the President and requiring Senate confirmation -- by vote! Then to become a Justice, a nomination by the President and another round of Senate confirmation voting.

Most Justices get to the Court through two different Presidents and two different Senates. I cannot think of any post less "unelected" than Supreme Court Justice. Which may be why we continue to allow them to serve for life.

He was an "adjunct professor" = a non-tenure-track resume-enhancer for local lawyers to 'give back' to their alma mater. It's also a way for the law school to keep in touch with local law firms or (in Obama's case) do a favor for some influential local politician.

There you go. That's the root of the "Constitutional Law Professor Obama" lie. Thanks for having the patience to post the facts yet again.

If I’m not mistaken (others please correct me), was not the vote by the Court already taken on Friday, March 30?

Or, have they yet to vote?

If the vote hasn’t yet been taken, this was aimed at Anthony Kennedy.

Will he cave?

If the vote already -has- been taken, perhaps Obama knows something we don’t about the outcome. Who might have leaked the decision? If that decision has been made, does Obama really think he can cow them?

...Unfortunately for Obama, he also made the tactical misstep of explaining why if the individual mandate is found unconstitutional, the entire law should be struck down:

I think the justices should understand, in the absence of an individual mandate, you cannot have a mechanism to ensure that people with pre-existing conditions can actually have health care.

In other words, the individual mandate lies at the heart of Obamacare; without that beating heart, the rest of the law becomes unworkable.

The only thing extraordinary and unprecedented here is such heavy handed demagoguing of the Supreme Court by a sitting President. SCOTUS ought to issue a reprimand of his blatant disrespect for the Constitutional role of the Court.

It was a brazen threat. If SCOTUS overturns Obama Care, then Obama will not comply with the decision at all, because it goes agianst "democracy." Obama ruined Libya on that principle, and I am sure he would have no problem ruining SCOTUS..Thats how far we have descended into Fascism, and most Americans do not even know it......YET.
