MSNBC's Joe Scarborough today suggested that Maureen Dowd's new column about the Supreme Court -- which, she argues, "is well on its way to becoming one of the most divisive in modern American history" -- was an attempt by the New York Times to 'play' Supreme Court Justice Anthony Kennedy and influence his ruling on the health care law.
"It's over the top, so much so that you sense [the New York Times] is playing Anthony Kennedy... because they know Anthony Kennedy is scared to death of the New York Times editorial page."
"It's amazing that you would have a newspaper that is playing a Supreme Court Justice," Scarborough added.
In her column, titled 'Men In Black,' Dowd argues that the Supreme Court "has squandered even the semi-illusion that it is the unbiased, honest guardian of the Constitution. It is run by hacks dressed up in black robes."
"Theyve already been playing Twister, turning precedents into pretzels to achieve their political objective," she writes. "In 2005, Scalia was endorsing a broad interpretation of the commerce clause and the necessary and proper clause, the clauses now coming under scrutiny from the majority, including the swing vote, Justice Anthony Kennedy. You can be forgiven (once) for asking such a foolish question, because you’re a “newbie.”
It’s Catherine Zeta Jones. I think back around the whole impeachment mess when Dowd was writing all these stories about Monica and Bill and was really in her prime if you want to call it that, that she went out with Michael Douglas for a bit. Anyway, he ended up leaving her for CZJ.
So it’s an FR custom that whenever a story involving Dowd comes up someone posts a CZJ photo to rub salt in the wound.
Also, I think some of the worry about Kennedy is misplaced. he wrote the Citizens United decision that was largely villified and attacked by the dems, the media, and the left. If he really cared about how the media treated him I don’t think if he’d have written that decision. He also has always been a consistent vote against affirmative action and racial preferences. He’s been a solid vote in both 2nd amendment cases. He was a very strong vote in the federalism cases like Lopez, Morrison and the 11th amendment cases. He even vote dto uphold the partial birth abortion ban.
Yes he’s liberal on some issues. But I don’t think he’s as malleable or susceptible or outisde pressure as some think
