Georgia Supreme Court Rejects Ballot Challenge

"Today is a total travesty for the Rule of Law, Article II and the U.S. Constitution. The State of Georgia has a law on the books giving electors the right to challenge the eligibility of a Presidential candidate. However, that would be in theory only because in reality the judicial process is prohibitive and the sanctity of the ballot cannot be assured. Therefore, my ballot challenge in which Barack Obama entered nothing into the record and ignored a court order to appear despite Georgia Secretary of State’s warning to do so would be at "his own peril", heads to the U.S. Supreme Court seeking not only redress for a judicial process that has failed its responsibilities, but ultimately seeking Constitutional compliance."

And who says that crime does not pay in government?

Could this be considered legislating from the bench since the Georgia Supreme Court, with their pronouncement, implied that the law must have been changed for Obama, who broke the law and order of the court? So, did the justices of the GSC change the law? (pssst: they can’t do that).

Remember the “dangling chads in the Florida election and how the SCOTUS slapped down the judges in Florida for changing the law from the bench?”

If they say Soros is supporting Romney which I laughing say either they are going to throw Obama out or they have the goods on him. Romney should not be our candidate in either case. he would not ket America win. He shouldn’t be running as his father was born in Mexico.

These patriots, who would surely rather be at home reading FReeper threads, are representing we who shake our fists at the sky from the comfort of our keyboards. And now commite themselves to do battle with the US Supreme Court, which has been, according to Justice Thomas, "evading the issue."

This was the first court ever to allow evidence and testimony to be entered on thsi issue of Obama's eligibility. This is the same case in which the judge found for the Respondent, Obama, despite that he, thru his attorneys, had flatly refused to honor a subpeona from the court and failed to enter any evidence or testimony at the hearing. Then the judge "pocket vetoed" (for lack of a better phrase) a motion to find the Respondent in contempt for failing to appear.

How can the highest court in the US deny this altogether legitimate challege; this travesty of justice?!

Really? That seems rather weak. His father was an American citizen at the time of Mitt's birth. That should satisfy even a strict interpretation of the "natural born" requirement.

I suspect the author is right, the very concept of justice dies with the presidents name. The president is “above the law” even if the question is posed whether or not he illegitimately is the president.

It seems that once he is sworn in he is immune to all forms of accountability and question to the law.

He was not born in this country and there is nothing weak about it. I am not a birther so don’t go that route. If we don’t start fighting for our country instead of yammering on; we will lose. Personally, I don’t care where Obama was born although it is important; but I do care about his coverups and criminal behavior and how he really became POTUS. We need to hold our own elections. The government is not playing by the rules; but we should and et our own candidates. We are letting these thugs take us over.

Standing isn’t an issue in this case. The law in Georgia allows voters the right to challenge ballots with ineligible candidates. The Georgia decision is not based on legal evidence since none was ever entered.

I would go beyond that. His arguments are the silliest thing I have ever seen since Yogi Bera. I don't mind someone disagreeing with me, but when the proffered arguments are so dumb that they make you feel stupid just trying to read them, you need to save your sanity and just ignore them.

This guy is the looniest anti-birther i've seen since squeeky fromme. Other than slapping him around, he's not worth the trouble it takes to respond. It's like arguing with a child.

There is no provision in the law to waive the qualification requirements for those who are politically prominent. There is no provision in the law to waive the qualification requirements for those currently holding the office being sought.

The qualifications specified by law are to be applied equally to all.

The law has not been applied equally.

If that is the case then the Federal court has almost no place in this case except to remind the State court that it is the discretionary of state law to define who can and cannot access the ballot.

As I understand it, the argument against Obama is that his father was not an American citizen at the time of his birth so it wouldn't matter if he had been born in Hawaii, he wouldn't meet the "natural born requirement." But you're taking the argument further and saying that because Romney's father was born in another country, even though George Romney was an American citizen, that makes Mitt ineligible.

So in other words, not only does one have to be a "natural born citizen", he has to also be the son of a "natural born citizen." How many generations does this thing have to go back, or am I missing something in the "natural born" interpretation?

Why do you think our candidate was McCain and is most likely to Romney?
One of the reasons Romney is strong is his father was not born in the US as supposedly Obamas father. So no one can not jump on Obama. McCain had a birth problem too. That’s why he was chosen and Duncan Hunter a true conservative was not. Apparently Obama can not p rove anything about his birth or is unwilling too.

Get the connection. They are always choosing for us and I emphasize choosing for us a candidate that has some kind of birth problem. We have poor candidates and we the people are doing nothing.

They wouldn’t choose such candidates that clearly no one want if they had nothing to hide. I am not saying they would not cheat in other ways.

Were both of Romney’s parents US citizens the day he was born? Was Romney born on US soil? If yes to both questions, Romney meets the requirements. His father may have been born on Mexico, but if he acquired naturalized US citizenship before Romney’s birth, the requirement is satisfied. Obozo admits his father was not a US citizen. He fails on that test alone. Obozo can’t prove he was born on US soil. His mother didn’t meet the 10 years a resident of the US including 5 after age 14 (she was 18 when he was born). Obozo fails by every measure, yet he sits in the White House dressed like a slob watching TV when his handlers haven’t dressed him to read from the teleprompter.

It states both parents must be born in the US. So it doesn’t matter if his father was a citizen or not. He wasn’t born here. Chester Hayes had this problem which they covered up. So it doesn’t matter where Romney or his mother were born.

No, Obama's father was not a U.S. citizen or was a dual citizen (British subject). I don't think that's true of Mitt's father. It has nothing to do with where their parents were born, but where the candidate is born and the citizenship status of his parents. You're really not making sense here, with all due respect.

Get the connection. They are always choosing for us and I emphasize choosing for us a candidate that has some kind of birth problem. We have poor candidates and we the people are doing nothing.

They wouldn’t choose such candidates that clearly no one want if they had nothing to hide. I am not saying they would not cheat in other ways.

As bad as I hate the outcome and the Super PAC money Romney has, no one is choosing anyone for us except stupid primary voters. This is not a conspiracy. It's about two candidates (Newt and Rick) who initially split the conservative vote and neither of whom had the resources or organization that Romney does.

If the story about Perry and the painkillers are true, then we may have lost a viable alternative to Romney right there because of bad timing.

I hope they take it to the convention, as long as the one left standing can defeat Obama. This is the most important issue, in reality the only issue.

A person’s parents don’t have to be born in the US, just have to be citizens at the time of the person’s birth, and on US soil, to qualify for NBC status.

Although I’m not supporting Mitt Romney in the primary process, his father’s birth in Mexico does not contradict the fact that he, Willard Mitt Romney, is a natural born citizen and does meet all the constitutional requirements for the Presidency. That’s because it’s incontrovertible that at the time of Mitt’s birth in the US, both George Romney and his wife were American citizens.

You misread. Both must be US citizens. Naturalization or by birth. Both must be citizens before producing a natural born citizen on US soil.
