I don’t think the prosecution will be able to get a 2nd degree murder conviction. The following is from a Florida Attorney’s website:

Second degree murder cases often involve a death that allegedly occurred because of a heat of passion or act that was so dangerous is warrants a criminal action be brought against the Defendant. The classic example is the spouse who finds their partner having an affair with another person and immediately acts to kill either the partner or the partner’s lover. In order to convict a defendant in Florida of Second-degree murder, the State of Florida must prove the following three elements beyond a reasonable doubt:

1. The victim is dead;
2. The death was caused by the criminal act of the defendant;
3. There was an unlawful killing of the victim by an act imminently dangerous to another and demonstrating a depraved mind without regard for human life.

Understanding a second degree murder can be more confusing than the more serious first degree murder. The “criminal act” reference in the statute must be a single event or series of related actions arising from and performed pursuant to a single design or purpose of committing the murder or creating the dangerous condition that led to the death. Although second-degree murder can carry a potential incarceration of up to life in prison, the death penalty cannot be imposed on a person found guilty of second-degree murder.

Whether a Defendant’s actions could have been reasonably foreseen as endangering a human life to the point of warranting a prosecution is a question for the jury and where a skilled defense lawyer can be most helpful. Examples may include the negligent supervision of a child or of the elderly by an adult, or other reckless behavior that led to the death of another person.

“Did this woman use the phrase: “Justice for Trayvon”? I just tuned in this this presser and it sounded as if she used that phrase that all the protesters have been using”

She sure did, she has made herself Judge, Jury, executioner. Disgusting witch, she was all but blowing kisses when she walked in.

Definitely a smarmy politically correct beginning. Barf. The first thing Zimmerman's legal team should do is to have her disqualified from the prosecution's team for her statements. Her press conference should have been limited to informing the press that charges of 2nd degree murder have been filed, Zimmerman is in custody, and there will be no further statements by the prosecution.

Zimmerman's legal team can delay this trial for a long time if they want to.

can’t speak for how things go in florida, but in georgia, all felonies go to grand jury.

if she got an arrest warrant for the charge(s), then she would’ve had to go before a judge and swear to the information in the warrant. If its found out that she “stretched”the truth to appease folks, she’s risking her career, like the moron in NC.

if zimmerman gets decent representation, this is going to take a while(suppression hearings, pre trial motions, change of venue, blah, blah, blah). and if it goes his way, it’ll cause chaos. probably, some time in mid to late october.

We had a judge in lieu of jury trial here...Black on black....Justice was NOT served because the guy with the knife went hunting for the “unarmed” dude and stabbed him to death.....4 or 5 times. It was a farce. Someone knew someone in this case...I’m certain...just plain dirty.

There was only ONE WITNESS to come forward the night of the act. He saw the thug on top of the security guard trying to bash his head in the ground.

Anymore “witnesses” to the crime that came forward days or even weeks later are LYING.

Only one witness to the act and that person said the thug was the culprit. This is purely political because if the racebaiters are not pleased with the outcome they will loot and burn everything in sight.

Judge Al Sharpton residing.

Doubt it unless they hold him without bail, which is a strong possibility considering what a huge sellout this woman is. It depends on the judge. After discovery, I think the Martin family are going to be very embarrassed.

HG I’m very surprised at your comment. For weeks things have been coming out which painted a very clear picture indeed. Including the ‘bash’ marks on the back of the man’s head; the eyewitness who saw that Martin was on top of him pummeling him; audio of him screaming for help.

Do you honestly believe that if there was a shred of doubt that the cops would not have arrested him on the spot?

The police report stated clearly the man was bleeding from the nose and back of head.

It was like Rush pointed out today, if this man had been over in the sand pits of hell and a Islamic fanatic attacked, the outcome would have been the same and no one (except Hussein) would have been screaming for his head.

This is a political lynching pure and simple.

If he gets sent down, it won’t be for second degree murder. Maybe manslaughter or third degree. It’s entirely possible that he might get acquitted on all charges, but I wouldn’t bet my life on it, either. Being held in jail, however, it’s much less likely that he’ll be lynched.

The SOW is now saying that the Police conducted a thorough and complete investigation, but before the end of the investigation, all the publicity ruined their work and the Special Prosecutor had to take over.

SHE MET with Treyvon’s parents last Monday with her prosecutors and PRAYED with them. She asked them what could they do to make sure Treyvon got justice... WTF??

I’m not a legal expert, so here’s my question:

If Zimmerman is charged with 2nd-degree murder, can a jury still decide to find him guilty of a lesser charge such as manslaughter?

Still, should give the situation some time to calm down.

I agree that with an honest jury based on the facts (not the spin) reported so far, there should not be a conviction.

The key question of fact for the jury will be who initiated the physical aspect of the alteration.

There does not appear to be any actual evidence to rebut the defendant’s description of events that Martin struck him in the face, knocking him down and got on top of him beating his head into the ground.

The only possibility would be a new witness not previously known or the girlfriend stretching her claim of what she heard on the cellphone conversation to include hearing Zimmerman physically striking Martin.

The question as to who struck the first blow will open up rule 404 evidence as to propensity.

There will be a big fight over just what about the No_Limit_N_gg_’s character the jury will be permitted to hear to prove propensity to violence.

This is actually good news. The prosecutor knows that she will not get a conviction for 2nd degree murder, but she can say that she tried.

IMO she is trying get a jury to come back with a lesser "compromise verdict" like manslaughter, if that option is available.

I fail to see how either “following” (as some on FR claim) Martin, or even getting out of his vehicle to get a street address (as others have said) for the responding officers qualifies as “imminently dangerous” or “evincing a depraved mind” in this case.

The "imminently dangerous" act was shooting Martin.

Yep, in the world we used to live in, you can't come out dancing and singing Hooray, Hooray, we got him! Now, let's kill him! Hooray everyone!! Yippy!

She should be put off the case. She should recuse due to her own, obvious, deep and personal feelings in the case. Go have dinner with ‘our victim's’ family. See how long that lasts once they are done with you.

Forgive them Lord, for they know not what they do.

Here’s a thought that just crossed my mind.

Maybe, just maybe, she knows this charge won’t fly and doesn’t want to be around to prosecute it. Could it be she’s throwing bait to the defense, basically giving them a reason to ask she recuse herself and a “special prosecutor” be appointed while she maintains her current post?
