ZIMMERMAN CHARGED WITH SECOND DEGEE MURDER

MIAMI (CBSMiami) – George Zimmerman has been charged with second-degree murder for the shooting death of 17-year-old Trayvon Martin, according to the Associated Press.

Additionally, Zimmerman has been taken into custody, but it hasn’t been revealed where he is being held.

CBSMiami has confirmed that State Attorney Angela Corey, who was appointed as a special prosecutor in the case, will hold an announcement about the charges at 6 p.m. in Jacksonville.

Thank you. Stay away. Note that the Sanford Police and the DA had handled this problem correctly UNTIL a bunch of yankee blacks came down to Florida and decided to blow this up into a Big Thing. Then the media, which is based in NYC latched on to the story and started banging the drum. Then, our illustrious President (from Hawaii, Kenya, Indonesia, and Illinois) and his racist AG (from the Bronx) got involved.

The people of Florida that you hate so much were the ones that created a simple Stand Your ground law along with an easy to obtain shall-issue CWL (the first in the nation, BTW, you are very welome). Corey has done a pretty good job, but the state came under so much pressure from OUT-OF-STATE forces that eventually it caved in and committed this travesty of justice because we have become a nation of men and not a nation of laws.

So, please stay out of my state. I get so sick of people coming here telling us how backward we are because we aren’t your home state. Well, I-95 and I-75 go both ways. Feel free to use the northbound lane!

Yesterday's circus from the inquisitor that your governor appointed to railroad Zimmerman, has shown brightly that PC trumps the rule of law and previous investigations in the State of Florida... that is as soon as the black community threatens violence and the black panthers issue a public contract on Zimmerman's life... and your state did vote for obama and polling data is showing that you guys are likely to do it again.

Did you know that Britain warns people not to come to your state? Seems some blacks killed two British students awhile back and your State has done little to nothing to seek justice there. Brits are not threatening to burn down Miami and they are not issuing death contracts like the nbpp is doing. NOTHING is happening to find their murderers either... plus they are white. "I'd like to remind people that the State of Florida takes a dim view of professional agitators coming into our state to stir the pot. It would be in the best interest of Mr. Sharpton and Mr. Jackson to get the f*** out of our state before I have them arrested for inciting a riot...and if anyone in the feral community so much as blinks; I'll have the National Guard on your *sses like white on rice. Dear Mr. Evil, this state has seen a 20 year low in crime due to our great laws on Concealed Carry and Stand Your Ground. As a small business owner within sight of Legoland, you're suggestion of crippling our tourist industry through boycotts is a direct attack on my livelihood, those I choose to employer, my family and my church I support. This arrest is an attack on our successful elections and laws passed resulting in the predator class becoming the prey in violent crime. Please refrain from emotional posts asking for financial harm to me and those I care about.

Do you think that's what Nifong believed when he prosecuted the Duke boys?

Angela Nifong. DA with political aspirations. She concluded that bringing charges was good a good career move.

I was on a murder jury once.

Included among the judge’s instructions to us was that we could, as an alternative to a murder conviction, vote for the “lesser included charge” of manslaughter. I suspect that the case will be the same here.

They charged him with 2nd degree as the highest they thought they could reasonbalby get a jury to agree to, and hope to use this to pressure him to pead guilty to manslaughter.

Now whether or not they can even get a conviction on manslaughter is an open question. Given what I know currently, I’d let him walk.

Oh, and that murder trial? We let him go. Seemed like an open and shut case of self-defense to us. All twelve of us.

Tell me, if you know, why other than his recent membership was this guy zotted? I mean, “legal arguments” have been made for the most outrageous positions, and won. Also, there is no telling what a jury would do.

It’s a choice of riots now or riots later. This is a kick-the-can-down-the-road and hope solution. My thought is that the post-election rioting will have burned itself out, and everything worth looting will have been carted away, before the trial. (Or more optimistically, that the hidden hand driving this situation — the Obama campaign — will be gone and no longer need it).

How does malice work into the Florida statute? It's specifically included in California's PC section. Does Florida use “depraved mind” synonymously?

It's not in the Florida Statute. For the reasons below, I'm going to tell you what I think, rather than what I know. Normally, 'depraved mind' can include malice for a specific individual (which can be formed just before the killing), malice for a group (which doesn't have to be racial - it could be Kiwanis, fat people, Ohio State fans, or - punks who look like they are casing or robbing apartments, if the prosecution can show that.

You would need evidence - early run-ins with the person or class, writings about them, expressions of hatred or frustration toward them. Something more than 'people who wear leather pant in public look silly.'

Because I'm not currently practicing law and much of the research I do for work is not legal, I'm not currently on a flat monthly fee for Westlaw or Lexis. I pay by the search and I haven't paid to run a search on this statute (it will make more sense to see what cases have interpreted parts of this statute after we know more about what Zimmerman may have told the police during his multi-hour interview, or what the prosecution is alleging).

What I'm telling you is general with respect to a 'depraved mind' or 'depraved indifference' and not Florida law.

The terms 'depraved mind' and 'depraved indifference' cover more than just the above.

Not necessarily. She could be claiming that he had malice toward punks who case and rob apartments and then 'always get away' before the police get them, regardless of race. She could be playing on all the 911 calls he made (not as many as were reported by the media, but he did make a lot), his desire to patrol, he comments about them getting away, his desire to follow, his carrying a gun.

I see legal, reasonable, Constitutionally protected reasons for all of those, even if he called 911 a lot. She made be playing them into a 'depraved mind' and the reason for a murder.

I believe this is a dog and pony show to placate the mob and hope for a cooler heads when the charges are thrown out in the pre-trial hearing.

Unless the DA has some pretty stunning evidence, I can’t see this getting to trial.

That’s my hope. To make that plan work the case can’t come to trial before the election though. Hopefully both the prosecution and the defense realize that.

When the media pushes for action right before the election we need to demand that Nidal Hasan be tried first...

In my local community, within an hour of Sanford, we have a very active 9-12 group. Over the last 2 years, weekly attendance averages averages 75 and when certain speakers or programs are offered, attendance doubles. We have taken half the seats in the county Republican Executive Committee and now the 'good old boys' of the GOP-e are feeling the pressure to get back to our conservative roots. This Martin - Zimmerman ordeal is carefully planned to bring our state's electoral votes over to the dark side in the next presidential election. We are also hosting the RNC this election cycle so we are ground zero. The big picture is being framed as I type and a boycott on Florida, our tourist industry and our products will result in nothing more than the boycott on South Africa to end apartheid.

Do you have any idea what the response is in the Cuban-American community? They’ve got roots to understand what thugocracy really means - regardless of which race is the perp. Are they speaking out on this, or are they drowned out (or cowed) by the racist groups such as Black Panthers, Yahweh bin Yahweh, La Raza, etc?

I know what I've read. I know what the Florida Statutes say - although I haven't read a lot of the case law interpreting those statutes (it's almost pointless until I know what the 'facts' are alleged to be by the prosecution and defense).

What we don't know is what Zimmerman told the police in the hours he was interrogated. Plus, we know that some witnesses changed their original statements to the police to make them more favorable to Martin. There's no telling how many new 'witnesses' have appeared since this became about race and gun rights rather than about Zimmerman and Martin, or since TV cameras have appeared, or how many witnesses have changed their stories.

I think Corey needs to be careful about suborning perjury from some of these witnesses who have changed their stories.

To claim that Zimmerman was the aggressor she’d have to explain away the 911 call, the witnesses saying Trayvon was on top, and Zimmerman’s injuries though, wouldn’t she? I mean, she can try to show that Zimmerman was out to get this “punk” but unless she can refute the evidence that Trayvon was the aggressor, it doesn’t matter what Zimmerman’s intentions were. Unless she claimed that he had gotten away from Trayvon and had shot out of malice, but the screaming right up to the time the shot was heard would refute that.

Am I missing something?

Agreed, I like Florida and have family there. I love the oranges from Harvey Groves. The real blame is not Florida, it is the race hustlers and pimps, the dupes that follow them and of course, Bammy and Erich Holder.

What is going against George are his own words to the dispatcher which indicate his propensity to think everyone is a suspect, standing in one place is suspect and "they always get away" in addition to the "f'n blank holes". That kind of record indicates a propensity by George Z. to spring into action based upon his faulty assumptions.

His new lawyer seems light in the loafers imo. Anyone else pick up on that?

I was wondering what the penalties are for somebody changing their claims from what they previously swore. This Mary C in particular seems to me to be on dangerous legal ground. Wouldn’t the changes in the story at best make the testimony of those witnesses non-credible?

Thinking everyone is a suspect is a reason to call the police, or to follow, or to confront. But given that Trayvon’s girlfriend has said that Trayvon initiated the direct confrontation, the only “propensity” that comes into question is whether he has a propensity to shoot somebody he’s conversing with. I think she’d be pretty hard pressed to prove that propensity.

And even if the propensity was there, she’d also have to overcome recorded audio evidence, witness testimony, and the evidence of Zimmerman’s injuries and absense of any Trayvon injuries beyond the fatal bullet wound - none of which Zimmerman had any control over and all of which (according to the police) corroborate Zimmerman’s claim of self-defense.

Eric Holder has made it abundantly clear that he considers himself an advocate for “his people”, not for justice.

Everything he does is a conflict of interest because the oath he took as AG is diametrically opposed to everything he is and has ever done. He is the fox guarding the henhouse.

Zimmerman wasn’t even called or re-questioned by this woman.

That's because he had counsel. If someone is under counsel, you can't talk to them except through the attorney.

Not if O'Mara does his job in voir dire. OJ trial was in south LA. Seminole County is 66% white, 17% Latin American and 11% black. Brevard County (same court system) is 77% white, 10% black, and 8% Latin American.

Zimmerman could have shoved Trayvon off of him with his pudgy, meaty arms instead of drawing his gun. Zimmerman had other options but as the prosecution will show through witnesses, Zimmerman lost more than one employment because he was too aggressive and they didn’t want to take the risk. That townhome complex is going to take a hit thanks to their Crime Watch volunteer. Glad I don’t live there. Yes, Ladyjane, Terri Schiavo was murdered by both political parties and a big cult that calls Pinellas home. Local RNC would hang up on Terri supporters. So, they got Barack Obama because so many left the GOP after Terri was murdered by not conservatives but by establishment republicans.

Florida's full of murders and wrongful deaths. Casey Anthony and George Z. should get together. They could share living expenses hiding from their infamous selves.

You just don't get it, do you? That's NOT a "stand your ground law." It's the regular, ordinary old law on self-defense. What happened to my friend happened in the nineties... long before anyone had ever conceived of a "stand your ground" law!

See, the word "defense" in "self-defense" has a meaning. So long as you are defending against an attack or threat, you can claim self-defense. As soon as you begin attacking (note the difference between that word and "defense"), especially after gaining the advantage (let's say, to make up a random scenario, you were sitting on top of someone, slamming his head into the ground while he screamed for help), you have become the aggressor and the new victim can now legally defend himself from you.

It's a simple and logical concept that has been part of common law for centuries...
