Zimmerman to face judge; Trayvon's mom says 'shooting was accident'

George Zimmerman woke up in a Seminole County jail cell this morning as the mother of Trayvon Martin, the teen he killed, revealed on national television that she thinks the shooting was an accident.

Asked what she would like to ask to Zimmerman, Trayvon's mother, Sybrina Fulton, told The Today Show that she wants an apology from him.

"I believe it was an accident. I believe it just got out of control and he couldn't turn the clock back," Fulton said, revealing her opinion on what happened the night her 17-year-old son was shot to death. "I would ask him, did he know that that was a minor, that that was a teenager and that he did not have a weapon."

We are still devastated by the loss of our son Trayvon Martin, and nothing can bring him back. But today, we are heartened to tell you that justice may finally be served for Trayvon.

This evening, Florida State Attorney Angela Corey announced that she will charge George Zimmerman with 2nd degree murder, weeks after he confessed to killing Trayvon -- and now he's in custody.

For weeks after Trayvon was killed, authorities refused to arrest Zimmerman. We couldn't believe that in 2012, public officials would turn a blind eye to our son's killing. We couldn't let that happen.

More than 2 million people joined our call for Zimmerman's arrest. We are so much closer to justice with the decision to bring charges against our son’s killer. We feel less alone knowing that so many people stood with our family during this impossible time.

When Trayvon was just nine, he ran into a burning house to save his father's life. He may be gone, but he is still our hero. We are so thankful to all of you who fought to honor his memory.

Thank you for standing with us, and with Trayvon.

How will Zimmerman be held civilly liable for Martin attacking him?

The witnesses, the cops, and the evidence are all going to exonerate this guy and show it was Martin who attacked Zimmerman.

Will Zimmerman be held liable for the damages to the city of Sanford and across the nation when the rioting occurs after he is found not guilty?

Because it happens so often that it's NOT NEWS.

On the other hand, a 'white' killing a 'black' is so rare, is becomes NATIONAL HEADLINE NEWS.

Initially, Zimmerman was arrested, he was handcuffed and taken to the police station. What’s your point?... that if the neighborhood watch guy had been black he would have been assumed guilty, and not let out of jail till a bond was posted? prove it and I’ll believe it... conjecture it, and I’ll conjecture my position. My conjecture is that no matter what the skin color of the neighborhood watchman, he is out trying to do good. Given all else being the same with witnesses and circumstance with only skin color being different, I believe we’d have the same results, only without black-backlash... though maybe LARAZA would have been called in to stir trouble instead of NBPP.

Note that in section 2 of the immunity statute 776.032 a person is “immune” from criminal or CIVIL action if they are not arrested. The arrest itself can be interpreted as “Probable Cause” the force, or action taken, was unlawful.

...and the operative word there is *prove*. Mass media-style hysterical innuendo won’t cut it. It must be proven beyond reasonable doubt and that’s a high bar to clear.

Personally I think she overcharged just hoping *something* would stick. Sort of like asking for a pony for Christmas knowing you won’t get it but maybe you’ll get the B-B gun. So maybe she’ll get manslaughter out of it (and can parlay that into her next political office).

The key element in this one is going to be the judge. Dear God, let it be an honest, impartial, and skillful one. There’s a lot hanging in the balance.

I believe he was taken into custody but not arrested. The difference for the family is without an official arrest they are unable to seek Civil damages.

I think if the shooter was black the outcome would only be different because there would be no manufactured racism and phony public outcry.

We don't. And they appear to feel entitled to a presumtion of innocence on their part from us that they have yet to afford to George Zimmerman.

If they can’t prove 2d degree, are they simply allowed to fall back to the next lower level of manslaughter?

You’d think that would require another trial if he wasn’t charged with it, since the standards are different.

Once the attorneys get through exposing who Trayvon was, and why he was out in th dark in the rain walking between houses the “Saint Trayvon of Sanford” image is going to fall

I was reading USA Today this morning (by accident, the hotel gives them out free) and they STILL had the picture of little 14 year old Trayvon, left out ANY mention of Trayvon attacking Zimmerman, said he was “shot while walking home” with “candy and ice tea in his pocket”, mentioned that there were witness but that “eyewitnesses are unreliable” (huh??)

If this is the public’s main source of info, no wonder the public knows NOTHING

This whole hooded klan event has back fired on the race hustlers. The git-Zimmerman racist display, threats and blood sacrifices of lynched whites was a means to an end of banning self defense laws in the US. But all Obammy’s chickens came home to roost for this race hate event and everyone heard Holder’s silence in the face of the Nation of Islam’s bounty on Zimmerman’s “white” head.

Why have we not seen any diagram of poor innocent St. Trayvon’s lifeless nody with the bullet path through his body?

I am guessing it supports the theory that he was on top. And the fact that their was a bullet fired but the next one was NOT chambered, means that something blocked it

I am guessing the dumbass tired to grab the gun and got what he deserved

The general rule is that if the prosecution does not include manslaughter as an alternative lesser included charge and the defendant does not request an instruction to allow the jury to find on the lesser included crime, then a failure to prove all the elements of second degree murder would demand that the jury return a verdict of not guilty.

In this case I do not believe that Zimmerman has been separately charged for voluntary or involuntary manslaughter. So it should be an all or nothing trial on the murder charge.

The State cannot later come back and charge the defendant on the lesser included charge. Of course that does not prevent Eric Holder from later holding a show trial on a Civil Rights violation.
