Dershowitz: Zimmerman Affidavit ‘Irresponsible And Unethical’
wagist.com ^ | 13 April, 2012 | Dan Linehan

Posted on 04/13/2012 10:55:07 AM PDT by marktwain

Harvard University law professor Alan Dershowitz made an appearance on on MSNBC’s Hardball to discuss the Zimmerman arrest affidavit, and had some incredibly harsh language for Angela Corey concerning her actions in the George Zimmerman prosecution.

Dershowitz is a well-known Democrat with a column on the Huffington Post, but seemed stunned by how poorly written the affidavit was, going so far as to call it “irresponsible and unethical,” as well as Corey’s actions politically motivated. He also said that if the prosecution didn’t have more evidence for the case than what we’ve seen, “a good judge would throw it out.”

Here’s the interview:

Smerconish: Joining me now, Harvard law professor Alan Dershowitz. Professor, I’ve really looked forward to this conversation. You’ve seen the affidavit of probable cause, what do you make of it?

Dershowitz: It won’t suffice. Most affidavits of probable cause are very thin; this is so thin that it won’t make it past a judge on a second degree murder charge. There’s simply nothing in there that would justify second degree murder. The elements of the crime aren’t established.

Basically what’s in the affidavit is what’s in the public domain, with the exception of a few little things that were put forward by your previous commentator. But the fact that the mother identified the voice as that of her son, of course, we all knew that was going to happen. There’s nothing in there of course either about the stains on the back of Zimmerman’s shirt, the blood on the back of his head, the bloody nose, all of that.

It’s not only thin, it’s irresponsible. I think that what you have here is an elected public official who made a campaign speech last night for reelection when she gave her presentation, and over-charged, way over-charged. This case will not, if the evidence is no stronger that what appears in the probable-cause affidavit, this case will result in an acquittal.

Very strongly worded statements from Dershowitz, who basically stopped just short of directly claiming Corey engaged in prosecutorial misconduct by her actions.

Interesting that Alan Dershowitz says this. He is not following the liberal playbook.

I swear he is getting more and more conservative as he ages...and the more I age, the more I seem to appreciate his comments!

You don’t even have to be a lawyer to see there is nothing to this. The defence attorney could have written it.

~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
Of course it was poorly written. It had to be dumbed down so the ignorant cracker hating race baiters could understand it.
The Dersh has been extremely quiet on liberal things the past few years, and has actually come out on the side of common sense a bit.
I think he may be having a hard time admitting that a liberal utopia conflicts with liberty, justice, freedom, and reality.
What worries me is that Zimmerman’s new lawyer strikes me as being pretty much on the prosecutor’s team. I think he’s a plant.
I think the fix is in.
This is going to be a slow-motion lynching which (since it’s 2nd degree murder) won’t end in an actual body hanging from a tree limb but “only” life in prison (where he will most likely become a body dangling from the end of a metal cot).
Zimmerman, I fear, is a lost cause. And though my heart goes out to him, I don’t believe there’s much any of us can do.
I can only hope this wakes up the Hispanic community to the reality of their “ally” in the White House.
This whole thing is orchestrated from the White House, of course.
Rush was talking about this. The theory is, that Angela Corey knew that Zimmerman can’t be convicted and never should have been charged, but for the good of her career (and perhaps, safety) she brought charges with a royally screwed up affidavit that would then force the judge to dismiss the case on a technicality. Thereby getting her neck out of the noose.
I have often said that scientists who really love science should speak most loudly against the Global Warming Scam. It hurts the entire profession when a bunch of con artists take over the dominant narrative.
Just so, lawyers who realy love and respect the law should speak most loudly against the abuse of the law for PC propaganda. It hurts the entire profession when a bunch of con artists take over the dominant narrative.
I think Dershowitz really respects the Law and I think he sees where the Law has become simply a political tool used by criminals in high places.
Dershowitz is a liberal, but he seems to be a lawyer first and foremost, and he isn’t merciful to what he sees as sloppy lawyering. This is starting to sound like Corey aiming as high as she can and hoping to either get a jury to convict on a lesser charge, or get Zimmerman to plead to a lesser charge. With a good dose of Nifong-style pandering to the Democratic base thrown in for seasoning.
On what possible basis do you believe Zimmerman’s lawyer secretly works for the prosecutor?
This means something. Obama has done the deed.
Slow to anger and quick to mercy...
The last people in the world you want to anger is the Jews.
Slow to anger does not mean ‘never’.
Obama and Co. has done it.
The word ‘wrath’ comes to mind.
” This whole thing is orchestrated from the White House, of course.”
Obama and Holder cooked this up. The race pimps, and MSM didn’t really enter the equation much until Obama “adopted” Trayvon. Any blood resulting from this belongs to Obama.
I can see the possibility. It's kind of ridiculous, but I won't discount that theory out of hand.
But we certainly live in unusual times when a professional decides that for the sake of her career, when she is handled a major case of national interest, her best bet is to screw the whole thing up by writing an affidavit which makes her look like a fool. An unusual strategy for career success.
Zimmerman must and will be convicted, thrown to the wolves,so to speak. Facts and law mean nothing to his case. Blacks must be placated!
I hope Zimmerman is acquitted, sues for false arrest and/or malicious prosecution and wins big.
And I hope Angela Corey loses her job.
Is Angela Corey deliberately throwing out a ricidulous and trumped up charge so “benefit” Zimmerman? Will this be thrown out?
Maybe. But others think she is dumber than Mike Nifong. She may really believe the Duke Univ. boys were guilty, And Obama was right; that the cops did “act stupidly”, and that Tawana Brawley was really raped, and Zimmerman hunted down and assassinated an innocent child.
Never underestimate a liberal woman with legal and political clout. They are insanely dangerous.
The affidavit is probably sufficient. As for Dershowitz he’s an arrogant jerk with a long history of criticizing other attorneys as incompetent. It’s an Ivy League thing it’s how they make money.
