DURBIN: Let me just ask you this: John Roberts said that Roe v. Wade is the settled law of the land. Do you believe it is the settled law of the land?

ALITO: Roe v. Wade is an important precedent of the Supreme Court. It was decided in 1973. So it’s been on the books for a long time. It has been challenged on a number of occasions. And I discussed those yesterday.

And it is my — and the Supreme Court has reaffirmed the decision; sometimes on the merits; sometimes — in Casey — based on stare decisis. And I think that when a decision is challenged and it is reaffirmed, that strengthens its value as stare decisis for at least two reasons.

First of all, the more often a decision is reaffirmed, the more people tend to rely on it. Secondly, I think stare decisis reflects the view that there is wisdom embedded in decisions that have been made by prior justices who take the same oath and are scholars and are conscientious. And when they examine a question and they reach a conclusion, I think that’s entitled to considerable respect. And, of course, the more times that happens, the more respect the decision is entitled to. And that’s my view of that.

So it’s a very important precedent...

DURBIN: Is it the settled law of the land?

ALITO: If “settled” means that it can’t be reexamined, then that’s one thing. If “settled” means that it is a precedent that is entitled to respect as stare decisis and all of the factors that I’ve mentioned come into play, including the reaffirmation and all of that, then it is a precedent that is protected, entitled to respect under the doctrine of stare decisis in that way.

DURBIN: How do you see it?

ALITO: I have explained, Senator, as best I can how I see it. It a precedent that has now been on the books for several decades. It has been challenged. It has been reaffirmed.

But it is an issue that is involved in litigation now at all levels. There is an abortion case before the Supreme Court this term. There are abortion cases in the lower courts. I’ve sat on three of them on the Court of Appeals for the 3rd Circuit. I’m sure there are others in other courts of appeals or working their way toward the courts of appeals right now. So it’s an issue that is involved in a considerable amount of litigation that is going on.

Newt is my guy. I voted for him in the primaries. Vote for who you like in your primary. But you guys with the slogans that won’t vote for Romney if he is the candidate in the Nationals will watch all of your “Conservative Values” that you are so proud of go up in smoke as obummer appoints 2 more Supremes during the next term.

I feel the same way. Voted for Newt and I hope that he stays in it and can get the nomination at the convention. Hate the whole group of Bushes, McCain, Romney, etc. Romney is my last choice for the GOP as I bounced between Cain, Newt, Santorum then back to Newt. Was and still is anybody but Romney for me. However, if Willard does become the nominee, as much as I dislike him, I will vote for him over the usurper known as 0bama in a second.

No less than 2 new ultra-libs on the supreme court, severe cuts in oil production, phasing out the entire coal industry, acceleration of already out of control spending, crushing taxes, another round of huge job losses due to even more regulations coming down the pike, a corrupt out of control Department of Injustice, a nanny state controlling every aspect of our lives. I won't even touch on the whole gutting of our Armed Forces, making backroom deals with Iran, Russia and every other dictator who will "accept" all of our apologies.

Every aspect of what makes us the greatest country on the face of the Earth will be purposely torn apart by 0bama. In short, 4 more years of 0bummer will change this country in ways which I think we will never recover. Like Levin says: It's TYRANNY.

I’ve already answered that question. First, I wasn’t voting for McAmnesty, I was voting for Sarah. Second, in the very least, McLame was pro-life and a war veteran. I absolutely will not vote for an abortionist, homosexualist, socialist draft dodger. And it won’t matter who is running mate is.

My pleasure. I got tired of the Sarah Palin stuff. She’s repeatedly stated ABO. I guess some folks have not paid attention.

Like I said, all the candidates, save for Ron Paul, (who likely wants to make a run of his own), have pledged to support the eventual nominee, so huge shocker, I guess that will make all of them RINOS too, along with DeMint, Ryan and the others who have already endorsed Romney.

I cannot vote for Romney for reasons of my own, -— namely I can’t ever trust a liar, so I’m praying mightily for Divine Intervention, and it’s still not yet mid April and a lot can happen between now and August, and even in between now and June!

Keep the faith and GO NEWT!

This country will not survive four years of a Marxist traitor (Romney), and I will NOT be a part of helping that happen.

There is NO comparison here. Romney is also PURE evil. He hates America, and he is doing everything in his power to destroy the country we love.

Romney is a ‘white and delightsome’ (to use a Book of Mormon phrase) version of Obama and I will not stand before my God and try to explain why I voted for a man who usurps the office of Christ (High Priest of Melchizedek), makes Satanic covenants, supports the murder of the unborn and believes he will one day work his way to godhood himself.

As a Christian, I cannot vote for Romney.

As a CONSERVATIVE, I cannot vote for Romney.

As a Republican, it will be the death of the party if they nominate Romney so I will have to go elsewhere.

There were those who said that the GOP would never make it, that it was only the Dems and Whigs. The GOP needs to go the way of the Whigs.

Damned straight my friend... their will’s and noonan’s and krauthammer’s have tried to marginalize the TEA Party effort and op eds have been written by so called conservative pundits... stating that the TEA Party was never responsible for the 2010 Victory. You know these people because they will always remind us of the two TEA Party women that lost... one in Liberal NY and one in LIBERAL Delaware. These people are my enemy as surely as pelosi and reid. They are liars for hire... selling themselves for a fee... there is a name for that... I just can't remember what it is.
