Judge in George Zimmerman case offers to recuse herself (Husband has ties to CNN)

A Florida judge on Friday offered to recuse herself from the George Zimmerman case in a surprise hearing because of her husband's ties to a CNN legal analyst and commentator.

The Orlando Sentinel reports that Judge Jessica Recksiedler disclosed that her husband works for Mark NeJame, a prominent Orlando attorney, in the five-minute hearing Friday afternoon. In addition to working for his law firm, NeJame sounds off on the Zimmerman case for CNN. It's unclear if either attorney will take Recksiedler up on her offer and ask her to step aside....

The judge admits her conflict, and bias.

I hope that is the case but I feel it is more to keep the NBPP from creating a dead or alive poster for her when she throws out the case.

Orlando attorney Mark NeJame knows attorney Mark O’Mara well. They were co-commentators for WKMG-Channel 6 during the Casey Anthony trial. NeJame, now a legal analyst for CNN, called O’Mara “a very excellent choice” for George Zimmerman’s attorney.

Zimmerman on Wednesday was charged with second-degree murder in the shooting death of 17-year-old Trayvon Martin.

“I spent about two months with him [O'Mara], almost every day [during the Anthony trial],” NeJame said on CNN this morning. “Mark knows the law inside out. As you saw in his press conference yesterday, it was very measured. He’s very controlled, very compassionate and a strong advocate.”

On CNN, NeJame revealed that he pointed Zimmerman in O’Mara’s direction. “Very simply, we got a phone call from Mr. Zimmerman,” NeJame said. But NeJame, the father of young children, said he didn’t want to handle such a high-profile, time-consuming case.

NeJame said he gave five names to Zimmerman and his people. ”They researched and found Mark to be the one they want to go with,” NeJame said. “They made a very excellent choice.”

NeJame cautioned that a lot of things need to be learned about the case “before people take these extreme, polarizing sides that they’ve taken.” NeJame called Trayvon’s shooting death a true tragedy for everyone involved.

Reading comprehension loses again. She has “offered” to allow Zim’s defense attorney to file a motion asking her to recuse herself. (She will then dismiss the motion.)

The judge is not “admitting” bias. She’s acknowledging an appearance of conflict. All judges have conflict lists.

Ya’ll are too cynical and ready to jump to wrong conclusions because you see her hubby commentates for CNN. Read the article I posted. This judge’s husband is a defense attorney and knows Zimmerman’s attorney Mark O’Mara. As a matter of fact he’s the one who recommended O’Mara to Zimmerman’s family.
The conflict the judge has is more pro-defense.

No one wants to be anywhere near this case.

Wait and see, there is no way that Angela Corey will personally prosecute this case. Some flunky will be told to hold the bag.

The drive-by media have painted it as a grown white man vigilante hunting down and killing a young black boy.

The problem is that the actual facts are we have on the one hand (1) a 5’8” slightly pudgy jewish-hispanic who tutors black kids on the weekends, and on the other hand (2) a 6’2” “No-Limit-N*gg*” (what he called himself) with gold teeth, tattoos, marijuana, burglary-tool-and-ladies-jewelry and sporting a serious gangsta attitude (judging by his twitter account) on the other hand.

When “the man” asked him what he was doing in the neighborhood did it suddenly occur to Trayvon that he might be able to make his gangsta bones in that moment by beating the head in of the little hispanic man standing in front of him? There is nothing that gets more respect in the gangsta world than having killed someone.

Goodness I guess nobody reads the dang thread before commenting. This judge does have a legitimate appearance of conflict that needed to be publicly acknowledged. Her husband is the one who gave the Zimmerman family his current attorney Mark O’Mara’s name for helping with the defense.

Actually it does not appear that it was her husband who recommended Mark O’Mara, only that it was someone else who happens to be in the same law firm who recommended him.

Unless there is something more to it, it is questionable that there is even an appearance of impropriety. If it was just the recommendation we’re talking about and not the disclosure of confidences, then it’s a pretty weak “appearance of impropriety.”

If you are a lawyer and someone contacts you to take a case, and you decline because of a conflict or some other reason, it’s not unusual to point that person to other law firms in the area who specialize in handling those types of cases. That does not in and of itself create a conflict for another person in your firm.

But anyone can argue pretty much anything is an “appearance” of impropriety, so if someone doesn’t want to be involved, it’s a good way to get off the hook because no one can really second guess it.

Okay maybe my reading comprehension skills are off, because it’s simple to me. The judge’s husband Mark Nejame is a legal commentator on CNN and used to work with Zimmerman’s current attorney Mark O Mara on TV doing commentary for legal cases.
When the Zimmerman family saw NeJame on TV doing commentary they contact him to represent George, but he declined to take their case however he pointed them to a few of his colleagues who would do a good job.

This DOES have an APPEARANCE of conflict on the judges part. Maybe only a slight appearance of conflict, but if she lets say had a husband who recommended a good attorney to the Martin family I would want her off the case.

You can bet Mark NeJame was hoping she wouldn’t get caught. So much for journalistic ethics, CNN didn’t even bother to disclose he was married to the judge who was going to decide the fate of Zimmerman. This whole story has stunk from day one.

This would be a tough decision for the Zimmerman counsel, the defendant does not get to pick the judge, it is a case of what’s worse, the devil you know, or the devil you don’t.

No doubt Sotomayor or Kagan have no ethics. However, I don’t think this judge does either. IF she did, she would immediately dismiss the case because the charge is wrong.

However, I think she won’t and knows she should. Basically, she knows that a conviction won’t happen and she doesn’t want to be the judge that it happens under. So, she is attempting to get out of a sticky position. She is an elected official.

Reminds me of the Judge in “Miracle of 34th Street” that didn’t want to be the Judge overseeing the prosecution of Santa. It is political suicide. Or, it could put her in physical risk of harm.

The mob wants blood and won’t accept no for an answer. I certainly hope they calm down soon. We don’t need things to set back race relations in this country.

Zimmerman is NOT guilty of 2nd Degree murder nor manslaughter.

Okay, I have to agree with you in part.

Not on the “recommendation” concern, for reasons I gave.

But as to the “TV commentary” part, I agree it IS an appearance of impropriety for Nejame to get on TV every night and bloviate about the case when his colleague’s wife is the judge.

But the proper resolution here is for Nejame NOT to go on TV every night and bloviate about the case.

The judge was elected by the people in her district and occupies a public position of trust and responsibility.

She should be expected to fulfill her responsibilities.

But no one elected Nejame to go on TV and play footsie with Anderson Cooper and Wolf Blitzer. No one is forcing him to do it.

In principle, the judge should fulfill her responsibility and Mr. Hollywood should refrain from being a public commentator on this particular case, in order not to create the appearance of impropriety vis-a-vis his colleague, the judge’s husband.

I bet this judge is hoping upon hope that they ask her to recuse herself.

We’ve already got the SP playing the role of Pilate and the New Black Panther Party and the whole race-pimping media playing the role of the crowd shouting “Crucify Him!”

No doubt before this is done we’ll have our own little Passion Play fully cast.
