RUSH: The media is beside itself over the government's performance at the Supreme Court yesterday on the Arizona immigration law. We've got audio sound bites. Jeffrey Toobin, somebody get him away from high places. Somebody take the belt off of his slacks. Jeffrey Toobin is beside himself. He thinks they're gonna lose the health care thing, and he thinks that this debacle yesterday on the Arizona immigration law hurts.
These media people are showing the wide-eyed amazement that they displayed in the oral arguments over health care, and they're gob-smacked that the justices might actually uphold the Arizona law. They are so wedded to this regime, they can't believe anything going against it in any other branch of government. And they literally are beside themselves. They have been hit upside the head. They do not know what hit them. None of this is working out as it was supposed to. So we have three Drive-By news organizations who have headlined and detailed the unemployment news truthfully, negatively, honestly. And now, almost in defeat, throwing up their hands over the government's continued lackluster performance in oral arguments at the Supreme Court.
It's almost like before yesterday, the idea that the Supreme Court would find for Arizona and its immigration law never even crossed their minds. Just like it never crossed their minds that the Supreme Court would find Obamacare unconstitutional. They live in such a cloistered world in and among themselves that they do not even consider that their worldview might not occur. What's interesting is the Arizona law is basically... Well, it's not "harmless," but it's let me describe for you. All the Arizona state law does is require Arizona law enforcement officials (that would be "police" for those of you in Rio Linda) to enforce federal law on immigration.
There's no conflict between the Arizona state law and the federal law that anybody can cite, not even Mr. Verrilli. The government lawyer could not find and could not cite any conflict. So there's nothing unconstitutional about the Arizona law. It should be allowed to stand. But the news media, all they can do is echo Obama and claim that enforcing the federal laws on immigration is mean. "It's just mean. It's mean to send people back. It's just mean to identify people who are here illegally. We shouldn't be doing that." But isn't that always the case with laws? Aren't laws supposed to be mean to lawbreakers, depending upon the severity of the law?
But the court could not come up with a single rational reason to strike it down. These people were beside themselves.
It is hard to fight for bad causes.
It is very hard to defend bad causes.

Appeal to emotions don’t work that well in legal argument, yet.
Obama and is regime are just not that smart.They should understand that by now.You’d have to be an idiot to hire an attorney this bad.....
It’s as is they are so used to the complicit msm letting them get away with-heck, helping them-make their “arguments” on the grounds of political correctness and airy appeals to emotion, that they forget that once actually before the court, they will have to resort to arguments based on law, precedent, and rationality. Or else they’re AA tokens and never had to do so in the first place.

Conspiracy Theory Time:
No Solicitor General is this incompetent. The assistant manager of your local Dairy Queen could have argued these cases more effectively than what we’ve seen.
Obama is tanking it. He wants to lose these cases so that he can in turn use that to fire-up his base and to run AGAINST the Supreme Court.
If he wins a second term he will then propose an FDR Court Packing Plan or something similar to try and cement liberal hegemony on his policies going forward. And he will claim to have the support of the American People because he ran on that.
I should say, once before THIS court-I know there are plenty of lower courts where they get away with that mess from dusk till dawn.
Look for more ugly threats against the Court from the regime and the punditry. That’s all they have.
I guarantee you, these attorneys are the smartest the left has. And you can apply all logical conclusions from there.
I don’t think he’s that devious or that smart. Everything he’s ever “accomplished” has been handed to him by those using him. He campaigns hard because that’s a matter of personal ego, and he likes the perks and the appearance of power. He loves the “love”. Almost everything he really makes a stand on and actually puts a little effort into, is based on his own motives of revenge, not because he has any base of ideology, at least not any traditionally American political one.
It is just no one can defend the psychopath in chief.
When you read the transcript of the hearing, you realize that the Feds were trying to defend the indefensible. I almost felt sorry for VERRILLI who was like the guy who brought a knife to a gun fight. The Feds should never have sued AZ in the first place. Hopefully, this will blow up in June along with the Obamacare case and set the stage for a massive defeat of The One.
BS. The Feds had no case to begin with. They should never have sued AZ. There was no case for preemption. The AZ law was/is constitutional. You can't defend the indefensible. Read the transcript.

Something just doesn’t seem right. I don’t know what it is, but something just doesn’t seem right. Obama’s lawyers aren’t stupid. They can’t be. You don’t rise to a position of power like that without having some smarts. None-the-less they are defending themselves horribly.
They honestly didn’t discuss answering obvious questions in a way to not make themselves look stupid?

I agree Obama is not nearly that smart. Some of his handlers though are extremely devious. This has the stink of Axelrod about it.
In my world view, the US Supreme Court should not fall prey to any of those tactics. If the Justices forgot who appointed them (which will never happen), the ACA would be overturned, and the Arizona law would be upheld...by unanimous decisions.
Until they get before the SCOTUS, and then it's made plain that the Emperor Barack has no clothes.
The best part? The WaPo spins this as a politicized court, as though the decision to refuse to enforce the laws was not political.
He won't be able to credibly use that argument. Even Sotomayor is telling Mr. Verrelli that the governments reasoning is "not cutting it". If even one of the libs on the Supreme Court votes for Arizona, the future implications will be tremendous.
Bad as this case went for the Feds I bet Kagen and Sotomayor still find for the Feds.
I’ve been burned by the SCOTUS way too many times to get my hopes up here.
I want to believe, but I just have this terrible, creeping suspicion that there are going to be ton of very very upset conservatives in June.

I think you nailed it. These people have been so protected by the MSM for their entire life, that when they face a situation where the MSM has less influence than they are used to, it is like a tame rabbit being let loose with wild coyotes. They have been so protected for so long that they think it is "state of nature".

I understand, but it’s common sense (yes, I know they lack it with the laws they are trying to pass, policies, etc.). Anyone going into a huge court case goes over questions they might be asked. At least come up with decent responses. They responded with horrible answers. I just can’t see them being not smart enough to do be this bad. I hope and pray I”m wrong, but something feels wrong.

Exactly. It was an absurd and politically motivated attack by the DOJ on a state. AZ was not preempting federal law but following it!
Just like their political attacks from the EPA against law-abiding fracking nat gas companies.
The good news is that Obama has not corrupted the courts enough to get away with it (we hope).

There are many cases where God confused the enemies of His people, delivering those enemies into the hands of those He loves. I don’t find it unreasonable that they “choked”.
