It is not a matter of following it. Obama was never challenged by the GOP and the Tribe/Olson opinion was requested by the Senate to determine McCain’s eligibility. If it was settled law re the definition of natural born citizen, then why ask for a legal opinion?

Obama was on the senate. Tribe was on his campaign staff. You don't see an obvious conflict of interest?? And let's not forget, Obama didn't release his alleged COLB until after Hillary conceded the primary and several months after the McCain resolution was passed. The GOP didn't know he was going to forge his birth credentials. McCain sure as hell wasn't going to challenge him after a quid pro quo.

"It is not like the MSM will ever touch it."

Unfortunately, it is much more than the MSM. I don't think the facts or any legal argument matter. There is no instrumentality of government that will touch him and numerous examples of earlier challenges being ruled against or sidetracked. The only potential effect is on the election and the media will make sure that is really deemphasized and ignored, too.

A question ... if we cannot trust this man to tell the truth about his past (zer0 has been very secretive of his past - executive orders to cover-up his past) how does America trust him now?

If it was a mistake, it was perpetuated years later when local Chicago newspapers again wrote that he was born in Kenya when he ran for state office. I highly doubt they obtained that information from this old bio that his literary agent drew up.

That resolution was based on the Tribe/Olson opinion. And it really didn’t make McCain “eligible” to run. The Senate Resolution has no force of law. The matter was never brought to the courts. The definition of “natural born citizen” as it applies to eligibility to serve as President and Vice President has never been resolved.

Kabar,
I am with you on your daughter having the right of natural born where you were overseas defending our country and your wife was a naturalized citizen. There should be no issue that she is not a natural born. Citizenship should naturally flow through the parents. Your heart and your wife’s heart is with the United States.

Obama’s parents hearts were never with the United States. There was no natural flow of allegiance through them.

I wish our country would come together on this issue and realize that to be a natural born is to naturally flow through both parents. This is how it should be!

Fly over and squatter birthrights should never be given!

It's the same reason Rush and Levin don't embrace the story. It's not some grand conspiracy, despite what some FReepers seem to think.

Look at it this way. If Rush Limbaugh said "the sky is blue" there are about 20 million morons in this country that would cease to believe that the sky is blue for the rest of their lives and they would gouge their eyes out for agreeing with Rush Limbaugh. Rush knows this and on certain subjects he subtly directs people to other sources that won't be rejected out of hand.

To a lesser extent the same phenomena is true for all right-wing pundits and authors. The mere fact that they say something is the proof that it's wrong and shuts the doors in those tiny minds out there to any other explanation. Forever.

He does not look at the stories online as he does them.

Actually he does. He has his computer monitor directly to his right and it is always open to Drudge. We shall see tomorrow after the Alphabets ignore the story, whether it gains any traction. Open line Friday will tell the tale because you know his listeners will be asking about it.

The obvious answer here is it would not be good business and unfair to his advertisers to send his listeners to Drudge during his show, so he sent them after his show was over.

The Supreme Court has followed the Law of Nations in defining natural-born citizen. They did so in Minor v. Happersett, which was quoted and affirmed in U.S. v. Wong Kim Ark. Eighteen Supreme Court justices agreed on the NBC definition. In the law of nations, it says children born in the Armies of the state are considered born in the country if they are born abroad. This made McCain a natural-born citizen. The Law of Nations definition does NOT, however, make Obama a natural-born citizen and neither do the two Supreme Court cases that were cited. Obama doesn’t even meet the court’s 14th amendment definition.

Tribe and Olson said this:

Historical practice confirms that birth on soil that is under the sovereignty of the United States, but not within a State, satisfies the Natural Born Citizen Clause. For example, Vice President Charles Curtis was born in the territory of Kansas on January 25, 1860 — one year before Kansas became a State. Because the Twelfth Amendment requires that Vice Presidents possess the same qualifications as Presidents, the service of Vice President Curtis verifies that the phrase “natural born Citizen” includes birth outside of any State but within U.S. territory. Similarly, Senator Barry Goldwater was born in Arizona before its statehood, yet attained the Republican Party’s presidential nomination in 1964. And Senator Barack Obama was born in Hawaii on August 4, 1961 — not long after its admission to the Union on August 21, 1959. We find it inconceivable that Senator Obama would have been ineligible for the Presidency had he been born two years earlier.

Essentially, when you read the entire opinion, you can be a "natural born citizen thru jus sanguinis OR jus solis. You don't need both. That is Tribe and Olson's opinion. SCOTUS has yet to rule on it in connection with eligibility to be President. We desperately need a decision on this issue given the changing demographics of this country fueled by immigration.

Minor vs Happersett is the closest settled law that I know of on the subject.

The point was SR 511 and who signed off on it, you're right about force of law of the resolution but why was it necessary to begin with?

Also note the use of the term parents in it.

BTW, meant to say thank you for your service!

LOL

The SCOTUS HAS already construed the term, and it is EXACTLY that which I have given you.

I believe it's you who are interpreting things the way you would like to see them.

It's funny that you bring up the issue of anchor babies. Anchor babies are given citizenship based on the SCOTUS's determination of the 'jurisdiction clause' of the 14th Amendment. Care to read a quote from John Bingham, the father of the 14th Amendment? Sound familiar?

I find no fault with the introductory clause, which is simply declaratory of what is written in the Constitution, that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural-born citizen;

You seem to be missing the point. The reason I mentioned anchor babies and the growing foreign born population of the US is because of the urgency to resolve it. There are over 15 million green card holders running around this country. They are having children as well. Can their offspring born in the US be eligible to be President?

Without the media will tell Americans all which has been dug up about this man Obama, yet instead will vet anyone who questions this issue to the hilt, there is something which has been lost of our nation's sanity(imho). Even though level playing fields do not exist (anywhere) one would think politicians would be vetted for the good of keeping our nation great. Guess not.

The uber-liberal New York Magazine reports:

Breitbart.com, as part of its continuing quest to bring you the stories the mainstream media refuses to report on, or else has already reported on but without the requisite paranoid hysteria, has a breathtaking new blockbuster exclusive: Barack Obama's literary agent created a promotional booklet in 1991 that described him as having been "born in Kenya."
There's a bit more at the link plus 202 comments and counting. I haven't looked at the comments yet but I would guess that NY Mag has more left-wing posters than we do here at FR.

Ummm, you’re not paying attention. I already pointed out that Tribe was Obama’s adviser. Why on Earth are we to think he would write an opinion that would prevent Obama from being eligible for office?? Eighteen Supreme Court justices agreed on an exclusive definition of natural-born citizen: all children born in the country to citizen parents. It requires both jus soli and jus sanguinis. It jibes with the Law of Nations. The Supreme Court is the nation’s highest judicial authority and it outweighs the opinions of Obama’s campaign adviser.

Finally, something I agree with you on.

But it will never happen. The SCOTUS will avoid the issue for the same reason that the Republicans avoided the issue. For the same reason the Hillary avoided the issue in the primaries in 2008.

They all are, or did, avoid this issue for the same reason - if Obama is shown to be not eligible for the office of POTUS, is could honestly start a civil war.

Look at how Obama, and the left are dividing the whites and blacks, and the rich and poor, 1% and 99%.... We are becoming a much more divided nation. I believe part of the reason this is happening is to put the country in a position that those in the position to rule Oboma ineligible, will not do so for the good of the country.

That’s more or less as I remembered. 309(c) provides:

“(c) Notwithstanding the provision of subsection (a) of this section, a person born, after December 23, 1952, outside the United States and out of wedlock shall be held to have acquired at birth the nationality status of his mother, if the mother had the nationality of the United States at the time of such person’s birth, and if the mother had previously been physically present in the United States or one of its outlying possessions for a continuous period of one year.”

The question is, by “nationality status,” do they mean just plain nationality? Or do they mean (i) just plain nationality when the mother is a national but not a citizen of the U.S. but (ii) nationality plus citizenship if the mother is a national and citizen of the U.S.?

If “nationality status” includes both nationality and citizenship in cases in which the mother is a U.S. citizen (who had previously resided in the U.S. for at least one uninterrupted year), then you are correct and Obama would be a U.S. citizen at birth even if born abroad if his mother was not actually married at the time.

Of course, it’s not clear whether Obama was born “out of wedlock” pursuant to the statute. Barack Obama, Sr. and Stanley Ann Dunham got married in Hawaii while Dunham was pregnant with Obama, and got divorced years later, which is evidence that Obama was not born out of wedlock. However, Barack Obama, Sr. had previously been married in Kenya, and there is no evidence that he had divorced his previous wife (who was still alive) at the time of his wedding to Dunham. That certainly complicates matters, but it seems to me that when the statute refers to “out of wedlock” births the term would not extend to births involving a mother who had been married in a legal ceremony in the U.S.

So in the event that Obama was born in Kenya, his only plausible claims to being a U.S. citizen at birth would be that (i) that his biological father was not Barack Obama, but a black U.S. citizen or U.S. national or (ii) his parents’ marriage was null and void ab initio given his father’s still valid marriage in Kenya, and the subsequent divorce was a sham.

Yes, the Supreme Court did make a definitive decision - back in 1874! It is called Miner v. Hapersett.

(I've given these facts to you many times; for emotional reasons you refuse to recognize the truth.)

Sen. John McCain was born in an unincorporated territory, the Panama Canal Zone, and is a citizen, like your daughter is a citizen, because of parental citizenship. McCain is no more eligible to be President than your daughter is eligible. He accepted hundreds of thousands of dollars in donations from George Soros, who wants to destroy the U.S. It was a setup in 2008.

When the Constitution was written, no one then living anticipated the U.S. military occupying overseas nations. But it shouldn't matter as those children are granted citizenship via their parents. The fact they are ineligible to be President or VP is too bad, but that's the law.

You are confusing citizenship with an eligibility requirement to be President. They are different. Such is life.

BHO2 and the Democratic Party have committed fraud and possibly worse, treason, knowingly promoting as eligible for the Presidency a man who is a foreign national. The Republicans should not be tempted into following suit.

Many people investigating BHO2’s birth have had their lives and the lives of their children threatened, including some who post here on Free Republic - butterdezillion and MissTickley come to mind. This is a serious matter and people have died because of BHO2’s craven desire to cover up his background.
