The California Suoreme Court is composed of seven members. Years back the Court voted 4-3 that the death penalty violated the California constitution. All the death-row prisoners’ sentences were reduced to a term of life (with the possibility of parole). Outraged California voters removed the four justices in a subsequent recall election.

True and a good example, which Iowa followed in voting out three Supremes for instituting gay marriage in 2010. But Manson had been commuted 14 years by the idiot Furman decision. Did any of the Framers consider capital punishment unusual? And the then usual definition of cruel went a lot further than what was done in Charlie's day.
