Cops gun down man for legally carrying firearm

Erik Scott was a West Point graduate who went on to serve honorably in the Army, get his MBA from Duke and establish a lucrative career in real estate and as a sales rep for a medical device company. He was 38 years old when he was gunned down in 2010 in the portico of a Las Vegas area Costco store by officers from the Las Vegas Metro Police Department. While it was 7 bullets from the only people we’re supposed to trust with guns that snuffed out Erik Scott’s life, what really killed him was an irrational fear of firearms – hoplophobia

Lead officer gave him commands that can be clearly heard on the tape, but other commands and voices can also be heard.

Well, what was the command?

What were those other commands?

It sounds like multiple commands

Were all the commands the same?

If they said they found 15 or 20 extra guns on him I would believe it. Thjey planted them there, why shouldn’t they find them. The only thing more repugnant and discipicle about that incident is someone that alibis for and defends those who done it. The poor guy was murdered in cold blood.

I’ve been reading thru the posts at the Erik Scott Index Archive, bottom-to-top, to get it into time-line perspective.

I can’t believe what I’m reading there. How the heck did I miss all that, despite not being on FR? I’m so truly stunned and saddened at what happened. I have some friends and former customers who are LEOs, in various agencies, and I can’t imagine any of them doing something this. I know them too well. I’ve never personally run into a corrupt LEO, but they’re out there, I know.

That said, I hope the truth comes out, and Erik Scott receives due justice for what happened.

When they told him to, he obeyed and laid down with his hands above his head while the trained guns on him.

Then they shot while him screaming, “he’s reaching for his gun” trying to alter the witnesses’ experiences to confuse them. The witnesses that were interviewed held their own minds and were not effected by the manipulation. The victim’s hands were no where near the gun.

Ainvestigation found that Las Vegas police officers have more shootings than officers at many other jurisdictions and that the agency did little to learn from the incidents.

Las Vegas police recently paid a $1.7 million settlement in 2010’s other controversial shooting, the death of Trevon Cole. Cole was shot in the head by officer Bryan Yant during a botched drug raid on Cole’s east valley apartment about a month before Scott’s death.

Apparently the *Buddy Hackett*impersonator had a previous problem with a OTJ shooting.

And where is the ACLU or Justice Department? And were there no nonlethal devices available? Seems like just about everyone is getting Tasered these days. Hopefully a civil suit will follow although I'm of the opinion our government should have instituted a thorough review of this case. While much smaller in scale, this use of excessive force is reminiscent of Ruby Ridge and Waco.

I can see, you feel strongly about this article. FFIW, there *is* fear that anti-gunners play upon; should you live in Connecticut, if your neighbor feels *threatened* by seeing you carry your gun into your own home, say, from your vehicle into your house, e.g., s/he can call the cops....on a *breach of peace charge.* Expect a *SWAT* team in minutes. ..the *interpretation of the law will be something on the order of *plainly carrying a firearm, and you either intend to alarm people or are irresponsible.* Here‘s the relevant Breach of Peace statute:

(a) A person is guilty of breach of the peace in the second degree when, with intent to cause inconvenience, annoyance or alarm, or recklessly creating a risk thereof, such person: (1) Engages in fighting or in violent, tumultuous or threatening behavior in a public place; or (2) assaults or strikes another; or (3) threatens to commit any crime against another person or such other person’s property; or (4) publicly exhibits, distributes, posts up or advertises any offensive, indecent or abusive matter concerning any person; or (5) in a public place, uses abusive or obscene language or makes an obscene gesture; or (6) creates a public and hazardous or physically offensive condition by any act which such person is not licensed or privileged to do. For purposes of this section, “public place” means any area that is used or held out for use by the public whether owned or operated by public or private interests.

So now, gun owners must behave responsibly, but the law doesn’t care about the illegality of the arrests that ensue from that responsible, legal, behavior.

This is the classic case here: James Goldberg of Glastonbury, Conn., recently was arrested for carrying a firearm at his neighborhood Chili’s restaurant, and his release because his actions were legal has sparked a major debate over the Second Amendment.

But the legislative director for the Massachusetts Gun Owners Action League, Jim Wallace, contends the case is evidence of the successful work of gun opponents in demonizing the hardware itself, using fear to crack down on a legal activity.

“I am not quite sure what the hysteria is about people carrying anything,” Wallace said.

“If police officers carry openly, is the general public scared? They shouldn’t be. Nor should they be scared if their fellow citizens are doing the same thing. The problem is the irrational stigma, probably created by the media, about guns themselves,” Wallace said.

“What the gun opponents are fostering is a basic mistrust of their fellow citizens,” Wallace said. “I’ve asked students at forums what they don’t trust about the person next to them. They usually answer, ‘I trust him, he’s my friend.’

“Then I usually say, ‘So what’s the problem?’ If you trust him, there shouldn’t be a problem,” Wallace said.

Goldberg was released because under the provisions of the Connecticut firearms-permit law, he was carrying legally.

Connecticut is one of 13 states that allow open carry with restrictions. According to The Free Library, others are Utah, North Dakota, Minnesota, Iowa, Tennessee, Mississippi, Georgia, Indiana, Maryland, New Jersey, Rhode Island and Massachusetts. States that offer open carry without licenses or restrictions are Alaska, Montana, Idaho, Wyoming, Nevada, Arizona, New Mexico, South Dakota, Vermont, Kentucky and Virginia.

While all states have their own variations of rules and regulations, Second Amendment advocates say the Goldberg case is a worrisome indicator.

Connecticut Citizens Defense League President Scott Wilson said that while the Chili’s employees may have been well-intentioned, the greater issue was ignorance of the law. “There is a perceived notion that if someone outside the law in Connecticut is carrying a firearm, concealed or otherwise, then someone is probably engaging in some type of illegal act,” Wilson said.

“Never mind what the employees thought. The police themselves are unaware of the law. On many occasions, talking with retired or active-duty state police officers in Connecticut, they very simply don’t know the law,” Wilson said. “And in some cases, even after I’ve pointed it out to them, they throw out, ‘Well, we will charge you with breach of peace.’ So it’s not just the employees of Chili’s. Police officers, Connecticut state troopers, and a lot of NRA instructors who teach the safety course here in Connecticut don’t know the law,” Wilson said.

Wallace said he looks at it as a picture of the whole nation.

“The problem is a nationwide perception of people with guns,” he said.

Wilson cited the immediate reaction following the Goldberg case: lawmakers in the Connecticut Legislature proposed a plan to take away the open-carry provisions.

While it wasn’t successful, Wilson said the reaction was alarming.

“The Connecticut Constitution, Article 1, Section 15, says clearly, ‘Every citizen has a right to bear arms in defense of himself and the state,’” Wilson said. “Plain and simple, Connecticut is an open-carry state provided the person has a Connecticut permit to carry pistols and revolvers.” Democratic State Rep. Stephen Dargan said bills were introduced to “plug the hole” in the law, but they didn’t go anywhere, and he believes there is a better way to deal with it. “The best solution is to inform the public about the citizen’s right to carry firearms. That will be a lot better than trying to pass a lot of unnecessary laws. Let’s inform the people about what the Second Amendment means and that Connecticut understands that people have a right to keep and bear arms,” Dargan said.

Once they confiscate your firearms, it may be years B4 you get you permit to carry back Goldberg’s incident at the Chili’s is not isolated. Even though most states now allow carry permits, a number of citizens have been arrested and charged for gun-law violations.

The San Jose Mercury News reports police arrested Sherman Fontano for carrying an unloaded .357 revolver. Fontano said California law allows for the open carry of an unloaded firearm.

In March, the Starbucks coffee-shop chain created a furor by agreeing to allow people with legally issued handgun permits to carry their guns into the shops, following a case in Seattle in which people carried firearms into the store.

States’ rules regarding carrying weapons vary widely, with 16 states having procedures to issue permits. Currently Illinois and Wisconsin are the only two U.S. states that do not issue permits for either concealed or open carry of firearms.
