75-year-old man charged with fatally shooting boy, 13(WI)

Everyone around W. Arrow and S. 20th streets knew John H. Spooner, the older white man who had lived there for decades, much longer than his younger Hispanic and African-American neighbors, and who was always walking his dogs around the block.

And they knew he was upset about a break-in at his house earlier this week, when burglars took some expensive shotguns and other items.

He suspected his new next door neighbor.

According to a criminal complaint filed Friday:

As 13-year-old Darius Simmons was moving a garbage cart from the curb Thursday morning, Spooner, 75, confronted him and demanded the boy give back his stuff and the shotguns.

Darius told him he didn't have his stuff.

The boy's mother chimed in, telling Spooner he should just go back inside. Then suddenly, as the mother watched, Spooner raised a black handgun and shot Darius in the chest from five feet away.

Darius ran around the cor ner and collapsed on Comstock Ave., about 10 feet from a small play area marked "Children's Park." As he ran, Spooner fired a second shot that did not hit the boy.

When police arrived, Spooner was still on the sidewalk, holding the gun. When told to drop the weapon, he placed it on the ground and told police, "Yeah, I shot him."

A second witness, who had been across the street, also told police he saw the shooting.

Spooner is now charged with first degree intentional homicide, use of a dangerous weapon, and faces life in prison if convicted.

The shooting occurred about 10 a.m.

This may be an extremely rare real first degree murder of a young black teenager by a frustrated white man.

A victim of multiple burglaries, we do not know if he had any evidence to connect the victim to those crimes.

Earlier that morning, Spooner had told Ald. Bob Donovan, whom he met inside a George Webb's restaurant, that burglars had taken about $3,000 worth of shotguns from his home two days earlier, that he suspected his neighbors and that he was frustrated police had made no arrests.

Donovan said he mostly listened as the men sat at the counter, and Spooner ate a breakfast of two pancakes, eggs and sausage.
He said he has known Spooner for years and knew Spooner had been a crime victim many times in the past and had even installed surveillance cameras on his home's exterior. He said Spooner mentioned that he was lonely since his wife died in 2004 and that he was dying of lung cancer.

"He seemed burdened, truly burdened," Donovan said Thursday.

Cryptic comment

He said Spooner also said something else - that "there are other ways to deal with situations" the police couldn't solve. Donovan said he didn't really take it as more than a passing comment at breakfast.

According to court records, police seized 16 guns from Spooner's house in December 2006. According to his handwritten form to reclaim them, the guns were taken because a felon had been a guest at Spooner's house.

The guns included eight rifles, four shotguns and four handguns. A judge ordered them returned to Spooner in April 2007.

At the crime scene Thursday, detectives recovered two .32 caliber shell casings, one from the porch of Darius' house and one from the grass next to it. There were two rounds still in the gun, including one in the chamber with strike mark, suggesting the gun had misfired on an attempted third shot.

A man can just take so much. Things just build up and explode.

Sounds like his life had been turned into a living hell.
I don’t think it will be any better in prison.

Will probably claim some ‘diminished capacity’ defense.
May even be true.

Those predators had made his life a living hell. Just because you are white and have something, doesn’t mean those who aren’t white and don’t have anything have the option to prey on you. You can only push people so far.

Well, just maybe his mother wished that he had not stolen the white man’s property, if that is true.....at 75, what else could he do wrong, police “probably wouldnt investigate the robberies, and so living with all those African thugs around him, he would settle the score in the wrong way

Or perhaps Spooner knew exactly who did it, from his surveillance cameras, and confronted them. Perhaps he didn't care because he's dying anyway, and was tired of being preyed upon.....perhaps....

If no evidence of a connection is found after a real honest investigation, I agree.
If evidence of guilt is found, I would find the old man "not guilty."

There is a limit to what the innocent should tolerate. Living in fear has got to be worse than the most PC "cruel and inhuman" punishment imagineable.

If he had,in fact,frequently been the victim of thefts it would be understandable that he'd be very angry.But unless he had strong evidence that the kid was involved this is,at best,a *very* unfortunate event.If he is,in fact,dying of cancer it seems to me that a case could be made that this widower is suffering from a serious psychiatric disorder.

Just some random thoughts....just that IMO,even if the kid was,by chance,involved in one or more thefts it didn't warrant a death sentence.

The ‘black community;? Let me ask you, if the video shows this 13 year old was robbing Spooners house, what do you think the ‘black community’ will do with that information? .... That’s right, they will ignore it and play their racists games ot the hilt. was Spooner committing 1st degree murder? Yes. I have no doubt. Was he justified? No, without any doubt. But let’s stop giving the ‘black community’ support for their racists crap. This was a crime. A kid was murdered. Race of the two involved is not the point. The point is murder int he first degree which is not a racial thing to be exploited by the race huslters like Jackson/Sharpton/Holder and Obama (even sounds like a bunch of sleazy lawyers!).

This was a crime. A kid was murdered. Race of the two involved is not the point.

If you go to the police, and they do nothing....which is apparently a very common scenerio in large cities, what is your next recourse? Most people just leave.....Mr. Spooner is 75 and a widower....where should he go?

If he has video he goes to the courts. When we start winking at an old man for shooting a 13 year old kid because he bleieves the kid stole his stuff, we have indeed gone into the dark side of lawlessness which is the favored realm of thugs and criminals, and perhaps Mr. Spooner’s neighbors. Who knows? If he caught someone inside robbing him, well that’s a whole nother story. Drop them with extreme prejudice is my motto.

All I’m saying is this black family has a legitimate reason to be angry.

This is different than the Martin case where the blacks had no legit reason to call for Zimmermans death or have Jackson and Sharpton preaching racial hatred.

This was a 13 year old boy taking something to the curb and he was confronted by a man with a gun. Yes, blacks murder and commit crimes against whites ALL THE TIME, but does that justify a white man killing a black kid....NO. We don’t need anymore hatred and anger, and this just adds one more nail to the coffin.

Mr Spooner killed this kid in cold blood, that’s all there is to it. He killed because his guns were taken, now he’ll pay for the very thing he killed for. White people “I HOPE” are better than this!!

The man was taken to his limit and that is unfortunate and tragic for sure. A person can only take so much and he will have a “mental” defense. He had called 911 many times, installed security cameras, but still breakins occurred as soon as he left his home for shopping etc. The police did nothing and he finally “cracked”. There was a situation in ohio a few years ago where a fireman with wife and two young children, were being bothered by teenagers setting off firecrackers past midnight just a few feet from his childrens bedroom window. Calling the cops did nothing, warning the kids did nothing, they continued to laugh and taunt. He finally went outside and blew two of them away. a person can only take so much, so sad.

I have personal experience with good neighborhoods going bad. My neighbors were old.....twice my age, and the homes were brick, well kept and owned by mostly veterans or their widows. NICE homes. After 8 years in that community, the writing was on the wall, section 8 apartments, sleazy duplexes, and very scary people walking the streets at night. We had been surrounded in the fields that I used to walk my dog in..... I sold that house for a $30,000 loss, just to get out. That was 10 years ago.....now driving through that neighborhood....well, it's dangerous. Some people believe their home is their castle....others belieive it's easy pickings....

I am familiar with that scenario of good neighborhoods being destroyed by riffraff, and people having to sell their homes at huge losses and move just to retain their feeling of security and sanity! Some peeps dont understand, but I can see how this man finally had enough.

I DID READ THE ARTICLE, and Spooner would have been justified shooting the kid IF THE BOY WAS IN HIS HOME AND IN THE PROCESS OF COMMITING THEFT. He didn’t do that. He was frustrated. That still does not equal murder.

Ok - we want race to be taken out of the Trayvon/Zimmerman case (and rightly so) and make a decision of innocence or guilt to be based only on the facts (again, rightly so).

Take race out of this story - a man confronts an unarmed 13 year old kid (I am assuming unarmed as he made no defense with a weapon) and accuses him of theft.

The 13 yr. old says he didn’t do it, the man pulls a gun and shoots the 13 yr. old at point blank range in the chest, then fires again as the boy is attempting to flee.

The boy made no attack at the man, he did not pull a weapon, and as far as we know according to witnesses, he made no threat to the man.

Whether or not this kid actually stole anything is irrelevant to the fact that this man shot an unarmed human being. The mans frustration because of multiple thefts may be relevent to the punishment of the crime, but, as it stands, if this story is accurate and true - this is plain, bald-faced, cold-blooded murder in the first degree.

People who bring up race in this case are the same ones who complain about Jessie Jackson and Al Sharpton for doing the same thing. Allow the process to work.

Got all three, and if you are here to tell me that a 13 year old kid deserved to die in this instance, then the same label applies to you. And, I’ve been part of this forum for well over ten years now.
