Texas Man Found Guilty for Killing Neighbor in Dispute (Stand Your Ground Defense)

A jury has convicted a Texas man for murdering his neighbor during a confrontation over loud music two years ago, rejecting a claim that he was within his rights to fatally shoot the man under Texas' version of a "stand-your-ground" law.

Raul Rodriguez, 47, faces up to life in prison for the killing of Kelly Danaher, 36. Sentencing is scheduled to begin today.

Didn't this guy video the whole thing...and utter phrases like “I'm standing my ground” and “I fear for my life” during the altercation? Sounded like a complete set-up.

This should be held as an example of how fair the law is. This guy was tried and rightfully convicted. His mistake was assuming the law protected his right to shoot someone after provoking a confrontation.

There is no need to change the law. As we can see in this case, judging the action of an individual within the confines of an established law is the job of the jury.

When you take a firearm and a camera to the neighbors house you’re not standing your ground, you’re overstepping your border. He got what was coming to him.

We had something like that happen years ago in Tulsa, OK. Some people were partying and you could hear their radio blasting for over three blocks in the middle of the night.

We called the cops with a noise complaint, then we went over and stood across the street where the music was blasting form.

The Policeman took care of the situation, and told us all to stay away. Needless to say, my worthless brother-in-law (If you know him he probably owes you money)had to say something snide and almost got arrested himself.

The people did turn the sound way down.

Exactly and he is lucky he was not shot and killed himself. The neighbors would have been in the right to do so.

The tragedy was the unwarranted killing and wounding, but in the long run, this will help the credibility of SYG laws nationwide, because it shows that it is not unreasonable, nor an easy excuse for murder, as claimed by its opponents.

It will be interesting to see what sentence the judge orders.

Maybe I should read the whole article first.

Rodriguez is interrupted by wild laughter, and then the sound of gunfire, before the tape stops as Rodriguez is tackled to the ground. In addition to the shot that killed Danaher, Houston Fire Capt. Ricky Johnson and Marshall Stetson received multiple gunshot wounds after the camera stopped recording. Rodriguez, a father of six, walked away from the incident unharmed.

So, a retired firefighter kills a teacher and shoots another firefighter? I can't tell from the article what the third guy who got shot did unless he was a Houston Fire Captain as well. What was his reason for taking a gun to the other guys? He feared for his life because of loud music and couldn't wait until the police got there?

Who was laughing, it sounds like the perp was interrupted by 'wild laughter', weird.

Right. The party was full of firefighters. The perp was a firefighter. The whole world revolved around gubment cheese.

I’ve had a carry permit since 1995, have always carried a loaded weapon in my vehicle since then, and have never had to take it from its storage place in anger. My view is it’s there in case fate challenges me, not so I can go and challenge fate. This nitwit did something even dumber than go, carrying, into a Hell’s Angels Bar and start insulting their old ladies, thinking he could legally use the weapon for “protection.”

Rodriguez did not take the stand in his own defense.

That fact alone tells me ABC is NOT reporting all essential details about this incident.

He’s facing life imprisonment, he claims he’s innocent, but he won’t defend himself in front of the jury?

This does not pass the sniff test.
