It seems that courts today have strayed from actually looking at, and interpreting, the law. Court rulings are made more on political leanings. You have conservative court officers who issue rulings based on conservatism and liberal court officers who rule based on their liberalism. When a case comes before an upper court (Ninth Circuit Court of Appeals, State Supreme Court, U.S. Supreme Court) one can guess which judges or justices will rule which direction based on their personal political feelings. To heck with the Constitution, or the law as passed. Thus, the courts have become no different than a governing body. Courts today use judicial activism to govern, and have strayed from intrepreting the law as it should be even though it may not agree with their political leanings. Thus, are the courts today no different than Congress?
Last night Roberts said something like “the role of the court is to make statutes fit the Constitution”, which I’m pretty sure is not the way they started out in 1793.
Since conservatism focuses on adherence to the Constitution, I don’t have a problem with conservative court officials making rulings based on conservatism.
If there is a reasonable interpretation of a statute that is consistant with the Constitution, then the statute is normally given that interpretation, but when you have to torture the statute beyond recognition to make it fit the Constitution then you have judges that have become policy makers pure and simple.
I’ve been a practicing lawyer for 32 years. Yes, the Court system is a joke. A cruel joke.
Yes, next question.
I think that the Supreme Court has become a mirror of the organization that affirms its membership, the Senate.
And just like the Senate, it’s become a worthless group of political hacks.
Everywhere you turn, Man glorifies himself to make laws, from the courts that were to interpret the law not make it to the home owners association deciding what color your garage should be because of their perceived authority over your life.
We chose freedom from God and His laws, and now we have Man and his laws in plenty. There is a real lesson to be learned in all of this.
There are four people sitting on the court who’s decision making is never in question. They are literally non-thinkers. You would no sooner expect blacks to vote Repulican, than half of the court uphold the constitution. If this isn’t a joke, I don’t know what is.
Yes, and has been for decades.
