"Doesn't Trayvon Martin actually have the right to kill George Zimmerman if George Zimmerman is stalking him and the police have told him not to stalk him?"

This question was actually asked Tuesday on CNN's Piers Morgan Tonight by schlockumentary filmmaker Michael Moore during a discussion about gun laws in the wake of the shootings in Aurora, Colorado (video follows with transcript and commentary):

MICHAEL MOORE: Can I say something about that? About the Trayvon Martin thing? Let me put it this way. Let's say George Zimmerman’s right when he says Trayvon Martin tried to kill him. Alright. But it was George Zimmerman who was told by the police to quit stalking this boy. And he was the one who was committing the infraction against the law by disobeying the police and going after Trayvon Martin. Doesn't Trayvon Martin actually have the right to kill George Zimmerman if George Zimmerman is stalking him and the police have told him not to stalk him?

We can question all day long, but the only ones who will make that determination are the jury. The rest of us can discuss it until the end of time but it does not matter. All that matters is what the jury ends up saying.

Granted, had they done this, it would have saved our nation much bad taste from “Jabba the Filmmaker.”

Hmmm, the fat must be clogging Moore's ear's. I listened to the 911 call and never heard the term “stalk” or “stalking” used or the police tell Zimmerman that he was breaking the law or ordering him not to follow Martin. The only thing I remember hearing was a 911 operator, NOT the police, tell Zimmerman “You don't need to do that.” When he said he was following Martin. That's not exactly an order, If I tell my boss I'm going to work late on a project and he says “You don't need to do that.” It certainly sounds to me like he is telling me that I can if I want, but I don't have to, not ordering me under no certain terms not to.

The guy’s a complete and utter dingelheimer. He would have had a right to use lethal force to protect himself had Zimmerman attacked him, but that obviously wasn’t the case.

Mr. Moron, stalking is a crime that occurs over an extended period of time, and it is not equivalent to following a suspicious person at all.

Furthermore, the act of stalking someone does not directly place their life in imminent danger, as bashing a person head into concrete repeatedly DOES.

So, no, the thug Martin would not have had the right to shoot Zimmerman.

NO! The police dispatcher’s SUGGESTION is merely that. Zimmerman had absolutely no legal obligation to follow the dispatcher’s suggestion.

Dispatchers are not deputized law enforcers, and that’s likely to come up in the trial when it gets under way.

Actually, I think we can fully accept that a neighborhood watchman who is looking out for the neighborhood is not a fair target to be killed. I would consider that concept to be settled.

I worked 911 trbls for Bell and visited many 911 call centers over many years.I used to listen to some of the calls and the questions these "console operators" asked were pretty lame and wasted valuble minutes.Many of the “console operators” weren't to swift.

The stand your ground law only applies if you are "standing your ground".   Zimmerman was moving away from Trayvon back towards his truck and Trayvon pursued Zimmerman.  Trayvon was no longer standing his ground, but had become the pursuer.  You can't be standing your ground if you're the pursuer.  Therefore, when Trayvon pursued then attacked Zimmerman, Zimmerman was standing his ground when he shot Trayvon.  Trayvon got his @ss shot in a righteous capping.

I’d be surprised if Moore approves of the death penalty. That’s a penalty imposed by a judge or jury after twelve jurors have heard all the evidence, given it consideration, and come to a unanimous conclusion.

And yet here he actually approves of the death penalty if the guy that is the target of investigation, is merely watched from a distance, or asked what he is up to. He’s actually saying that this guy should be able to kill the person watching or asking a simple easy question.

Some times you just have to shut up and quit proving how stupid you are. Of course that would imply you had the mental faculties to realize you needed to.

According to testimony, Travon was trying to get Zimmerman's gun so he could kill him. That's a far cry from someone following you around.

Of course, Michael Moore is a complete idiot, so we can't really expect him to know the difference.

Understood. It’s obvious from the testimony that GZ broke off the search and even stated something to the effect, “They always get away.” So he’s walking back to his truck and is jumped and he’s just supposed to lay down and take a beating?

In my opinion, GZ did the public a service. Had the tables been turned, Martin would’ve pulled the trigger, killing or injuring GZ, and we the taxpayer would be paying to keep him fed, clothed, and given access to medical care, free cable, and workout facilities.

Our justice system is becoming a joke.

You know, we use the word “predator” a bit too liberally these days. More often than not most of the the “wolves” we are faced with anymore aren’t predators at all, they’re scavengers. They won’t mess with anything that’ll fight back. There are some true predatory animals out there, and they truly hunt, but for the most part I think that most of these idiots are looking for the path of least resistance. They don’t want to get dirty. “We’ll rob the old lady”, “Let’s abduct a kid”. A defensless target is an easy target, right? The solution for that is simple, refuse to be food. For the other, the true predator, the solution isn’t so simple. They are hunters. They stalk, they lay in wait. They kill. Those are the ones that will let you know that you’ve got a fight on your hands. Not fighting to get away, but fighting to get to you. All the posturing in the world won’t change their mind. You have to understand going into it that there will only be one left standing. Who will it be? You, or them? Maybe it is as simple as it seems...Victory, or nothing.

She had also asked GZ to report what the individual was doing, which would be hard to do when TM went behind the buildings and out of sight. I guess GZ could have driven his truck up on the grass between the units and kept reporting from there.

At best he was given conflicting instructions from someone who wasn't at the scene.

One. Stalking is not a capital offense and therefore not punishable by death and so if you kill someone for “stalking you would be guilty of murder.
Two. Zimmerman was not stalking Martin He was following a suspicious person.
Three. A citizen is under no obligation to follow police “suggestion” when the citizen is not breaking the law. Should you? Maybe, maybe not..

He was watching him from a distance, from what I see from the evidence.

All the evidence indicates that Martin had created a distance of separation between them, but then came back to Zimmerman to confront him.

Exactly what happened at that point may not be entirely provable one way or another, but I think it seems pretty likely that at some point Martin had the easy opportunity to get back to his home, but chose not to.

He is confusing the condition of being physically attacked with an acute need for self defense with the condition of being stalked with no acute need for self defense.

His attack on Zimmerman then allowed Zimmerman to defend himself.

This sort of thinking goes right to the root of liberal racism. White liberals like Michael Moore simply do not expect black people to behave in as civilized a manner as they expect white people to behave. They actually believe it is racist to expect and demand a level of commonality of moral norms among people regardless of their skin color.

Imagine how Michael Moore would label you if you stated that a white 17 year old football player from Iowa should be allowed to beat to death a black father who he thinks may be following him.

That is a tricky one, You would have to be able to prove that you were being stalked, could the person following just happen to be following the same route? Another reason to have a handgun at the ready, but concelled so as not to be charged with brandishing, if the threat is not really a threat, and a dead threat if it is.

But does Trayvon Martin have the right to attack George Zimmerman if George Zimmerman is/was following him and the police have told him not to follow him so George is returning to his truck? This is the main reason I have heard as to why George is gulity, once you follow someone on the street you have the right (by street law) to attack and kill them.
