Group representing Va. veteran says hes being detained for anti-government Facebook posts

RICHMOND, Va. — A former Marine involuntarily detained for psychiatric evaluation for posting strident anti-government messages on Facebook has received an outpouring of support from people who say authorities are trampling on his First Amendment rights.

Brandon J. Raub, 26, has been in custody since FBI and Secret Service agents and Chesterfield County police questioned him Thursday evening about what they considered ominous posts talking of a coming revolution. In one message earlier this month, Raub wrote: “Sharpen my axe; I’m here to sever heads.”

Dee Rybiski, an FBI spokeswoman in Richmond, said there was no Facebook snooping by her agency.

“We received quite a few complaints about what were perceived as threatening posts,” she said. “Given the circumstances with the things that have gone on in the country with some of these mass shootings, it would be horrible for law enforcement not to pay attention to complaints.”

Whitehead said some of the posts in question were made on a closed Facebook page that Raub had just created and that had only three members, so he questioned whether anyone from the public would have complained about them.

The doublespeak is strong with this story. And it is a very short journey from Raub to committing people for political views.

Thomas Jefferson, if alive today, would be thrown in a mental health facility (for his own good of course) and never let out.
We are going to have to be very careful about bombastic and colorful expressions if this is the new deal.

Yes.

But I am following it carefully. I don't want the U.S.S.A. government to decide *I* am insane.

I wouldn’t be surprised if Mr. Raub makes that journey with in the week.

I’d say he is half way there already.

I have heard that he had two different pages. One was pretty much out there.... but there seems some reasoned debate over if he was posting words to an obscure song —or if he spewing
terror threats. There seems also some question as to if he was read his Miranda rights-or not. And if the FBI deliberately LIED to his momma claiming he had been arrested for assaulting an Officer and resisting arrest. She says she went to where they said he was to find he was not there? Had not been taken there.IF these guys are among the Sovereign Citizens group or not I do not know. But I’d bet IF he was a Black Muslim— or a
Black Panther Eric Holder would be all about defending him.

I cannot speak to the underlying law, but from a practical standpoint - I (and my sis) had to involuntarily my mom (bipolar and waaaaay off the reservation) several times.

While my father was alive, it was a bit easier as they certainly took at face value the statements of the man living with her, coupled with her behavior.

After he passed, it became much more difficult, as the bias was certainly against sis and I, who were more likely to be seen as trying to put inconvenient mother into the hospital, presumably so we could raid her assets.

Anyway, in talking to an eldercare attorney, his suggestion was to go swear out (I don’t recall the exact language) a warrant for observation, at the circuit court, who would then engage the cops to go pick up the individual, take them to the nearest hospital for observation. I believe that the warrant issued by the court for observation satisfies the rules of the 4th amendment. But I’m no legal scholar.

BTW, we never went that route with my mom, we handled it the hard way, as I was not really interested in Baltimore city cops showing up at my moms place.

The local police say they did not arrest him. The FBI says they did not arrest him. He has not been charged with a crime. The judge authorized another 30 days detention.

WTF is going on?

“Col. Thierry Dupuis, the county police chief, said Raub was taken into custody upon the recommendation of mental health crisis intervention workers. He said the action was taken in accordance with the state’s emergency custody statute, which allows a magistrate to order the civil detention and psychiatric evaluation of a person deemed to be potentially dangerous. He said Raub was handcuffed because he resisted officers’ attempts to take him into custody.”

Somebody (multiple officials) is lying.

This may be a warning for anyone posting on the internet. Be careful what you post. Unless Raub has a collection of axes that he spends an inordinate amount of time sharpening I consider his comment a metaphor. The Soviet Union also had problems with mental deviants. A simple lobotomy will return Raub to a contributing member of the community. Perhaps he can go on food stamps (economists say every $1.00 in food stamps contribute $1.84 to the economy.) The FBI has its work cut out for it. Thousands of rap artists, Black Panthers, and even politicians, have said things that could have them committed. A prominent politician once said, “If they bring a knife, we bring a gun.”

Sounds like state-sanctioned kidnapping.

You have got to be kidding me. This is akin to a call to arms.

I’m an attorney and as such can state, based upon these facts (the facts as set forth in the public releases thus far), this state/federal act of seizure was illegal, further, it goes against everything that America stands for. Seriously, I never post, but this one just speaks to me and makes me “afraid”.

How does this happen? How can any American abide this?

Is being a 9/11 truther patriotic?

Hmmm Yes truthers are pretty dumb, but since when is ignorance a crime? The average DEM makes that ignorance seem trivial.

This is his one FB post that could be construed as a threat against a specific party, IMO:

5) This is the part where I tell the Federal Government to go **** [db edit] itself. This is the part where I tell Generals, training our young men to fight Americans, I am coming for you. The Veterans will be with me. 8/9/12

But even then, that is pretty weak as a legal justification to have someone involuntarily committed.
