Benjamin M. Wassell, an Iraq War hero who, despite a traumatic brain injury from an improvised explosive device that destroyed his vehicle back in 2006, was able to lead other wounded Marines through a minefield to safety, was the first person charged in violation of the New York State Safe Act.

(VIDEO AT LINK)

Iraq War hero Benjamin Wassell faces seven years in prison for the violation.

Wassell pleaded not guilty today. Guns.com reported:

A Western New York man now faces seven years in prison for violating Gov. Andrew Cuomo’s new gun control-law, the NY Secure Ammunition and Firearms Enforcement Act (or SAFE Act).

Benjamin M. Wassell, an Iraq War veteran, was charged with twice selling newly banned military-style ‘assault’ weapons and standard-capacity magazines to an undercover police officer as part of a sting operation conducted by State Police and the New York Attorney General’s Office, the Buffalo News reported.

Altogether, the 32-year-old Silver Creek resident was slapped with three felony charges and one misdemeanor, which as noted could end up putting Wassell, who has no prior convictions, behind bars for as many as seven years.......

Gov. Andrew Cuomo is a very dangerous thing. Same for Bloomberg.

Fortunately, both are profoundly stupid enough to swing at a hornet's nest pretending it's a pinata full of party favors.

I think he connected with this swing at that pinata.

Better have that EpiPen handy...for all the good it will do against the angry swarm that's coming for him.

The first to fall will be hand-picked in order to make the medicine go down easier. It is incumbent upon Up-staters to protest every use of this law, regardless of the lawbreakers disposition on other sundry issues.

who better to make an example of ?

This is a shot straight at the rest of us who oppose the un-SAFE Act.

We need to keep asking those who wish to disarm us:

Why do your police need the weapons of war ?

Why do they need M-4’s with holographic sights and 30 rnd magazines ?

Who are you at war with?

They dress like military, are armed like military, and have all the accoutrements of military

Here’s something to think about; A young person could survive a 10 year sentence, however for a person in their sixties or seventies, 10 years would most likely be a life sentence.

If you give someone a life sentence, are they less likely to be taken alive. I wonder if the Jack Boots have considered that?

Now that the Red Diaper Babies are in charge of the Executive branch, they are bending over backwards to treat our servicemen just like they did during the Vietnam War.

Makes me want to spit in somebody's face.

Yet another “call to arms” that’s going to be ignored by the chest thumpers waiting for the revolution to start. They’re probably busy taking their kid to a soccer match.....

Now that the NY State Police and the democrat politicians have eliminated all serious crimes of violence in the state of New York they have the time to entrap serious threats like Bitter Clingers and military veterans.

It's a good thing this poor guy wasn't drinking a Big Gulp soda when he was arrested.

"The rifle is a weapon. Let there be no mistake about that. It is a tool of power, and thus dependent completely upon the moral stature of its user. It is equally useful in securing meat for the table, destroying group enemies on the battlefield, and resisting tyranny."

"That is why our masters in Washington are so anxious to disarm us. They are not afraid of criminals. They are afraid of a populace which cannot be subdued by tyrants."

They are both fascist thugs. If they could (and maybe they will yet), they would have goose stepping jack booted thugs patrolling the streets to enforce their despotic whims.

The question is, could this become the “test case” for the unconstitutionality of this stupid law?

Harassing war veterans with prison time for violating made-up crimes? Is this really the fight that Cuomo and his fellow rats want? Bring it.

I just hope that Ben’s defense attorney makes DAMN SURE the jury knows their God-given rights under the Jury Nullification Doctrine.

The judge will NEVER instruct the jury that they have three options for reaching their decision, not two. They can find the defendant guilty, find him not guilty on the facts as presented, or find him not guilty because the damned law itself is unjust. The judge wants a quick and easy decision; he doesn’t want the court’s time wasted in a nullification decision. Too damned bad.

I would LOVE to sit on the jury for this case. Hoo yeah!

Some years ago I was forman of a jury that exercised its right of Nullification. We were not instructed by anyone, but we knew that it was the right thing to do. The Prosecuting Attorney was livid.
