Boston bombing suspect charged, will not be treated as enemy combatant

The White House said Monday that the surviving suspect in the Boston Marathon bombing will not be treated as an enemy combatant, in response to calls from Republican lawmakers to consider that option.

The announcement came as a sealed complaint was filed against suspect Dzhokhar Tsarnaev. Fox News has learned that the suspect made an initial appearance in front of a federal magistrate judge at the hospital where he is still being treated. No plea was entered.

I have a problem with Enemy Combatant Status for American citizens (e.g., being stripped of all rights), because any of us could be next.

Exactly, as distasteful as this case is (and given the current regime any of us could indeed be next).

He's a US citizen who committed an attack on US soil.

He is a United States Citizen on United States Soil. If it turns out he is an "enemy combatant" working on behalf of a foreign government or a foreign terroist network, then on top of the murder charges, they can try him for treason.

He is entitled, by virtue of his American Citizenship, to the same due process as any other citizen. That includes the right to a speedy trial by a jury.

If the government can take that away from him, it can take it away from you.

If articles of Impeachment are brought against Obama, the urban negor population, all white liberal facilitators and the individual members of congress will declare such action as denying every black American their US citizenship.

He’s an enemy combatant, but they gave him American citizenship.

So at this point either go through the process to strip him of citizenship or give him the full protections any of us should have.

Don’t create a precedent for ignoring citizen’s rights, simply because of this bozo.

And also a US citizen with protection under the bill or rights. Sorry, but preventing lynchings is one reason why the bill of rights exists. Perhaps you should be questioning the events that lead to his citizenship.

Poor kid. And if they try him in NY, he’ll probably be acquitted.

Not too sure that a NY jury will be sympathetic to terrorists after what happened in 2001.

Omar Abdel-Rahman was convicted by a NY jury, and that was before 9-11.

It’s better to try him in civilian court. Making it military bestows too much credit on them, elevates them to something they aren’t. Trying him in civilian court says “you’re just another murderer”.

I have to agree with you. If you're an American citizen, you need to stick to the Constitution, because it's our "We The People's" only protection against tyranny here. I know everyone wants to get tough on these a-holes, but we have to proceed carefully on how things get done. Once you break new ground, we will never be able to re-take it again.

To a certain degree yes but when I think about it too deeply and consider that the terrorist could have been some nutcase claiming to be a Tea Partier I could easily see the democrats becoming the "lynch mob" against us conservatives, probably trying to take actions to get conservative Talkers pulled off the air.

A “lynch mob” in this case? Yes, I can disagree. It's the precedence it sets for liberals going after conservatives is where that disagreement ends.

To tell you the truth, I had no real opinion on how this terrorist was tried but I did tilt more towards a Civilian Federal Court even though I did not express my opinion or advocate for it
