German Family Denied Asylum, HSLDA Appeals

The Sixth Circuit Court of Appeals today upheld the Obama Administration’s denial of asylum granted to the Romeike family.

The Romeikes fled Germany in 2008 when they were subjected to criminal prosecution for homeschooling. They were granted asylum in 2010 by Immigration Judge Lawrence O. Burman, but that grant was overturned by the Board of Immigration Appeals in 2012. A three-judge panel of the Sixth Circuit heard the Romeikes’ appeal on April 23 in Cincinnati, and issued today’s unanimous decision against the family.

“We believe the Sixth Circuit is wrong, and we will appeal their decision,” said Michael Farris, HSLDA founder and chairman. “America has room for this family, and we will do everything we can to help them.”

The court said that the Romeikes had not made a sufficient case, and that the United States has not opened its doors to every victim of unfair treatment. Although the court acknowledged that the U.S. Constitution recognizes the rights of parents to direct the education and upbringing of their children, it refused to concede that the harsh treatment of religiously and philosophically motivated homeschoolers in Germany amounts to persecution within our laws on asylum.

“Germany continues to persecute homeschoolers,” said Mike Donnelly, HSLDA director of international affairs. “The court ignored mountains of evidence that homeschoolers are harshly fined and that custody of their children is gravely threatened—something most people would call persecution. This is what the Romeikes will suffer if they are sent back to Germany.”

But, of course, there’s always plenty of room for illegal aliens and illiterate Africans.

The problem, of course, is that these groups can be relied upon to vote Democrat; an educated European refugee, however, might - gasp! - turn out to be a Republican.

And, let’s face it, the very notion of homeschooling threatens the government hegemony on early brainwashing via its NEA lackeys, something which is critical to grooming the next generation of Nanny Staters.

This isn’t OUR battle — we have a tough enough time protecting Homeschoolers in America.

However, these are the kind of people that America should be recruiting.

The thing that angers me most about this case is that they were originally granted asylum, and Holder et al reached down and actively appealed the grant of asylum.

They could have just let it be, but NOOOOO....

This case is about so much more than a German family wishing to homeschool their children. This is about all parents' rights to oversee, influence and direct the education, religious upbringing and healthcare of their own children.

The long term ramifications of the case impact much more in the United States than the homeschooling issue. Prior to the Romeikes' arrival in the United States, the German government had been preparing to permanently remove the Romeike children from their parents' care.

The United States Sixth Court of Appeals has in effect, sent a strong message to American parents that they can also expect the American government to micromanage the raising of American children. If the parents object to anything they are ordered to do by the government, such as forced enrollment in government approved public schools; forced acceptance of all medical treatment including recommendations from untrained school officials; forced acceptance of potentially unnecessary medical treatment, including surgery, with no right to a second opinion, when parents refuse, they can expect the government to remove American children from American homes.

The shocking April 2013 case in Sacramento, California where parents observed a hospital nurse administering antibiotics to their infant which was against the orders of the infant's doctor, were then told by the hospital officials that their infant needed immediate cardiac surgery. The parents then sought a second opinion from another hospital. The second hospital had said that the infant was fine, had the flu and had sent the parents home with their infant. The second hospital disagreed with the first hospital's demand that the infant be subjected to immediate surgery.

However the first hospital phoned police and CPS, who without consulting the second hospital, forced entry without warrant into the parents' home and took the crying infant out of the Mother's arms and into official custody of the government.

The You Tube video showing a CPS social worker instructing the Mother that she had no rights, that her infant had been ordered by a doctor at the first hospital to have immediate surgery; informing the Mother that she had no right to disagree and had no right to ask where the police and CPS were taking her baby; and the CPS social worker informing the Mother that she (the Mother) was acting irrationally when she asked where they were taking her infant, and all of this while her husband was outside on the ground after being knocked down by the police, is chilling.

The case is far from over. CPS still has authority over the infant and is controlling the parents' daily activities with their infant.

You’re right. Sooner or later we’ll be facing a justice system that is based on international law. If we conservatives stick to defense we’ll lose. We have to keep the evil left on defense world wide as much as we can.

They could have just let it be, but NOOOOO....

Especially given the fact that Holder’s gang has been sitting on student visa expiration information for certain well connected people tired to a certain middle east country.....

They passively allow people staying on expired student visas and actively go after people who have allready been approved for asylum.... Because the asylum goes against Holder’s and Obama’s PERSONAL Beliefs on Homeschooling....

So does that mean keeping Jihadis here on expired visas is PRECISELY because Obama’s and Holder’s personal beliefs.......

If so, that is scary damned thought...

Please don't mistake this as a defense of the German homeschooling ban, which it is not. But with all due respect, what you say isn't strictly true. Yes, state run public schools are the norm in Germany. And yes, homeschooling as practised in the US is illegal in Germany. However, it's more complex than that.

a.) There is no strict separation of church and state as in the US. As a result, even public schools offer religious education. Often the religion teacher is the town pastor. There is some variation from state to state (e.g. a city state like Berlin might offer ethics courses as standard and make religious courses optional, whereas in other states the whole school might be denominational, e.g. a catholic or protestant public school).
b.) For those who find 2 hours per week of moderate Lutheranism or Roman Catholicism insufficient, there is a huge variety of religious private schools. These schools get similar tax money allocation per child as public schools, so except for posh boarding schools, they are often quite affordable.
c.) If even a conservative, church-run catholic school is to milquetoast, there is also the option of Zwergschulen (dwarf schools). German law says that pupils have the right to a teacher with an education degree, it doesn't say that they have to attend state-run schools. Most religious communities have no problems finding children from half a dozen families and and someone with a background in education amongst their midst to start their own private "dwarf" schools.

The reason why the Romeike case is not much of an issue in Germany is because there are very few religious parents who have a problem with the current system. In many ways the issue is more about sensitivities in the US than about Germany.

My objections to German schools go much deeper than what you discuss-—it goes to the Postmodernism—the Fichte/Wundt/ Hegelian/Marxism/Nietzschean ideology which is the only allowed “mindset” of Germans. You can not escape the indoctrination into irrationality and slavery.

The “religion” in Germany is controlled by the State-—as Pastor Bonhoeffer refused the mainline “churches” in Germany, even before Hitler took them over in the 30’s-—they were already “de-Christianized” at that point——with the “Filth from the Rhine and the vulgar Weimar Republic corrupting the Youth”—(Postmodernist ideology) that ideology of the Frankfurt school and the preceding 18th century philosophers who actually “killed” off God and the Christian “ethical” system, and kicked out all Classical philosophy (Reason) for Dialectical Materialism and Postmodernism.

As Hannah Arendt stated, political theory started with Socrates and ended with Marx. The fundamental Natural Duty of human beings is to care for their offspring, nurture them, and transmit their worldview and traditions. Any other system which separates young children from their biological parents inculcates an artificial, sterile, dehumanized world. Children will not “flourish” as they were designed-—in a Natural way and will be “trained” and conditioned by the State. They will be dehumanized to an extend-—be a part of a collective-—with collective “rights”—where individualism is crushed and punished. Individuals are expendable, and it all depends on the “rulers” who can live, speak and participate in the government. Some Ideas will be punished.

The State can never transmit “values” which lead to uniqueness, individualism, “thinking-outside-the-box” the way the natural family is designed to do. People like Lincoln could not exist or will not be “produced” in today’s Germany-—they are forced into a “group think” factory at a young age and controlled in a Marxist’s design—Top Down control. Uniqueness, love of God, is nearly impossible. Pressure to be one of the “herd” is instilled and inculcated in the Prussian system of education.

Parents in Germany are not treated as “masters”-—as adults. They are controlled by the State with little, if any, allowed autonomy. The force of government will crush any dissent-—like it does to human beings who want to raise their children as God designed them to be raised——in the most humane way-—not institutionalized where they are forced into a group “think” atmosphere with dozens of immature children who all are dictated to and controlled every minute (unlike the childhood of a Lincoln or Mark Twain) and all individuality is crushed and vilified. Humiliation faces all children who “think outside the box”.

There is only ONE allowed ideology/ethical system in Germany. There is no god, but the State and the State controls all allowed perceptions and ethics and what “type” of god you can worship. The Christian god the pastors worship-—is not the God of the Bible. Truth is never allowed—only irrational ideology of Postmodernists. Natural Law (science) is thrown out-—there are no Laws of Nature, and Rights are dictated by the State—never God or Natural Laws.

What they don’t allow is the “individualism” (free will) and autonomy of the adults to actually be adults and control their own lives and their children’s lives——they dictate everything-—give them little “choices” but not the major ones-—like controlling the worldview of their own children.

The children are really owned by the State. They dictate everything the parents can and can not do. Their system of education forces compliance/dependence/and destroys all incentives which lead to individualism—ideas which threaten the control of the State.

True Freedom is “scary” to most people——especially those who grow up in a systemized society like Germany which conditions and indoctrinates into irrational atheism and worship of the State. They become little happy campers-—loving the State making all their major life decisions. They don’t even (can’t ) understand that they are really slaves and their “lives” are worthless. They are reduced to termites in a colony——total dehumanization.
