Unarmed teen shot inside homeowner's fenced yard, but not breaking into home, NOPD warrant says

A 14-year-old boy remained in critical condition Friday after being shot in the head by a homeowner who said he thought the teen was trying to break into his house. But police said the teen was unarmed and did not pose an "imminent threat" when he was shot and have charged the owner with attempted second-degree murder.

The family of Marshall Coulter said the teenager could move only the right side of his body a little, but not the left. Doctors told the family that if Coulter survives, he would likely be severely brain damaged.

Coulter's family acknowledged the teen's history of burglary arrests but said he had never used a gun.

Police said that Coulter did not pose a threat to the homeowner, Merritt Landry, who works as a building inspector for the Historic District Landmarks Commission.

I hate the silent runners that are out biking at 2 am.

They creep me out.
I step out at 2 am to look at the moon and some 28 year old is coasting down the street looking about.

The dogs generally bark, but some ahole walked off with a gas can this week.
I personally would never shoot some one over property, but I certainly would be within my rights to do so in this state.

The punks know you wont shoot over $10
And they know you wont shoot over grand theft auto because you have insurance, so they will just hit you over and over bleeding you to death.

Mr Landry was completely within his rights, but now he will sit before a grand jury in a very unsympathetic political time.

A neighbors report:

The video has been given to police. A second unidentified neighbor claimed to have seen the boy in the blue striped shirt earlier in the evening at about 8 p.m. The neighbor believed he was looking at different houses.

"I thought about calling the cops, but the last thing I want to do is racially profile a little kid who's just biking," said the anonymous neighbor.

As per the neighbor's accounts, the kids were black.

Shot near the back door of a home at ~2AM after jumping a not-insubstantial fence. The “kid” wasn’t there by accident and at 2AM was up to no good. No bill from me.

NO great loss. His career as a professional thief is over in any case. I’d ask the little punk if whatever he was planning to steal is worth it now. If he hadn’t CHOSEN to climb someone’s fence at 2am to STEAL he wouldn’t have a bullet hole in his head. And considering his family and actions I’d say he was brain damaged BEFORE he was shot. NO GREAT LOSS.

I can answer this. I’d feel terrible. I’d feel sorry for my brother or sister, AND I would feel they had brought it on themselves. I would hold no ill will toward the homeowner as my brother or sister was the cause of the tragic chain of events, not the homeowner.

I did things when I was a teenager that I’m not proud of. Do I blame the people who caught and stopped me? No. My actions were entirely my own fault. I’m sorry for my sins and pray I never repeat any of them.

Is the homeowner guilty? I don’t know...I’m torn on this one.

I’ve had my go-rounds with building inspectors. Although, I have to admit, they’re usually pretty nice when they say “Sir, you’re screwed.”

It is a very bad time to exercise your rights.
I pray this man wins in court, but I think he was foolish.

I would consider any one within the FENCE at 1 am to be malicious, and here in Tx the law says it is unreasonable for you to determine if they are armed after dark.
The Law here realizes that anyone, uninvited on your property after dark may be assumed to be up to no good.
Certainly some one uninvited in your fenced back yard at 1 AM.

I believe the thief is black and the homeowner is white. This is another wonderful opportunity for the racial grievances crowd.
