On July 26, a doctor reportedly told Wrana if he survived surgery, he would likely be put on life support. The elderly man refused the operation, and paramedics attempted to involuntarily transport him for medical treatment. He was sitting in a chair, holding a cane and a shoe horn when police arrived at the Victory Centre senior living facility located just south of Chicago.

The Cook County medical examiner reported that Wrana bled to death internally from injuries caused when the elderly man was shot in the stomach with a 12-gauge shotgun that fired a bag filled with lead shot. The death has been ruled a homicide, according to reports.

I find myself in much the same situation. I like the libertarian ideal of one doing what one pleases as long as that does not harm another, but a necessary part of this is that one must accept the consequences of one’s own freely-chosen actions. If harm to one’s self or to others results from these actions, one should repair the harm using one’s own resources, or those given voluntarily by others.

Unfortunately, in this society, people are not held accountable for their actions, and the government uses the confiscated resources of others to repair harm from such actions. As long as this continues, and I do not look for a change any time soon, libertarianism cannot work.

Forth Amendment Text

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Seems like this age old practice is at odds with the forth and fifth amendments.

That would be Giles Corey, the most defiant of the Salem defendants. My mother is a direct descendant of Rebecca Nurse, who was hanged for refusing to confess.

She was initially acquitted much like the Sanford PD who refused to charge George Zimmerman with any crime.

But the public outcry was so great that they retried her and she wasn't as lucky as George Zimmerman. Still, she is the key reason we have the double jeopardy clause in the Constitution and Corey is the main reason we have the prohibition on cruel and unusual punishment.

The Salem Witch Trials actually provided a lot of legal precedent on what NOT to do in the development of the American legal system. It is rather surreal on how the Obama administration is working to bring so much of it back. (i.e. a modern accusation of racism now is akin to an accusation of witchcraft then.)

I always thought that these seizures,in order to be made permanent,had to be accompanied by a criminal...or at least civil...conviction of some sort.

The question is Why do the courts let them get away with this practice.

The courts must get a share of the proceeds is the only reason I can guess.

Civil forfeitures involving innocent people are rare and hardly happen in comparison to the real harm done to drug dealers and other criminals.

You obviously haven't been paying attention. I know it's a long article but you might want to actually read it before you make an ignorant statement like that

You see how that works? You now have to prove you're innocent. Forget about the JBTs proving your money is drug money. The burden of proof is now on the accused....like Zimmerman recently learned.

The problem is that each person has his own opinion about what constitutes ‘cruel and unusual punishment’.

For example, I, personally, think that being dragged down to the police station, locked in a room for a couple of hours while I stew until Big Brother decides to come into the room and browbeat me for several hours.....I would consider that to be ‘cruel and unusual punishment’. Yes, that happened to me for a traffic ticket that I didn’t even know that I had.
