Well sure. They could walk in and demand proof any time they liked. “Hey he had a nice television, and we asked him to prove where he got it. No receipt, it was ours.”

This is a stretch, but I see very little difference in the logic.

Civil forfeitures involving innocent people are rare and hardly happen..

How, exactly, do you know this?

Looking around my home office as I type and not onky can I not recall where I bought the TV, the monitors for my computers, DVD player, ohones, some furniture, fans etc, etc...I also can’t recall what I paid for them or if they were paid for by plastic or dinero’s.

Good point. A few items in my office were provided by a company I no longer work for, but were outdated such that at the point of our parting of the ways that they just left the stuff in my office. How would I verify that?

I have never understood how this practice has survived legal challenges.

Once again, asset forfiture is enabled by lawyer’s twisting words. If you look at the paperwork, it will say something like:
“USA vs. $5,000 cash” for the crime of being the proceeds of illegal acts And since cash is not a person, it has no rights.

The Statute then says that if you claim this cash, you must post a bond in order to get into court to claim it, and then must prove by a preponderance of evidence that it was not ill gotten goods.

The FBI has taken this trick a step farther — they accuse you of a crime, the seize all of your assets so you will not have any money to hire attorneys to defend you.

Why? Is it against the law to travel with so much cash?

No, but it sure isn't smart. Robbery comes to mind.

True Dat.

However, it is legal, lawful and a matter of course for good many people.

I-10 through Louisiana was once infamous for local police “window shopping” expensive cars with out of state tags to seize under any pretext. You’d have to sue in their jurisdiction to try to get it back. May still be for all I know.
