Yes, the Constitution and its amendments are outdated.

In Arkansas a class of sixth graders were asked to prune the Constitution and its amendments. Glenn Beck decried the notion of an outdated Constitution in his radio program. Like a true patriot he defended it, but he was wrong. The Constitution is outdated as are many of its amendments.

Here are some amendments that need instant pruning or decapitation:

The 16th amendment allowing the federal government to collect income tax. If that were abolished, so would Obamacare, according to Chief Justice John Roberts.

The 17th amendment establishing the direct election of United States senators. The Founders were correct in granting this power of appointment to the individual states.

The 26th amendment granting the right to vote to 18 yr olds. The right to vote should be raised to age 27 when one is no longer a child.

The 24th amendment abolishing poll taxes. Democrats say that voter ID cards are a form of poll tax. This amendment should be revised so that states can issue voter ID cards to legal citizens only. I would even require some minimal literacy test.

I am sorely tempted to forage into the 19th amendment, but I have a better half to contend with.

As for the Constitution itself, let’s eliminate the outdated Commerce Clause. It served its purpose for its time to help form the union. I doubt there is any state today that would impose tariffs once you cross its state line. The Commerce Clause has been abused by the courts to the point that what you grow in your back yard can be regulated.

Oh, and one more.

The 28th amendment. Congress can only enact legislation during the months of June, July, and August. Legislation can be repealed at any time of the year.

The 17th was the beginning of the end if Federalism as envisioned by the Founding Fathers.

They should replace it with another copy of the 10th Amendment.

The States have virtually no power and this is where it started.

She is wrong about that.

Pennsylvania legally charges fees for interstate commerce on the Ohio River in that state whether the ship originates in Pennsylvania or not.

Correction: Their assignment asked them to "prune" the Bill of Rights, not the entire Constitution.

First of all, the she is a he.

And I don’t have a problem with states charging fees for interstate commerce. If someone does not want to pay it find another way around the state.

Unimpeded competition will sort it all out.

The 28th amendment. Congress can only enact legislation during the months of June, July, and August.

I've been advocating that for years, but there's more needed to make it truly effective:

  1. Every regulation proposed by an administrative agency must be passed by both Houses of Congress before it takes effect.
  2. Every proposed law and regulation must be read verbatim, before a quorum of both Houses, twice, prior to a vote.
  3. Proposed laws and regulations can only be read during the primary session of Congress.
  4. Primary sessions of Congress cannot extend beyond the months of June, July, and August.
  5. Congress mus meet, for primary sessions of Congress, in a public building within the geographical limits of the District of Columbia.
  6. Air conditioning is forbidden, in public buildings within the District of Columbia.

Good point and sadly too true. A bunch of vindictive juveniles.
All the more reason to revise the outdated amendments.

30th Amendment: Only ballots cast on Election Day and absentee ballots will be counted. No Drive In, Drive By or pre-election day votes will be counted. Nor will a state’s election hours be extended by some federal judge.

Add a 7 thru 10 to the 28th

7. The Supreme Court of the U.S. and its subordinate Federal courts will only rule on the constitutionality of any law in the narrow sense that it is permitted explicitly in the Constitution or that it is not explicitly covered under the Constitution and is given to the states.
8. The president may not in any way add to, reinterpret, alter the conditions of, or change by means of Executive Orders or any other Executive instrument any standing law of the United States.
9. All citizens of the United States will be required to strictly adhere to any Constitutionally passed law with no exceptions for any resident, legal or legal alien.
10. No person or persons within the boundaries of the United States illegally will be accorded any privileges under any Constitutionally established law of the United States.

Also include some language in the 28th Amendment to the effect of “Congress shall pass now law from which its own members are exempt.”
