Judge strikes down Florida law mandating drug tests for welfare

A U.S. judge on Tuesday struck down a Florida law requiring drug screening for welfare recipients, saying that it violated the constitutional protection against unreasonable searches.

Florida Governor Rick Scott, a Republican who campaigned on a promise to expand drug testing, said he would appeal the ruling.

The law took effect in July 2011 and required parents to undergo and pay for urine tests for illegal drugs when they applied for Temporary Assistance for Needy Families, a federal-state program that helps poor people with children pay for food, shelter and necessities. …

We need drug tests for ANYONE who is elected or appointed...or on welfare, or food stamps, or Section 8 housing, or WIC....etc

I think that the judge’s already provided adequate evidence of using mind altering something or another...

I CRINGE every time I see the words U. S. JUDGE!!

Same here. Funny thing was that I was a state employee I was never tested and may know of one or two that ever were.

Working buys you freedom! Laziness gets your urine tested twice a week....

Welfare is not mandatory, it is voluntary and as such if you don’t want to get tested, don’t get on welfare....

If my tax dollars are paying to support someone, I insist they do a few bars of ‘Tinkle in the Cup’ by Dolly on the Dole.

And Random Drug tests at that too!

Have a Test Mobile much like the blood donation mobile, that drives and shows up randomly every day to people who are on welfare and politicians homes and tests their piss and blood for drugs... They want them illegal, they can live by the rules everyone else has to, the damn fools!

I disagree with the decision but I actually can see the judge’s reasoning.

It can't be an unreasonable search because it is voluntary. No one is being required to take a drug test.

That would have standing, for a class action lawsuit, for an enterprising up and coming lawyer. Could judge shop it until it gets approved.

And there's the rub. To think otherwise is to argue they have the right to money stolen from free citizens.

I agree with that - they should be drug tested, as these illegal drugs are the SCOURGE of society.

BUT ... at the same time I think EVERYONE should be drug tested, and anyone that fails, will need to undergo rehab. If they persist and do not get off these illegal drugs, after giving time for rehab and counseling - then those people should be thrown into jail!
