A Mexican federal judge sent Andrew Tahmooressi back to prison after the U.S. Marine sergeant made his first official courtroom appearance since being locked up more than three months ago for accidentally crossing the border with guns in his pickup truck.
The 26-year-old veteran of two tours in Afghanistan was finally able to tell his story to a judge, after his case had been delayed by both Mexico's unpredictable legal system and his own trouble settling on a lawyer. It was not immediately clear what Tahmooressi said at the evidentiary hearing, which was closed to the public. The next hearing in the case is scheduled for August 4.
Despite the judge's ruling, Tahmooressi's attorney, Fernando Benitez, told reporters that he was confident that the Marine's case was on the right track. Benitez said that his client's statement to the judge was "sound and made perfect sense," and claimed that irregularities with Tahmooressi's detention were grounds for dismissal of the case. The attorney said that his client was not provided with consular services for nearly eight hours after he was detained, nor did he have access to an adequate translator.
In addition, Benitez said that the order to search Tahmooressi's vehicle was dated March 28, three days before the Marine crossed the border.
Benitez had earlier sought to dampen hopes that federal Judge Victor Octavio Luna Escobedo would free Tahmooressi, although supporters, including his mother, Jill Tahmooressi, had held out hope.
Tahmooressi has been held since March 31, when he accidentally drove into Mexico at the San Ysidro, Calif., Port of Entry late March 31, after becoming disoriented from poorly lit street signs and being in a position on the road unable to make a last ditch U-turn.

First duty is to escape, I think. Mainly because of this and other actions by Mexico being a declaration of war against the USA.
And encourage and welcome illegal aliens to enter our country and DEMAND the public dole.
China is probably a better friend to the USA than Mexico is.
Time to boycott every Mexican product from beer to tequilla and hiring illegals to clean your yard.
Our Sunni President can free serious Islamic Killers and buy a deserter back from the Taliban.
Yet he can’t pick up a phone and “Say, free my Marine, Now!”
Any Marine or Sailor, who supports Obozo and other rats in Congress, while this Marine rots in Mexico is worthless.
You would think that the president of mexico would have the authority to end this.
We are dealing now with a disfuncional country, Mexico, which pretty much is at WAR with the USA.
Apparently the Mexican officials haven’t gotten enough bribes from his family. Maybe we should establish a fund to raise money for the bribes.
Considering that a week ago a Mex military helicopter fired on U.S. Federal officers, a state of war exists between the USA and Mexico, Andrew Tahmooressi should be rescued by a SEAL team.
Zero wants Tahmooressi in prison for owning firearms. He wants all of us locked away somewhere. He wants his fellow Muslims free to murder us. Why would he try to get Andrew out? Why wouldn’t he release Taliban generals?

I think you may be right. He could escape, and then come back the the US where he would be able to tell his story of his he was taken prisoner on trumped up Mexican charges and denied his Constitutional Rights.

(Prior to the Vietnam Conflict, violation of any of the above code elements could result in trial by Courts Martial. After learning of the atrocities inflicted on our personnel held prisoner in that action, it was determined that requiring strict compliance to such a demanding code was not always possible. It should stand as a guide to personal conduct but enforcement as a point of law is questionable.)
Sure this couldn’t have happened the way he describes. After all, we have been assured that the border is secure!
