IRS gives full account of lost Lerner emails

The IRS declared under oath and penalty of perjury on Friday that Lois Lerner’s hard drive is irrecoverable after being wiped clean by tech staff and recycled with an outside contractor, according to a court filing.

It was wiped clean, recycled, given to an outside contractor who then hit it numerous times with a sledge hammer and threw it into an active volcano.

You're essentially correct, but omitted a few of steps. . . The drive was sent to Lawrence Livermore National Laboratory, where it underwent a massive Electromagnetic Pulse, it was then returned to Washington, D.C., where the platters were exposed to the unprotected bile of Hillary Clinton, which has been scientifically proven to be more acerbic than fluoroantimonic acid. It was then subjected to 200 simultaneous, non-stop recordings of Barack Hussein Obama campaign promises. Only when it was smoking, was doused in a bucket of official Harry Reid Senate Excrement. THEN, it was sent to a "Certified Major Obama Donor" contractor for further processing. . .

NEVER forget the shipping and "handling". . .

I just had a thought. Considering the potentially explosive contents of that drive, do you suppose the IRS failed to perform the proper Environmental Impact Studies, failed to file the proper permits, before they threw this hazardous waste in the volcano?

The specialist tried to recover data but “all of the … efforts to recover any data were unsuccessful.” It was then sent to the criminal unit forensics lab, but they were also unable to save the data.

IRS criminal division official Eggas described how an unnamed senior analyst with more than 25 years of forensic data recovery experience was unsuccessful in recovering the data, and sent it back to the original service unit.

When that failed, “the hard drive was degaussed and then batched with other miscellaneous equipment (equipment whose inventory is not tracked by bar code tags) and transferred to an external recycling contractor for destruction and recycling.”

The testimony says “degaussing” involves “using a device employing magnetism and is designed to permanently erase data contained on magnetic data storage devices like a hard disk.”

The drive was sent to a criminal forensics lab for analysis and data recovery, and no one recorded the serial number of the drive. What kind of "criminal unit forensics lab" handles evidence this way?

They threw it into the West Mata volcano which is in International waters 1100 meters below the surface, so permits weren't required. The EPA, along with the Justice Department has concurred with the normal disposal of non-smidgen items.

According to the testimoney of that lyin’ head of the IRS, the backups to the servers were being made to tape drives.

Because of the horrible anti-IRS GOP budget cuts, the $1.8BILLION budget for IRS IT was just so paltry they couldn’t buy more blank tapes.

Hence, they only kept backups for 6 months. Adios Lerner emails!!

Oh, those paper printouts were also shredded or not kept according to law either.

So it goes, laws are only for the little peeps, not the ELITE!!

I presume the plaintiffs will tell the court this was a “bull account”, not a “full account”. “Er, your honor, we can’t produce the evidence because we deliberately destroyed it”, just doesn’t seem adequate.

Plaintiffs should petition the court for answers to these and other obvious questions:
Names, titles, contact info of personnel who did the “recovery” work = ?
Names, etc., of everyone gave them instructions = ?
Written instructions?
Date “crash” incident first reported?
Recovery efforts performed when?
Produce all communications involving the files, recovery, etc.
Were the personnel involved aware of the FOIA requests and subpoenas for the documents on the “hard drives”?
Detailed explanation of efforts made to recover the files from other sources — servers and message recipients = ?
Did Lois Lerner or others involved use Blackberry devices, or other computers, phones, etc. to communicate about or matters related to the FOIA requests and suits?
Where are those communications?
Why did the IRS pay for a data backup service if they didn’t use it?
Why did the IRS suddenly cancel that service?

Thanks for the quote. I have read Voltaire, but either don't remember reading this, or was unable to put it into context.

We must continue to tend "one's own garden", while we sharpen our plowshares into swords.

I read Voltaire a generation ago in High School and College. America was still America then and before the rapid march to authoritarianism and fascism.

The emails weren’t JUST on Lois Lerner’s damn harddrive.

They were also on the harddrives of everyone in the email chain who sent or received a message in the TWO-WAY conversation.

This “dog ate my homework” sh!t won’t fly.

That’s what the person who filed the report with the court said, under oath.

So the next step is to call in that IT specialist who had been there since 2007,” put him under oath and see if his testimony is consistent. He should, for example have an insight as to whether the drive had crashed, or was just wiped clean before he got it. Put him under oath and let’s see exactly what he found when he got his hands on the drive. Who knows? He might even admit under oath that he did the erasing himself. After all, someone did a pretty good job on it somewhere.

The point is that they could have recovered the emails from the Blackberries immediately when the computers crashed. They weren’t lost at all.

Lois certainly was, she was seeking to communicate in ways that circumvented the FOIA requests...
