Executive Order — Revised List of Quarantinable Communicable Diseases

EXECUTIVE ORDER

REVISED LIST OF QUARANTINABLE COMMUNICABLE DISEASES

By the authority vested in me as President by the Constitution and the laws of the United States of America, including section 264(b) of title 42, United States Code, it is hereby ordered as follows:

Section 1. Amendment to Executive Order 13295. Based upon the recommendation of the Secretary of Health and Human Services, in consultation with the Acting Surgeon General, and for the purposes set forth in section 1 of Executive Order 13295 of April 4, 2003, as amended by Executive Order 13375 of April 1, 2005, section 1 of Executive Order 13295 shall be further amended by replacing subsection (b) with the following:

“(b) Severe acute respiratory syndromes, which are diseases that are associated with fever and signs and symptoms of pneumonia or other respiratory illness, are capable of being transmitted from person to person, and that either are causing, or have the potential to cause, a pandemic, or, upon infection, are highly likely to cause mortality or serious morbidity if not properly controlled. This subsection does not apply to influenza.”

Sec. 2. General Provisions. (a) Nothing in this order shall be construed to impair or otherwise affect:

(i) the authority granted by law to an executive department, agency, or the head thereof; or

(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

(b) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Amendment comes in wake of Ebola scare

Although the quarantining of people suspected of being infected with the Ebola virus seems like a perfectly logical move, the actual preconditions for this to happen aren’t restricted to just those suffering from the disease.

As we highlighted earlier this week, the Centers for Disease Control and Prevention (CDC) has measures in place for dealing with an outbreak of a communicable disease which allow for the quarantine of “well persons” who “do not show symptoms” of the disease.

In addition, under the Model State Emergency Health Powers Act, public health authorities and governors would be given expanded police powers to seize control of communications devices, public and private property, as well as a host of other draconian measures in the event of a public health emergency.

When the legislation was introduced, the Association of American Physicians and Surgeons warned that it “could turn governors into dictators.”

Yesterday it was reported that Emory University Hospital in Atlanta was set to receive a patient infected with Ebola. A hospital in Germany also accepted an infected patient earlier this week. Some critics have raised concerns about the risk of deliberately importing infected individuals into the west.

They opened the borders and left them open
and then sent the infected lured “immigrants”
by airplanes and buses into cities.

No public records.

Some have been very sick costing states (where
they can control the imported diseases) MILLIONS.

It previously was unclear how, or why, the cities
were selected.

Import active, oozing Ebola patients, treat them until they recover from their overt symptoms, release them to the general public while they still have active virus in their bodily fluids.

Clamp down on the rest of us.

I wonder if a certain FReeper still thinks bringing people with active, bloody Ebola cases into the USofA is a great idea?

Bring Out Your Dead

Post to me or FReep mail to be on/off the Bring Out Your Dead ping list.

The purpose of the “Bring Out Your Dead” ping list (formerly the “Ebola” ping list) is very early warning of emerging pandemics, as such it has a high false positive rate.

So far the false positive rate is 100%.

At some point we may well have a high mortality pandemic, and likely as not the “Bring Out Your Dead” threads will miss the beginning entirely.

*sigh* Such is life, and death...

Unless I’m missing something this applies only to respiratory diseases, and that would exclude Ebola at this time.

Re-read section (b).

The "or's" could well be argued to mean respiratory diseases 'OR have the potential to cause, a pandemic, OR, upon infection, are highly likely to cause mortality OR serious morbidity if not properly controlled.'

I'm sure Holder, Jarret, et al. will hold out for the narrowest, least intrusive, most freedom protecting interpretation of this de facto law of the land.

No big deal .... the “science” will suddenly show that Ebola is airborne and respiratory and all you have to do is exhale and you could be infecting millions, especially if you are of the dreaded ‘anti-Obama’ political ilk or have any skin color that Holder doesn’t approve of.

Ebola (human strain) is not a respiratory illness.

Yes. But the moment they start bleeding into their lungs, even the most casual of observers would conclude that there is respiratory involvement.

Someone with an agenda and the full weight of the judicial system on their side could make that leap without their feet ever leaving the ground.

West Africans in the United States and elsewhere may face stigmatization (stigma) during the current Ebola outbreak because the outbreak is associated with a region of the world.

Stigma involves stereotyping and discriminating against an identifiable group of people, a product, an animal, a place, or a nation.

Stigma can occur when people associate an infectious disease, such as Ebola, with a population, even though not everyone in that population or from that region is specifically at risk for the disease (for example, West Africans living in the United States).

Stigma occurred among Asian Americans in the United States during the SARS pandemic in 2003.

Communicators and public health officials can help counter stigma during the Ebola response.

Communicate early the risk or lack of risk from associations with products, people, and places.

Raise awareness of the potential problem.

Counter stigmatization with accurate risk information about how the virus spreads.

Speak out against negative behaviors.

Be cautious about the images that are shared. Make sure they do not reinforce stereotypes.

Model good behaviors; engage with stigmatized groups in person and through social media.

The Centers for Disease Control and Prevention (CDC) protects people’s health and safety by preventing and controlling diseases and injuries; enhances health decisions by providing credible information on critical health issues; and promotes healthy living through strong partnerships with local, national and international organizations.

Totally consistent with DHS and TSA directives to be fair and non-discriminatory. Don’t want muslins feeling picked just because the vile and viscious actions 99.999% make ther othe 0.001% look bad.

Far as I know, they don’t bleed into their lungs...

Only smooth muscle and tissues are affected...skin, gums, throat, intestines...other organs..

The lungs are totally different...and to my knowledge, not affected by any ebola strain with one exception and that is the reston strain, which only affects animals and is not dangerous to humans.

So it’s not respiratory...

I’m very glad they were treated and have mostly recovered.

I’m not glad the entire country was exposed to mortal peril, I’m not glad that they’ve been released onto the streets to mingle with hundreds, perhaps thousands of random strangers and during the period that repeated tests of other survivors demonstrate that they could still have active Ebola viruses in their secretions.

I will be really glad if no one they touched, sneezed near, ate with, used a public restroom before, or was ‘intimate’ with them gets sick in the next 42 days.

Only then will I be confident that we have dodged snake-eyes on those two rolls of the dice.

They could just as easily and should have been treated where they fell ill.

I would never argue that governments won’t do the interpretations that make sense to them at the time. But I don’t think that is the point.

I think this change to the regs was made for SARS and other similar respiratory diseases that are not flu and maybe bacterial and not viruses.

Not Ebola.....

You say right after reminding us the Reston strain IS respiratory.

Depends on what the meaning of is, is, eh?

I'm sure the White House friend of ISIS will define IS in the most prudent and narrowest sense. Just like you, I'd bet my very life and the lives of everyone I hold dear, and the continued existence of the entire country on that.
