Michael Brown shooting: Is this new video a 'game changer'?

It's a view of the Michael Brown shooting we hadn't seen before, but could it be enough to shape the way a grand jury handles the controversial case?

An exclusive video first broadcast Wednesday on CNN shows two construction workers' reactions just after a police officer shot the unarmed African-American 18-year-old last month in Ferguson, Missouri. The contractors shown in the short video clip told CNN they saw Brown with his hands up as Officer Darren Wilson pursued him and opened fire.

Several legal analysts describe the video as a "game changer." Others said it might not make much of a dent in the case.

Here are three reasons legal analysts told CNN the video could be important:

1. The witnesses it depicts are white and don't live in Ferguson.

The race of the witnesses shouldn't matter, but it could for the grand jury that's investigating the case, said Mark Geragos, a CNN legal analyst and criminal defense attorney.

There are nine whites and three African-Americans on the 12-member panel tasked with deciding whether Wilson, who is white, should be charged.

"You now have some witnesses who the majority of this grand jury are going to better relate to. I hate to say it, but that's the reality of it, and that's why it's a game changer to me," Geragos said.

2. It shows their reactions shortly after the shooting.

Lots of people have come forward with their accounts of what happened the day Wilson shot Brown. But it's significant to have the immediate reactions of two witnesses on tape, said CNN senior legal analyst Jeffrey Toobin.

"They're saying that he was running from the police officer and that his hands were up," she said.

Any witness who says that has to be full of crap. The autopsy clearly shows Brown was shot in the front not in the back.

He could have had his hands up and then said as has been reported...you are not going to shoot me, and then rushes the officer that is still dazed from the punch he took.

Who knows

Also the one contractor reportedly said he spent 30 minutes with Big Mike just before the shooting,according to him Big Mike was trying to lead him to Christ.

I guess if he was on the stand testifying, I might ask him if he was surprised to learn that Big Mike went straight from trying to lead him to Christ to robbing a liquor store and assaulting the clerk

Would ask him if he appeared to be high, did he shear a joint with you? By this point we will know if there was anything else in his system

There are good empirical reasons to discount this "testimony" as credible. Forensic experts in eye-witness testimony are unanimous that it is terribly unreliable, even right after the fact.

Studies have amply demonstrated that what someone says he saw, especially suddenly or unexpectedly, is as likely as not to be wrong. The fact that there are two of them does not change this, as they would both be subject to the same sources of distortion.

We still don't know what happened in Ferguson and should await some report from a credible investigation, including being consistent with an objective coroner's report. The reactions of these two isn't it.

CNN is trying to counter their GENTLE GIANT THEORY that went Kaput when the STRONG ARM ROBBERY VIDEO WAS RELEASED. This video shows JACK. It has already been reported by witnesses he attacked the officer and cold cocked him while going for his gun. The gentle giant then ran, turned around and walked back towards the officer with his hands up. He did not follow orders and the officer based on the previous attack had to protect himself. I BELIEVE NOTHING FROM CNN. This video shows only a selected view that supports the liars on the lefts story line.

Although CNN doesn’t mention it here, the contractor said he heard “two shots” separated by 30 seconds. That’s not in agreement with anything else we’ve heard.

There exists an audio recording of the gunshots, captured accidentally by a guy engaged in a video chat with his girlfriend.

I have never been on a murder jury, but I did try an obscenity case. The deliberations with the other jurors convinced me that people are generally too stupid to decide the fate of other human beings. So you’re right; any trial is a crap shoot.

Since the CNN/AP report of the 2 new landscaper witnesses, the St. Louis Post Dispatch [9-16] wrote about their interview of the one who said MB’s hands were up, who also said but isn’t being reported:

“Wilson, gun drawn, also stopped about 10 feet in front of Brown, the worker said. Then Brown moved, the worker said. “He’s kind of walking back toward the cop.” He said Brown’s hands were still up. Wilson began backing up as he fired, the worker said. After the third shot, Brown’s hands started going down, and he moved about 25 feet toward Wilson, who kept backing away and firing. The worker said he could not tell from where he watched — about 50 feet away — if Brown’s motion toward Wilson after the shots was “a stumble to the ground” or “OK, I’m going to get you, you’re already shooting me.”

St. Louis Post Dispatch article with landscaper saying MB repeatedly came toward Ofc. Wilson as he backed up and fired. The link also has a video showing a black man, with his arms/hands up, hurrying toward the landscaper who then mimics the man by also raising his arms/hands, imo to indicate that’s what he saw too. But that’s not all he saw.
