Judge sides with student punished for criticizing lesbians

The University of New Mexico and one of its professors will face trial on a charge of violating the constitutional rights of a student punished for expressing her opinions about lesbianism in a class described by the instructor as having “controversy built right into the syllabus.”

Chief U.S. District Judge M. Christina Armijo denied a motion by the university to dismiss a case brought by student Monica Pompeo, who claimed she was improperly dismissed from the class for describing lesbianism as perverse in an assigned critique of a lesbian romance film.

The course, “Images of (Wo)men: From Icons to Iconoclasts,” was taught by professor Caroline Hinkley in 2012.

Judge Armijo, in her Sept. 29 order, wrote that the First Amendment “violation in this case arises from the irreconcilable conflict between the all-views-are-welcome description of the forum and [the professor's] only-those-views-with-which-I-personally-agree-are-acceptable implementation of the forum.”

Hinkley wrote in the syllabus: “It’s quite clear that we do not expect anyone to necessarily agree with the positions and arguments advanced in our work. There’s controversy built right into the syllabus, and we can’t wait to hash out our differences.”

But when she assigned students to watch and write about “Desert Hearts,” a 1985 lesbian romance film, Pompeo said Hinckley refused to read beyond the first two pages of her harsh critique. The professor described Pompeo’s opinion as “inflammatory and offensive” hate speech and said it would be in her best interest to drop the class.

The movie, set in the 1950s, tells the story of a woman who arrives to get a divorce and “finds herself increasingly drawn” to another woman, “an open and self-assured lesbian.”

I would say this....were this a private school...they could get away with this, and the professor could play virtually any game they desired. The problem is...it’s a state-funded school, and thus inviting state constitutional issues. The professor may be shocked as they advance with this case, but he or she is merely a state employee and simply fearing the chancellor’s wrath is the least of the problems ahead.

From a loser prospective, if they reach the end and pronounce the professor wrong...it opens vast doors at the university and throughout the US. If I were the chancellor at the university...I’d try hard to convince the professor and his lawyer to accommodate this kid, apologize, and pay some moderate damages (lawyer fees maybe). You don’t want this getting to the end, and the judge issues out a fine and some type of punishment that might mean loss of tenure or suspension from the university for a year or two, or loss of pay.

It’d open up big doors for further law episodes in court, and the university would be spending tens of millions on lawyers.

Points well taken. This should be handled at the administrative level.

That being said, my spidey senses tell me that the outcome you fear will become reality come hell or high water. Liberalism is nothing but a make-work program for lawyers.

Hey!

I am a clitorically well endowed lesbian that has fathered 4 outstanding children. Women have been a passion of mine for several decades and at NO TIME in any of those numerous years have my lust for women waned. Men do not turn me on in the slightest. I first learned that I was a lesbian when I was five years old. There was a cute little blond haired, blue eyed six year old girl that I just couldn't stay away from. She taught me how to play jacks, hopscotch, tether-ball, two-square and all the other cool things little girls like. She even taught me how to kiss...

Seriously... Universities and their professors need to be closed down and fired. What use are classes like the one at the center of this case? How is learning about sick and twisted, disease ridden, child molesting, abominable perverts like the sodomite professor in this case going to help students learn how to get a job, run a business, invent the next wheel or colonize another planet? No.... Courses like this one are nothing more than burner (elective) course meant to fill a student's required hours so that said students can qualify for student loans, grants, etc. and the university can sell more books and fleece the taxpayers for more money.

Courses like this one serve no USEFUL purpose at all. Professors of such courses have only one agenda and that is to pervert YOUR child by forwarding their perverted lifestyle.

Point taken and thanks for your honesty. The schools need to get out of the gender studies and advanced sex education business. Besides the kids already know this stuff and could probably school the teachers by the time they are taught it anyway. Now if they want to teach them about birth control in middle school that might be helpful.

Well, let’s say that the kid wins, and the judge determines that not only did the professor screw up (separate fine or punishment), but the university owes the kid something (maybe $10,000...maybe $100,000).

So, let’s look three years ahead, and twelve kids from this New Mexico university are repeating the same accusations, and the fines are getting up to $100,000 each.

Where exactly will the mythical and magic fine money come from? Adding another $3k onto the yearly tuition?

And by 2025? Making a kid pay $35k a year for a public marginal university tuition deal? A quarter of that for fines and yearly lawyer cost to fight for the stupid professors?

This is a court case that the college and every college in the nation cannot afford to lose. It would eventually bankrupt the whole standard of screwed-up tuition as it is. Your own alternate fix is to bring the liberal professor in, and let them feel suspension pains from time to time, if they go beyond any realistic expectation. Money for some reason....affects the character of liberals.

Some thoughts:

1) How novel. A judge who actually rules on the written law and Constitution. Any chance the prospective GOP Presidential candidates would nominate this judge to a higher court if elected?
2) A good George W. Bush appointee to the district court (2001). Too bad he didn’t raise her to a higher appeals court before he left office.
3) Why is a publicly funded state university using taxpayer money to fund courses such as this one and hiring intolerant leftist professors whose only goal is indoctrinating students?
4) Why are parents who are fully or partially paying for college educations at colleges and universities allowing their students to take garbage classes such as this one which do nothing to prepare their daughters and sons for life beyond the campus? As I told my daughter, “As long as I’m paying for your education I reserve the right to approve your course selection.” Parenting doesn’t end when a child leaves for college.
5) I hope this case goes to trial and the plaintiff prevails over the university and professor. Unfortunately, Obama has appointed so many leftist judges to the higher federal courts it is likely a ruling in favor of the student will be overturned on appeal no matter what the Constitution or any law passed by Congress says.

It took my daughter, a freshman, about a week to get her creative writing class all riled up. When asked, she pointed out her opinion of some differences between male and female roles (or at least how they are looked upon by society). According to her, a fellow student raised her hand, declared that she was a feminist and deeply offended by my daughter's remarks, and eventually started crying and stormed out of the class.

My daughter said an argument ensued where one person took her side, or at least defended her right to express her opinion. While the rest of the class took the feminist's side where one should not speak if one has views that could be deemed controversial or offensive.

The class was eventually dismissed early. My daughter originally felt that the professor took the feminist's side, but in a private meeting, I guess the prof agreed that the feminist young lady was a bit high strung on the matter.
