Having that black sergeant in charge of that crime scene takes race out of the equation. As awful as Pantaleo’s actions appear on that video, at no time does that black sergeant order Pantaleo to stop choking Garner.

With a population that is 70% white and 10% African-American, when a Staten Island grand jury is presented with a white cop supervised by a black sergeant applying a lethal chokehold, it eliminates the racial component.

The grand jury was then left with the decision of whether Pantaleo had malicious intentions. It decided that he did not. Case closed. ...

And the female (ph), she found that there were 10 hemorrhages on the inside of the neck, in the muscles of the neck, petechial hemorrhages in the eye, hemorrhage in the tongue. And those are all evidence of neck compression. You’re right, chokehold has many different meanings in all. What we’re concerned at autopsy is was there pressure on the neck.

HANNITY: Right.

BADEN: There was pressure on the neck and pressure on the chest.

HANNITY: I don’t doubt it. This is a big guy.

BADEN: Pressure on the chest that interferes with the lungs expanding and —

HANNITY: But they also —

BADEN: And hands on the face and nose. So he couldn’t breathe, and he was telling the truth.

HANNITY: But he was still talking does. That impact his ability to talk, if he can’t breathe?

BADEN: Yes, no, you can say, I can’t breathe.

HANNITY: You can.

BADEN: Absolutely.”

So: she found that there were 10 hemorrhages on the inside of the neck, in the muscles of the neck, petechial hemorrhages in the eye, hemorrhage in the tongue. And those are all evidence of neck compression.

So he couldn’t breathe, and he was telling the truth.

HANNITY: But he was still talking does. That impact his ability to talk, if he can’t breathe?

BADEN: Yes, no, you can say, I can’t breathe.

The cop is guilty of at least manslaughter.

Something, very important, in the GJ testimony allowed the officer to not be charged. We’re not privy to it yet.

Only a limited amount of information has been released and that took an order from a judge at the request of the prosecutor.

Pantaleo’s lawyer has released some information. Pantaleo testified and answered 20 questions from the jury and explained what happened in the videos. He did not use a chokehold. As he pulled Garner down using an approved technique, Garner pushed him up against a glass window that buckled. He feared going through the window and that’s when his left arm went around Garner’s neck. Regardless, the coroner still didn’t find evidence of choking such as a damaged trachea or fractured hyoid bone. If anything, Pantaleo was careful not to apply pressure to the windpipe. The palm of his left hand was facing outward, and contact was made to the side of Garner’s neck by the top of his left forearm. Garner appeared to be conscious as he went down. He supported himself with his arms.

Note that I said he couldn’t breathe if he was choking. I didn’t say that he couldn’t breathe if he was talking. There’s a difference.

If he was in a chokehold, i.e., being choked, he would not be able to breathe or talk. If he was unable to take a breath (even if he wasn’t being choked, but was for example suffering an asthma attack) he would still be able to expel the air needed to say “I can’t breathe.”

Again, he resisted arrest. The police took him down. If you’re in lousy health to start with, don’t resist arrest. If he had not resisted it’s likely he’d still be alive today. Calling the cop, who was doing his job, an executioner, is inane.

I disagree. Grand jury proceedings should remain, for the most part, confidential. Not all cases are open and shut (as this one turned out to be, despite the Left’s proclivity to think otherwise) and releasing all the evidence would in many cases be likely to cast an unwarranted shadow over the accused.

In this case, the way it was handled was probably a good decision because the prosecutor knew that the case shouldn’t go to trial, but he also knew that maintaining secrecy if he took the case to a grand jury was an untenable situation given the national attention to the case.

So his only other option was to make up his mind ahead of time and not bring the case at all, i.e., refuse to prosecute. Obviously, that would have put his head on the chopping block along with Officer Wilson’s without resolving the issue.

What we’ve witnessed is the successful implementation of an ingenious solution to a real mess, a mess created by the Progressive media’s failure to do its duty to the citizenry. Whether the prosecutor came up with the solution, or someone else, whoever it was should be commended.

It’s a chokehold. That’s the generic term of lock around the neck. Now legions of lemmings declare no such thing exists. Parsing words and claiming well “trachea not damaged” is utterly laughable. Damage to the neck and body by compression. I guess that was just the invisible Steinway grand piano that landed out of the sky no one saw?...haha

Pantaleo Hooked his right arm underneath Garner’s right arm. Before pulling Garner back to take him down, Pantaleo moved his left hand so that it was pulling at the top of Garner’s chest on the left side. That isn’t a chokehold and it’s all available to see in the video. Pantaleo explained all this to the grand jury and that’s why he wasn’t indicted.

Hahaha. The cop’s arms are locked around Garner’s neck in a blatant chokehold, violating policy as the video very clearly shows, he then kneels on his head. Pretty easy to see.

The initial technique used to bring down Garner was not a chokehold. Pantaleo explained to the grand jury that Garner drove him into a large glass window that buckled, which can be seen in the video, and Pantaleo feared that he would go through the window. That’s when Pantaleo’s left arm got around Garner’s neck. Even so, there is no evidence of choking. Garner appeared to maintain consciousness until well after he was on the ground. He could speak which means he could breathe, and the coroner found no evidence of choking such as a damaged trachea or a fractured hyoid bone.

It’s a chokehold on the ground. Nuff said. One can speak in a chokehold. Again, this keeps getting repeated about how one can’t speak, flatly laughable and untrue. It depends on the pressure, which will vary with two bodies moving. If it’s tight enough and secure, speaking would be difficult, but slightly less, one can speak.

And no mention of findings of hemorrhaging in neck? Must be that invisible grand piano that fell from the sky.

So again, if we were truthful without an agenda it’s the things not said here. 5 guys compressing neck and chest cause a death.

As soon as Pantaleo could reposition his left arm on the ground, he was applying pressure to the right side of Garner’s neck with the top of his forearm with the palm of his left hand facing outward. Hemorrhaging is nothing more than bruising. It’s not a cause of death or evidence of choking. There’s no other evidence of choking and there was no indictment.

Pressure caused by a chokehold and pile on his body cause his death and his poor health per medical examiner. Arms locked around a neck is a chokehold, whether on windpipe or just neck. It’s not complicated.

No indictment, sure — what did the DA lead with? We need pre-FDR days of common law grand juries then. Hardly matters since public outrage and raw video footage show results of excessive force.

The grand jury reached the correct conclusion based on several weeks of evidence presentation and testimony.

Maybe if we bring back lynch mobs you’ll get the uncomplicated results you want.

It’s fortunate that so many private citizens know the ins and outs of law enforcement and what should be done. Because; not so long from now, no decent person of any color is going to be willing to take on the job. That will leave the scum policing the scum and, oh yeah, the rest of us too. None of our lives will be worth a cent, not even law-abiding blacks. What’s coming will make the Capone days look like a kiddie playground.

Exactly.

I was at a cousin’s lake place awhile back, and some white cops-in-training were there. I haven’t been so scared for the future of the country in a long time.

It was like Junior High Boys + Beer Soaked Fraternity + C- GPA + Gang + Steroid Gym Rats = TROUBLE!!

Wow. Those A-holes are going to have the power to kill me. I don’t trust them for one microscopic second. They were rude to their wives, ignored their kids, were dangerous to us on the dock, drunk as skunks, spooky looking with tattoos, etc.

Just an accidental placement of Pantaleo’s left arm. No actual intent to choke. Coulda been Pantaleo’s right leg around Garner’s left pinkie just as easily. Just happened to have “got around Garner’s neck” with no actual effort by Pantaleo.

Or did you really mean “Pantaleo grabbed Garner by the neck and squeezed”?

Are you going with the accidental or intentional chokehold?
