Rand Paul: Officer involved in chokehold death shouldn't be a policeman

Washington (CNN) -- The New York officer involved in the death of Eric Garner should no longer be on the police force, Sen. Rand Paul argued Monday.

The Kentucky Republican said Daniel Pantaleo lacked "discretion" when he placed Garner in a chokehold for allegedly selling untaxed cigarettes.

The “experts” have shown that it wasn’t a “choke hold”. Rand...facts matter.

People watch these movies where 100lb heroines subdue 200lb bad guys in seconds while mussing their bangs so they catch the light at just the right angle to be even more photogenic than they normally are. This generates unrealistic expectations about what's possible in real life.

I agree with you. That policeman over-reacted. I’m fearful of giving too much support to Paul, because he’s become a politician. Who knows if he means it or not?

Starting with Rand Paul’s comments on immigration a couple of years ago, he’s been gradually removing himself as a viable GOP presidential candidate. Now, he’s taking big steps by joining the “GOP are racists” far left crowd, he’s taken himself completely out of contention. Why he’s gone down this road is a mystery to me, just like Marco Rubio’s decision to jump on the Comprehensive Immigration Reform bandwagon. Rubio’s toast too.

I’m not sure Rand Paul is ready to be President but he does have a good grasp of right and wrong. If you are restraining someone to the point that they tell you repeatedly they cannot breathe then its time to forget your marching orders and do what’s right. Falling back on “they told me to do it” is BS. The penalty for selling loosies should not be death on the sidewalk.

The situation was handled poorly by the officer and his supervisor. I would fire both of them. There is no basis for criminal charges. It was just bad work that unfortunately resulted in a death.

Thus, I agree with Senator Paul.

I think the over-reaction started when the officer jumped on the guy’s back. It simply wasn’t necessary.

Issue a citation, for pete’s sake. Tell him to appear in court. But loose cigarettes aren’t a violent crime, so violence is not even a remotely justifiable response.

The jury only decides if he should be prosecuted at law. It doesn’t decide if his employer thinks he was out of line. He could probably cite some kind of justification based on Mr Garner’s resisting cooperation, so that’s what saved him from a wrongful death charge.

That doesn’t mean he didn’t stupidly escalate a simple situation. I think he did.

In any case, he should be taken off the street and stuck in some file clerk’s job.

That is exactly right. I was thinking the same thing. Why didn’t the cops just issue a ticket and tell the guy to move on away from the retail shop? These guys selling loosies are just a nuisance.

The police are not the judge, jury or executioner.

What you are saying, and I agree, is that the head lock was not the cause of his death but he died from a combination of being put face down on the ground (the proper method to subdue a resisting suspect) and his own physical make up and a slow response by the EMT’s.

What really caused his death though was the cigarettes.

Except that the choke hold was not the cause. Review of the video shows that the hold was only briefly applied. The victim did not die from lack of oh-2. It seems the victim had many medical triggers that contributed to his death, brought on by resisting arrest and the ensuing tussle. The knee in the upper back could be more of a contributor as well.

That's the problem. Cops aren't fellow citizens or Men anymore rather they are Units who ‘told and trained’ and then turned loose. These four had no problem with using maximum force against this sad sack the minute he gave them some static. Similarly the gov’t didn't have any trouble sending scores of men including snipers into the Bundy ranch to use force where it would have been wiser to plod along and keep it Civil. Instantaneous force, by the way, is a FEAR reaction.

None of this would have happened had he not resisted arrest. He’d been arrested 30 times. He knew the drill. He knew he was risking a heart attack by resisting.

Once he has him on the ground that’s apparent. He’s applying pressure to the side of the neck rather than the windpipe.
