Charges sought against Albuquerque cops in shooting: police

(Reuters) - Prosecutors in New Mexico are seeking murder charges against two Albuquerque police officers in connection with the 2014 shooting death of a homeless man, which sparked protests in the city, police said on Monday.

Former Albuquerque police detective Keith Sandy and current officer Dominique Perez could face murder charges linked to the March 16 killing of mentally ill homeless man James Boyd, police spokesman Tanner Tixier said.

That shooting prompted protests sharply critical of the Albuquerque police department, which the federal government found has used excessive, even deadly, force against civilians. It is now facing reforms and is under federal monitoring.

Sandy and Perez both face murder charges, Second Judicial District Attorney Kari Brandenburg said in a statement provided through her office. The statement provided no further information on the details of the charges.

Bean bag rounds are for unarmed suspects. This was an ARMED man with a 20 year history of violence and attacks on police officers who had threatened the lives of the officers who shot them.

Watch the video carefully. There was a flash bang to start. (thrown when he was complying and picking up a bag) Then they released a dog. The dog on lead lunged at him and the handler moved forward (officer induced jeopardy)he stood defensively against the dog, then the cops shot him with the ARs several times.
He goes down.
As he lays there, shot to pieces, they give commands to drop the knife. (doubtful he could comply as he fell incapacitated with it in his hands still)
Then they beanbagged him several times, and released a dog on him for several bites.

The guy was a flaming A-hole with a violent record in Albuquerque, but the shoot is simply not justified by that.


I agree with you on all points.

From the article: “Officer Sandy, who was involved in the shooting, was fired from the New Mexico State Police in 2007 over accusations of fraud. He was allegedly making money doing private security work while also on the force, KRQE reported.

When Sandy joined the APD, the department said he would be a civilian employee and wouldn’t have a gun or badge. Sandy continued rising through the ranks, eventually joining the Repeat Offender Project Team.”

The good news is that almost everyone agrees it’s murder. I even heard other police officers say it looks bad. The D.A. agrees and is prosecuting.

Well I would not trust that report. Just like B.S. internal investigation that cleared the cops initially. Whoever, was in charge of that should be fired, arrested and charge with conspiracy to cover up a murder.

Just look at the video. The guy was trying to leave, and they attacked him. Those cops flat out murdered the guy plain in simple.

I’d agree with you if there weren’t also video of these “officers” joking about shooting the bum in the groin with a shotgun on dashcam audio before there ever got there.

If I’m on a jury, that’s premeditation IMO...

According to the video the police set in motion the events where they shot him. First they threw the concussion grenade close to him, then when he moved because of the blast, they let the dog lunge at him. When he turned to brace for the dog attack, they shot him. The shooting was bad enough, but what they did next was what repulsed me. As he lay there dying, they tortured him by shooting him with bean bags. Then they let the dog go bite him.

If there was any justice, they would be doing time for murder. But I suppose, judging by some of the posts I read, this is the caliber of men the younger guys want in authority over them. It makes me thankful that I am long in the tooth andmy race is almost run.

If you bothered to learn the whole story, you would know that earlier he had threatened to murder the officers if they gave him any more commands.

What does the location of the police murders by a knife wielding lunatic matter? It clearly demonstrates that police who hesitate to fire on suspects brandishing knives are likely to end up dead. Google the 21 foot rule if you wish to be informed.

You are probably not aware that one of these two cops charged that did shoot the guy said he could not wait to shoot the guy he killed. This was before he even drove up on the scene. They have it on tape and the cop does not even deny he said that.

Did you even see the video????????????

The threshhold is not POTENTIALLY dangerous, you moron. EVERY human is POTENTIALLY dangerous. They could have easily ended it within 4 hours using less than deadly force. The fact that, with bean bags and tasers and dogs and outnumbering him greatly and having him trapped for 4 hours, they STILL could not get him under control, even with him "not following orders", says far far more about the cops than it does about the homeless idiot.

If I'm on the jury, I vote for murder charges.

A lot. Do you really believe those Nicaraguan "officers" received the same training that a typical U.S. LEO receives regardless of agency location? Puhleese! And did you notice that the "officers" formed a circle around the perp so that when they finally started shooting, other "officers" were in the line of fire? Yep, these boys were really well-trained.

I did. It appears the "21 foot rule" applies to an officer facing a knife-wielding subject when the officer's GUN IS HOLSTERED. Let me repeat that for you. The "21 foot rule" applies to a situation where an officer is facing a knife-wielding subject when the officer's GUN IS HOLSTERED!

That is not the situation here: Multiple LEOs, armed with both lethal and non-lethal force trained on the perp and a police dog to boot.

So who is uninformed?

You seem to be an “Al Sharpton conservative”.

The idea that the lives of police or innocent civilians should be put at even the slightest risk to preserve the lives of violent felons who have made threats against innocent lives is a fairly new and extremely flawed idea. I think it started with the OJ Simpson chase.
