There’s not much question which way the decision will go: same-sex couples are going to prevail. The logic is plain:

In 2013, the court—the very same nine justices—struck down the Defense of Marriage Act. The plaintiff was a lesbian spouse whose marriage was recognized under New York law. The court ruled that the Constitution bars the federal government from treating traditional marriages differently from same-sex marriages in states that legalize both.

The game was fixed from day 1 when this issue appeared on the radar. The only thing that can stop it is Ginsburg croaking. I think being opposed to gay marriage will make one unfit to be a member of mainstream society as segregationists. Traditionalist churches, institutions, and people will be forced into silence.

SCOTUS should NOT be hearing this gay marriage case because marriage is not an enumerated power delegated to them by the Constitution. So it is up to the states to assert adhesion to the Rule of Law of the Constitution and declare they reject unconstitutional federal acts and decisions like hearing and deciding regarding gay marriage (regardless of their ruling - it is not in their constitutional scope of power to hear the case AT ALL (other than to repeal lower federal court decisions and send the case back to the state where it originated)).

Even Ginsburg conceded that she didn't want a Roe v Wade ruling in regards to homo marriage.

I predict a 7-2 ruling in favor of states being allowed to define marriage.

I hope SCOTUS is consistent and makes sure my state issued CCW permit is recognized in all 57 states. Or better yet, just rule in favor of constitutional carry, as it should be anyway.

So what is your theory for Roberts inexplicably rewriting the ACA on the fly (which has never been done in our country’s history) to make it a “tax?” I’m guessing you’ll say he was a stealthy liberal all along.
