Feds say Walmart was biased against lesbians

BOSTON, MA -- A federal agency says Walmart discriminated against a lesbian employee who sought health coverage for her ailing wife and has ordered "a just resolution" for violating her civil rights.

The U.S. Equal Employment Opportunity Commission ordered the retail giant to work with Jacqueline Cote of New Bedford, Massachusetts, who hopes the determination will help her pay off $100,000 in medical bills.

In a Jan. 29 EEOC ruling, obtained Wednesday by The Associated Press, the agency said Cote "was treated differently and denied benefits because of her sex."

Well then the feda.need to boost domestic partners to include multiples (polygamists)...lest the feds be “discriminating” vs. Their “sexual orientation”

Cote "was treated differently and denied benefits because of her sex."

Incorrect. She may have been treated differently based on her sexual orientation but not because of her sex unless the judge is claiming that lesbian is an entirely new gender from woman or that the benefits would have still been denied if she had an ailing husband.

This is either bad law or awful reporting.

Still, if homosexuals can legally marry in Massachusetts and if Wal-Mart's health coverage provides for covering sick spouses of employees, Wal-Mart has little recourse but to pay the woman so long as the laws were applicable at the time the health claims were filed.

I agree. Since marriage is what ever you wish to define it as, how about marrying three women and a Great Dane so the dog can have health insurance too?

I think the boomers have a lot to be held accountable for voting themselves our money decades ago, but to be fair the MEDIA was the main information source at the time

Dan Rather and those of his generation should have all their wealth confiscated to pay for the things they promoted.

They wanted ‘share the wealth’ policies, after all.

In fact, any one who wants to ‘share the wealth’ should be required to turn over any thing they make past the minimum wage. THEN I’ll consider raising it.

I’ve seen that on here. I’m sure you payed in so why not collect? OTOH, my grandmother which never worked, drew on SS for over 25 years. Is that right?

I'm a Gen-X'er, and have no faith that there will be a single cent of what they confiscated from my wages available for my retirement years.

That being said, if you were threatened with jail time and loss of property for not succumbing to the federally approved Ponzi scheme that is SS paid into it, you, by all rights, deserve to benefit from it.

Was that due to being a survivor? Had your grandfather passed away? Had he paid into it?

She doesn't have an "ailing wife." She's a woman. Women don't have wives.

Gay marriage is recognized in Massachusetts, so if the two lesbians were legally married, then Walmart is legally obligated to extend the same benefits to them as to any other married couple.

If the two were simply co-habituating, tough luck. Walmart is not obligated to extend spousal benefits to a boyfriend living with his girlfriend, so it shouldn’t be obligated to extend them to a girlfriend living with her girlfriend.

Did she work at home, raise kids? My grandmother, who lived to be 100 and died in a nursing home, never held a job outside of home.

Do we let them die in an alley because they never worked? Remember, working women used to be in the minority when it was financially possible for women to stay home.

If she didn’t pay the premiums, she didn’t have insurance. Lesbian or not. Walmart should fight this “federal agency” Marxism.
