Judge REDUCES prison sentence of man who raped 3-year-old while covering her mouth because 'he didn't intend to harm her'

A California judge has reduced a child rapist's mandatory 25-year sentence down to only 10 - saying anything longer would be 'cruel and unusual punishment'.

Superior Court Judge M. Marc Kelly told an Orange County jury that 20-year-old Kevin Jonas Rojano-Nieto 'did not intend to harm' the three-year-old girl he raped at his family home in June. The judge said that he was sure that although Rojano-Nieto sodomized the girl and covered her mouth so she couldn't scream out, 'there was no violence or callous disregard for the victim's well-being'.

“Funny, that. Even incarcerated criminals have their own code. One might be a safe cracker, drug dealer, burglar, perhaps even a murderer, and survive in prison; but a child rapist is considered too low even for the low.”

Years ago I read somewhere, according to a guy who worked as a prison guard, the reason for that is because most if not all prison inmates were themselves abused in various ways (sexually molested, beaten, neglected, etc) by fully grown adults when they were children.

I agree. Any normal adult would think that forced sodomy could in no way be looking out for a child’s well fare. Its insane on the face of it.

There is something seriously wrong with that judge. Seriously wrong.

when people make these kinds of statements followed up by these kinds of actions, one has to assume that they have some "baggage" in their background....

because there is NO WAY that the mandatory sentence should have been lifted...
