In Praise of the Soviet Constitution.

It’s a pity the Russians didn’t enforce the constitution they had.

The Soviet Constitution shared more than a few similarities with the US constitution. The rights to property, private correspondence, freedom of religion & conscience, equality before the law, and the right to earn/keep earnings and to leave inheritances are there.

All considered, it wasn’t bad for peoples who had only known Mongol hordes and Czars for the past thousand years.

Despite these guarantees, the Soviet Union was a slave state from its inception. How could oppression have lived side-by-side recognized assurances of so many personal rights?

Slavery was certain because the Soviet system lacked institutions designed to secure liberty.

Similar to post-1913 American governance, the Soviet constitution set up internal contradictions. While it guaranteed certain rights and free will, the Soviet constitution purposely neglected to provide governing institutions to secure those rights.

At least history provided the Russians with an excuse.

History doesn’t leave Americans such an easy out. The self-inflicted wound of the 17th Amendment destroyed the Framers' careful structure of freedom. In 102 years we morphed from the freest nation on earth to one on the cusp of hard tyranny.

Oh, and the Soviet Union had elections too.

That would also eliminate the IRS=KGB. And Freedom would reign, THE PEOPLE would be in charge and jobs would skyrocket....

Why the prow Russian stuff all of a sudden? Yesterday they won WWII for us now there Constitution is superior.

What property? Government owned EVERYTHING!

Private correspondence? 100% censorship of mail and phones. (If there were any)

Freedom of religion and conscience? Just ask destroyed Ukrainian Church and Sacharov's "conscience". "Freedom" in Gulags in Siberia.

The Soviet Constitution circa 1936 (The Great Experiment as it was referred to by Western Leftists)

Chapter 2:

Article 3. Its fundamental aim being abolition of all exploitation of man by man, complete elimination of the division of society into classes, merciless suppression of the exploiters, socialist organization of society, and victory of socialism in all countries, the Third All-Russia Congress of Soviets of Workers', Soldiers' and Peasants' Deputies further resolves:

Pursuant to the socialization of land, private land ownership is hereby abolished, and all land is proclaimed the property of the entire people and turned over to the working people without any redemption, on the principles of egalitarian land tenure.

All forests, mineral wealth and waters of national importance, as well as all live and dead stock, model estates and agricultural enterprises are proclaimed the property of the nation.

The Soviet laws on workers' control and on the Supreme Economic Council are hereby confirmed in order to guarantee the power of the working people over the exploiters and as a first step towards the complete conversion of factories, mines, railways and other means of production and transportation into the property of the Soviet Workers' and Peasants' Republic.

The Third Congress of Soviets regards as a first blow at international banking, financial capital, the Soviet law on the annulment of loans negotiated by the governments of the tsar, the landlords and the bourgeoisie and expresses confidence that Soviet power will be advancing steadfastly along this road until the complete victory of an international workers' uprising against the rule of capital.

To ensure the sovereign power of the working people and to rule out any possibility of restoration of the power of the exploiters, the arming of the working people, the creation of a socialist Red Army of workers and peasants, and the complete disarming of the propertied classes are hereby decreed.

I forget which Founding Father said it but one of them referred to our own Constitution as a "parchment barrier" against oppressive government.

That's why they put in the Tenth Amendment. It's up to us, the people, who are expected to be the final physical barrier against such.

James Madison wasn't all that supportive of a Bill of Rights, because he had seen the VA legislature get around the VA Declaration of Rights. He did indeed regard them as parchment barriers. He was right. Few of our constitutional rights are in force.

Madison regarded division of power as our best security.

Our post-17th Amendment history proves that the horizontal separation of powers between the congress, prez, and courts is insufficient.

It why the first line of freedom's defense was the vertical division of power, between the states and the government they created.

Well, to be fair, there was a vertical separation of powers too. (It's just that by making the Senate a sort of super house-of-representatives we stripped States-as-institutions from the federal government.)

(That and the frighteningly pervasive view that the federal government is, in all cases, superior to the States.)
