The first loose thread pulled on the poorly woven case.

I’m sorry, but as an RKBA guy, I can’t worry about what kind of knife he had. A knife? Really? Depending on definitions and interpretations? Shoot, they should see what I carry. I ain’t sweating knife definitions. Sorry.

Shouldn’t the knife be in police custody? And if it’s not, why not?

Good thing at least two cops saw that knife. Otherwise, I could see Mizz Mosby doing a SWITCH-A-ROO to a different one. She might STILL try and do that, then claim she knows nothing about it.

Assisted-opening knives from Wikipedia:

“When the knife is in the closed position, the blade is held in place by means of torsion springs and an additional blade lock (optional). As the user applies manual pressure to the thumbstud to open the knife, a mechanism such as a torsion spring moves along a track in the liner and rapidly rotates the blade into the open and locked position.[1]

“Although commonly confused with switchblade knives, a switchblade can be opened automatically simply with the push of a button, but the user of an assisted-opening knife must open it about one-quarter of the way (45°) before the mechanism opens the knife the rest of the way.[4] The difference is important legally; because the blade does not open simply “by the push of a button or by force of gravity” the assisted-opening knife is typically not considered a switchblade,[5] and may escape the restrictions applying to those in many places.

“Additionally, despite the explicit illegal classification of switchblade knives in the UK, assisted opening knives remain permissible to own.[6]. . .”

I have always been fascinated by all kinds of edged weapons and tools. I own probably a couple of hundred most of them purchased 30-40 years ago when I could afford them.

In addition to a shotgun and two pistols, I keep an axe, sword and a Fiskars hatchet handy near my bed. Not really sure why. For some reason, swords or knives in the hands of a suspicious person has always bothered me. The idea of a mugger slashing me with a Spyderco gives me the shivers.

Romans and Carthaginians literally killed hundreds of thousands with edged weapons. They can be as deadly up close as anything.

his knife may or may not have been legal under that state’s apparently antiquated laws, but there still had to be probable cause to stop and search him for the knife
(unless of course he was waving it in the open)
The poorly presented news reports I’ve seen so far indicate this may not have been the case.

In which case, the arrest was still very illegal, even if they found a nuclear bomb on him

Poorly written article but the UK Guardian is Marxist in its orientation, so why bother telling the truth.

Freddy ran AFTER he made eye contact with the police, not before. That act is one of about a dozen which can give the police the right to stop and question someone.

Chances are that if Freddy had drugs on him, he needed to get far enough away to ditch them without being seen by the police (he had multiple convictions and could be facing some serious time as a career criminal).

If he had a knife, that should be a violation of any parole/probation terms.

I did a ride-along with a DC Narcotics Squad detective many years ago while I was studying Police Science (aka Criminology, Law Enforcement, etc).We went out in the famous “Green Jumper” car, a lime-green Ford that you could see from Virginia.

Its’ purpose was scare drug dealers into ditching their drugs and fleeing, wherein the police would search the bushes or look under the boxes (which young criminals would sit on as either a police watch site, or from which to hand out drugs brought for cash elsewhere). The car would coming speeding in to a drug area, screech its brakes, and then the cops would look to see who was dumping their drugs, where.

Once we hit 7th St. NW, about U street or so, we heard a whistle go out that warned everyone that the Jumper was in the area. A couple young kids quickly put things under their seat boxes and fled, as did most older dealers.

Let’s see what the CSI people find around Freddy’s “hood”.

The District Attorney is a politically ambitious white-hating bitch. After listening to her kowtow to the rioters, in your heart, you know I’m right.

So Gray wasn’t caught buying drugs when they stopped him as I read elsewhere?

If I understand this motion, it mitigates the charge at least some of the officers face in 'illegal arrest'.

Okay, well that may be so. How would dropping the 'illegal arrest' charges mitigate the manslaughter/murder charges?

Yes, I think the police officers are overcharged by the prosecutor -- especially where SECOND DEGREE MURDER is charged -- but I'm all ears as to how this man ended up dead in police custody.

People in Baltimore will always believe in Freddie Gray. He might even get an “unofficial” city holiday.

re. Baltimore state’s attorney Marilyn Mosby

Within a few years, (Nick Mosby) had married his college sweetheart, Marilyn Mosby, a Baltimore assistant state’s attorney, and purchased a shell of a house in Reservoir Hill. The couple rebuilt it and are raising their daughters, ages 3 and 1, there.

Mosby launched a bid for the 11th District council seat in 2007, losing to Bill Cole, a former state delegate. He dug into community life, becoming president of the Bolton Park Neighbors, Inc. in 2008.

Chet Myers, the current president, said Mosby was instrumental in securing nonprofit status for the Bolton Park group and convincing the city to fence and provide water for a community park on Reservoir Street. Mosby also helped organize the home tour and worked with the community garden, he said.

“He’s very organized, and he’s always out there in the community,” Myers said.

Mosby positioned himself for another run for council, joining the board of the Midtown Community Benefits District and winning a seat on Baltimore’s State Democratic Central Committee.

This year, he learned that as part of Mayor Stephanie Rawlings-Blake’s redrawing of district boundaries, Reservoir Hill was now in the 7th District. That meant he would face Conaway in the election.

Mosby says he mapped out a strategy early, tapping a close circle of relatives, friends and neighbors to become the core of his campaign. He scored a significant win in snaring the services of the influential fundraiser Colleen Martin-Lauer, who manages finances for the campaigns of Rawlings-Blake, Gov. Martin O’Malley and about half of the council.

Councilman wants Baltimore to boycott Florida after Zimmerman trial
Mosby says Florida’s stand-your-ground law encourages ‘vigilantes’
August 09, 2013

If Councilman Nick Mosby has his way, Baltimore government would boycott Florida-based businesses in protest to the state’s stand-your-ground law after George Zimmerman’s acquittal.

Mosby intends to file a resolution on Monday to encourage city agencies and investment boards to avoid doing business with companies in the Sunshine State. He hopes that would pressure the legislature there to rethink a law that allows individuals to use lethal force, if necessary, to defend themselves in public places.

The resolution also calls on city officials to avoid traveling to Florida or attending events in the state.

“Ultimately, the purpose of the legislation is to call to attention to an issue I think is very severe, and is not just a Florida issue but an American issue,” Mosby said. “I never want to see another Trayvon Martin again in my lifetime, nor do I want to see another policy that exacerbates the social issues we have in this country.”

Mosby ran, in part, on a vow for more police accountability — the city’s police force has a well-earned reputation for excessive force. He tried to improve the relationship between the department and the folks they police.

The Freddie Gray case falls right at the nexus of those issues.
