TEXAS POLICE SHUT DOWN GIRLS' LEMONADE STAND, DEMAND PERMIT

OVERTON, TX (KTRK) -- Police in Texas shut down a lemonade stand run by two little girls. They said it was illegal.

Andria and Zoey Green told ABC affiliate KLTV they were trying to raise about $100 for a Father's Day present. They wanted to take him to Splash Kingdom.

They had been selling lemonade and kettle corn for an hour - and made about $25 - when officers showed up and told them they need a $150 permit to sell their lemonade.

Texas House Bill 970, or the Texas Baker's Bill, does not allow the sale of food that needs time or temperature control to prevent it from spoiling. Since lemonade needs to be refrigerated to prevent bacteria growth, police said they needed an inspection from the health department and a permit to sell it.

"It is a lemonade stand, but they also have a permit that they are required to get," Overton Police Chief Clyde Carter said.

Overton, a small town near Tyler, isn't exactly Austin or the Oak Lawn and Uptown districts of Dallas. Here are the local officials:

Mayor: C.R. Evans Jr.

City Council: John Edd Welch, Philip Cox, Pat Beets, Jerry Clark, John Posey

City Manager: Charles Cunningham

City Attorney: Blake Thompson

City Secretary: Rachel Gafford

Police Chief: Clyde Carter

Fire Chief: Greg Wall

Finance Director: Pam Raney

The names hardly seem like those of recent transplants from New Jersey or some such bastion of Yankeedom. The local representatives to both houses of the Legislature and Congress are Republicans.

A quick Google search shows this story to have reached media outlets as far away as New York and London. It looks like the local Boss Hoggs are about to be hit by a media firestorm they don't want. To Texas officials who get overzealous in enforcing laws, remember the fate of Tulia.

Actually, the acid in the lemons and the sugar will inhibit bacterial growth. Both have been used as preservatives for eons. (think pickles and jams) Even if that weren't the case, you have a 4 hour window before anything starts growing anyway. So, rather than someone who actually knows about health issues, we have a grump who needed to kick a couple of little girls around.

If I moved to Texas, I would be another conservative added to the millions already there in The Lone Star State.

My politics are to the right of the late, great North Carolina senator Jesse Helms.

Here in Maine, the Maine House and Senate just passed Constitutional Carry, and our ultra-conservative governor Paul LePage said he will sign it. The Bloomturd idiots tried to stop it, but they failed.

Sold koolaide. Made money until mom taught me about costs. She charged me for sugar and the koolaide mix. Now I didn’t make money.
