so to clarify, these are emails that the State Department says they’ve sent to Hillary.

These are not ones that have been found on her server or ones she has submitted. Correct?

Not only does removing the markings not declassify it, I’m pretty sure it’s a crime.

18 U.S. Code § 2071

(a) Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.

(b) Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

This woman is disqualified from holding any federal office, and is qualified to be sitting in federal prison.

BINGO, exactly. I worked with classified information for 26 years. This classified retroactively BullShite is driving me crazy. When in the hell is someone from the FBI, CIA, or NSA going to tell the State Department spokesmen that they are blowing smoke or smoking something.

I was going to make a vanity post soon but will use your excellent post as an occasion to make the same observation:

Despite FR’s venerable, trusty format and interface, we need a Disqus-style Up-Vote button. I appreciate ‘I agree’ or ‘Well Said’ -type responses but obviously that requires an additional post which can muck up the flow or legibility of a thread.

In the social media age it’s almost a compulsion and I ask the already put-upon programmers at FR to give us an Up Vote function and a counter. Thanks.

What is driving the continuing exposure of Hillary’s email offenses?

A month ago, Hillary and her emails were barely a news item.

Could it really be a coincidence that a month ago was about the same time that Joe Biden decided he wanted to challenge Hillary for next year’s presidential nomination and Obama reportedly gave him his blessing?

After that, Joe Biden took a rest on an island, while his friend and supporter Obama has been using his administration to weaken Hillary’s candidacy.

The weaker Hillary becomes, the more of a savior Joe Biden will appear when he finally arrives on his white horse to rescue the Democratic party.

I’m surprised they didn’t release them at 9:00 PM Friday, before Labor Day. That’s the way government usually dumps evidence.

I think these are part of the Judicial Watch FOIA case. If so, the judge has already threatened the State Department lawyers with contempt if they fail to release the batches of e-mails on the schedule he laid out for them. As I recall, the releases are to be done on Mondays, per the judge. So I don't think they had the freedom to hold them until Friday - not unless they wanted to wait in jail until the emails were released.

This question of whether the material was classified at the time of transmission is easily settled by bringing out the classification guide.

For those unfamiliar with classification, there are “classification guides” which dictate what is classified and the classification level along with other information. For example, a class guide might say that a weapons range is secret but it’s weight is unclassified.

If these emails are classified, then bring out the class guide that governs them. If the class guide is dated earlier than the message, then the material was classified when it was sent.

In an earlier thread, some legal “experts” were saying that she had nothing to worry about.
I don’t trust anything purporting to exculpate Clinton. She was either incompetent or irresponsible.
And her criminal negligence cost lives.

Yes, I know that. I was trying to tell folks who would think that HRC was “innocent” because the e-mails were ‘just now being classified’ are totally wrong. I spent most of my military career dealing with classified documents and in declassification after I retired.

This is just the tip of the iceberg.

Our girl Hillary did some bad things concerning Libya and Qadaffi.

Some very bad things.

She isn’t even really campaigning. She’s getting kicked in the teeth and she’s not responding. That’s not the Clinton way. By now, she should have spent thirty million dollars buying advertising to fight this.

She hasn’t.

That means she’s not serious about the campaign.

She is old and sick and doesn’t want to spend her last days in prison.

This is part of her stall defense.

If she never got any classified material on her server, how was she doing her job as SoS?

If she was not sending and receiving classified materials, what was she doing to earn her salary as SoS?

If she was not sending and receiving classified materials on HER server, where was she plugging in to send and receive classified materials?

She said she only had one smartphone when she traveled. Did it send and receive classified materials? If so, did they go through her HOME SERVER?

Can someone provide a practical example of how a previously innocuous email from about 2 years ago instantly becomes so sensitive that it is only now considered a risk to national security. For instance, troop movement, drone strike data, location of protected dignitaries - all from about two years ago and assumed to have been hacked by foreign agents anyway - all of a sudden becomes redacted. For instance, if someone were to have requested a FOIA disclosure two years ago, we would have gotten the email - but ooops - it couldn’t have been FOIA’d since it was on Hillary’s private server and not part of the official pubic record. How convenient.

It’s not the number of classified material that was compromised, but the amount of money and influence that went to the Clinton Foundation and crime syndicate.
