Actually I just read that very thing on a different thread. It was about how Rubio wants to increase H-1B visas. Apparently this is an Establishment position, shared by Rubio and Cruz.

Thing is, it is not about property rights, it is about the fact that sometimes individuals have to trade one piece of property for another of their choosing so that society may grow/develop/move on. Otherwise cities would never have grown to begin with. It would put a strangle hold on the economy. There is no reason not to be willing to sell your property for a fair price and go buy another.

I wonder how many schools, libraries, interstate highways, gov’t buildings, actually anything outside a private residence would have been built without the use of eminent domain.

Koch Industries operates anywhere between 35,000 and 50,000 miles of pipelines between Texas and Canada—...eminent domain

I really don’t understand how Kelo and what Trump tried are different.

In Kelo the local government tried (and succeeded) to take land from one private entity and give it to another (for the purposes of “development”)

In the Atlantic City case, the local government tried (and failed) to take property from one private entity and give it to another (again for the purposes of development or one could say in this case redevelopment).

How are they different, other than the fact that the local government in AC failed in their quest?

If they aren’t different in substance, then I really fail to see how Trump apologists can say they were against what happened in Kelo but yet support what (almost) happened in AC!

Maybe I should really ask, “Do you support the Kelo decision?”

Whether or not we support the decision is irrelevant. The courts decided the case. I do not know the particulars of either so I trust the courts made the right decision based on existing law.

Not trying to be a Trump apologist but people keep trying to create the narrative that Trump is throwing some old lady out of her house to build some limousine parking lot. Trump does not have the power to do that. He can avail himself of the courts to adjudicate the matter and must abide by the decisions made.

Burden to interpret eminent domain is on the courts. It's not up to Trump.

I would be more sympathetic with Kelo if it had ruled that the property owner must submit his land for development, but that he retains control of the cubic footage of his building and the square footage of his lot.

So, the choice for the developer would be fully developed property including that area the developer owns/controls and that area which he does not directly control but is owned by another person, but required to permit standards to be retained (and borne) by the major developer.

That land owner might just sell after the completion of the development. He might lease the place to a restaurant and receive rent. Etc.

Since you are irrational on the Trump topic, a comparison may better serve. Let’s use Cruz for the purpose.

Suppose Cruz had been, for the most part, a lifelong conservative. Then, four years ago, Cruz wrote what was billed as a “policy manifesto.” Interestingly, every line in the book—every single one—was liberal. [It’s an example. Stay with it.]

Four years after publishing his wholesale liberal manifesto, Cruz runs for POTUS. Now, instead of reverting to the old time conservatism, he runs as a Dem, and does so on the liberal platform from the book he wrote. I.e.: he doubles down on every single liberal position he took, plus he releases several policy papers just as liberal.

On just one point, Cruz remains a stalwart conservative: Kelo. On everything else, he’s a liberal Dem.

Now with Cruz this hasn’t happened; it’s just an illustration. But if the above *had* happened, would you ignore the sea change of the past four years, and continue to label him a “lifelong conservative Republican”?

It’s doubtful you would. The last four years would bely the assertion. Yet the same thing has happened in reverse with Trump, and you very dishonestly and inaccurately label him a lifelong liberal. If you believe that lying about people is the right thing to do, carry on. But if you believe honesty and integrity are the best option, you will note the truth about Trump. It’s up to you.

[You can of course cite Kelo as the exception. But Trump’s book and policy papers are solidly conservative, so Kelo IS the exception.]
