Open carry gun law set to go into effect Jan. 1(TX)

Beginning on Jan. 1 the new open carry gun laws Texas will go into effect, allowing licensed handgun owners to openly carry guns in public.

"As of January, there is no such thing as a concealed license anymore," said Stephens County Sheriff Billy Wade. "Your license is simply going to say license to carry a handgun."

According to Wade, under the new law, handgun license owners have two options when carrying a handgun, they can continue to carry it concealed, as they always have, or carry it open which means with the weapon in view.

"You have to carry it in a holster on a belt or in a shoulder holster," he said. "If you're wearing a shoulder rig and you have jacket on, then it's concealed. Then you take your jacket off at Ernie's to have lunch, it's in view and not concealed anymore."

He said the community needs to think of it as license to carry a handgun and you get to choose how you carry it.

"If it's concealed, do it like you've always done," he said. "If you're going to carry unconcealed in the open, it has to be in a holster on a belt, if you're wearing it on your waist, or it has to be on a shoulder holster."

Wade said for businesses wanting to prohibit handguns on their premises, under the new law, the businesses will need to post two separate signs banning them. The first one, known as the 30.06 prohibits concealed handguns and is the sign that is currently displayed at businesses prohibiting concealed handguns and will still need to be in place. The second sign known as the 30.07 sign prohibits open carry handguns.

He said the community needs to think of it as license to carry a handgun and you get to choose how you carry it.

Does the State of Texas require a license to purchase a handgun? If not, how to you legally get your gun from the store to home? Can I carry a gun in my pocket, or must it be in a holster? What about a purse?

I am pretty sure the law already reads that way in Georgia.

I remember years ago stopping for gas along I-75 in Georgia and the apparent station owner walked around with a pistol in a holster on his hip. It was an unusual sight but it didn't bother me and it didn't seem to bother anybody else either.

No. You do have to pass a background check per the federal law, but no license to get one, nor registration of the weapon (beyond the Form 4473) after you do.

Can I carry a gun in my pocket, or must it be in a holster? What about a purse?

If it's fully concealed, there is no specific requirement for how it is carried. If it is carried *openly*, then it needs to be in a holster - either belt holster or shoulder holster.

One of the main advantages is that under the present law if the weapon was seen no matter how hard you tried to conceal it you were in violation. Now you won’t be if it’s visible either by design or accidentally. I’m not anticipating a lot of Texans walking around like Marshall Dillon with the weapon strapped to their hip! Could be wrong... time will tell.
You could always carry a rifle in the open but haven’t seen one being done so in quite a while!

In Texas, any one not restricted from owning a hand gun(e.g. convicted felon) may carry a firearm in their vehicle, but it cannot be seen from outside of the vehicle(in a glove compartment or console, no paper,registration or license required.

The gun may be transported directly from a residence or to a gun range or other place where it might be appropriate (gun shop or gun smith). If you are stopped by a lawman, you do not have to revel the presence of a gun.

The individuals that have a CHL or (now) a LTC are under more restrictive requirements. We must show our license to carry and identify the location of any guns we have in the vehicle or on our person if stopped by a LEO.

Under the new law, a LTC holder may have a visible gun in the car provided it is properly holstered.

Long guns are not under these restrictions.

In other words, any gun-legal Texan has the right to the protection offered by a hand gun... Take that Chicago...

Most of the CHL’s I know do not intend to open carry for open carry’s sake. It’s just a convenience, that you are able to.

For example, if you have a firearm strapped on more or less visibly while on your property, and you run to town for something, you don’t need to remember to take it off. That sort of thing.

No license required to purchase or transfer a handgun in Texas. I’m a little disappointed that HEB (grocery chain) has elected to opt out of open carry.

I’ll continue to conceal carry. Everyone I know that carries won’t be doing it openly. The benefit of the new law that all of us agree on is that we no longer have to be concerned if a stiff breeze decides to blow our jacket open and accidentally exposes our firearms. Basically is removes the ‘printing’ issue from the law. What will also be funny to see if the businesses that want to continue to ban handguns from their stores. They will now be required to post FOUR signs. The 30.06 in English and Spanish and the new 30.07 in English and Spanish. If they only have a 30.06 someone could enter openly carrying without persecution, and vice versa.
