Sowell: 'Messing With the Constitution'

In recent years, a small but growing number of people have advocated a convention of states to propose amendments to the Constitution of the United States. The reaction to the proposal has been hostile, out of all proportion to either the originality or the danger of such a convention.

The political left has been especially vehement in its denunciations of what they call "messing with the Constitution." A recent proposal by Governor Greg Abbott of Texas to hold a Constitutional convention of states has been denounced by the Texas branch of the American Civil Liberties Union and nationally by an editorial in the liberal "USA Today."

The irony in all this is that no one has messed with the Constitution more or longer than the political left, over the past hundred years.

This began with Progressives like Woodrow Wilson, who openly declared the Constitution an impediment to the kinds of "reforms" the Progressive movement wanted, and urged judges to "interpret" the Constitution in such a way as to loosen its limits on federal power.

It has long been a complaint of the left that the process of amending the Constitution is too hard, so they have depended on federal judges -- especially Supreme Court Justices -- to amend the Constitution, de facto and piecemeal, in a leftward direction.

This judicial amendment process has been going on now for generations, so that today government officials at the local, state or national level can often seize private property in disregard of the 5th Amendment's protections.

For nearly 40 years, the Supreme Court has been evading the 14th Amendment's provision of "equal protection" of the law for all, in order to let government-imposed group preferences and quotas continue, under the name of "affirmative action."

The Constitution is a dead letter. We need a CoS Art V ASAP. Deleting the 16th and 17th amendments would be a good start.

We are fighting for the soul of our Sacred Republic. The terror attacks in Paris and San Bernardino plus the demands for a "new Constitution" are signs of a quickening in this battle.

For those who think the Article V process is too risky, I ask, "What other options do you see?"

To summarize from a previous post by GraceG:

1. Elect More Republicans - Failed due to RINO/Uni-party confluence.

2. Article V Convention of States to propose Amendments - Needed to try to take power from the federal government back to the states and reel in the federal leviathan.

3. State Nullification - Last ditch effort to try to take power back from the federal monster, though by this point it may be too late.

4. State Secession - Could either end up peaceably like the breakup of the Czechoslovakia in 1993 or a brutal:

5. Civil War II like the first one.... The longer we wait on #2, the more likely #3, then #4 and finally #5. .

So, do we do nothing and just wait for # 5?

Quick review: We need 34 states to pass an application, then Congress shall, by law, call a Convention of States as soon as it receives applications from 2/3 of the State Legislatures. That's 34 states. (So far both legislative chambers of 4 States, {Alabama, Alaska, Florida and Georgia}, have completely passed their resolutions and 36 state legislative chambers or bodies have filed or passed resolutions.) Amendments are proposed and voted on at the convention. Each Amendment must be ratified by 3/4 of the states in order to become part of the US Constitution. That's 38 states.

An amendment to limit judicial rulings to the parties of the lawsuit. If a law is found unconstitutional, the court sends the law back for review to the legislature that created it. IOW, no court can make law.

An amendments convention can reverse any Scotus opinion. Imagine if it reversed Wickard v. Filburn.

In a convention of states, Barbara Boxer could be sent by California to amend the US Constitution. So could Chuck Schumer. Or Bill Clinton. or Mitch McConnell. Or Paul Ryan.

I find that scary.
