My only “claim” is that there is huge inconsistency in dealing with offenses. We’ve all seen proof of that.

nope release the drone footage from hundreds of feet away.

And the low res version at that. These drones have ultra high resolution capability.

In the video, between approximately 8:09 - 8:15 two flashes can be seen. Within two seconds of the second flash Finicum drives from the first stop. Victoria Sharp, who was a passenger in the truck driven by Livicum, said that after being shot at they began to realize that the police “meant business” and that Finicum yelled that he was going to continue driving so that he could “talk to the sheriff.”

I respectfully disagree with at least some of your analysis.

After Lavoy went down he did raise his arm to surrender while he was laying on his back in the snow. Watch the video again, for 5 or 6 seconds after he went down at 9:34 it appeared as if the guy on the left was going to try and
apprehend him. Then the pursuing officers appeared with their weapons drawn.

At 9:40 Lavoy lifts his arm off his chest and puts his arm up in the air. Then the guy of the left darts out of the way of fire.

Watch the officers on the road raise their weapons and open fire from 9:42-9:49 as the guy on the left is moving out of the way.

Lavoy appeared to be alive and trying to surrender up until that point.

Yes, you are correct about the vehicle being a PU. I realized that "sometime" in the wee hours. My bad.

I think all this raises another question, at least for me. Are LEO's justified in using deadly force if a suspect might be reaching for a weapon that is never seen until after the "reacher" is dead? Does it matter if the "reacher" is known to have previously committed or not committed a violent crime? How about homeowners defending their property in a break-in?

I know the answer to the first, under current law, seems to be "yes", but I ask it as a philosophical question for a society that seems to be losing its regard for life.

OTOH, if you're an LEO, do you tase someone (in heavy clothing) who you really think might shoot you? (It's almost like bringing a knife to a gun fight.)

A last thought for the moment is that it seems to me the LEO's training stinks. They were in way too close / uncovered, until they could determine Finicum's intent. If Finicum or the others really intended to take a couple LEO's with them, they definitely could have. And then there's the idiot who runs out in front of the PU. If Finicum had gunned it and tried to hit him...

You are right...and I saw that earlier and updated my own site’s verbiage accordingly. He did lift his arm. Tragically, I think at that point, there was no saving him. His wounds were mortal and they were a long way form any substantial help.

Let me say this in summary...and pardon my length, but it is my own belief, and it is as objective as I can possibly be.

I have now watched the video in detaail, several tiems, and analyzed it to the best of my ability, taking several hours to go through it frame by frame.

I have also talked to people with close association and knowledge of this.

I believe Lavoy was not wanting to die...its a false narrative for anyone to say he had a death wish.

But he was passionate about his beliefs, as he should be, and he came out of that car determined to try and either talk sense into the personnel there, or (as I have heard) tell them he would only talk to the Sheriff.

But in a situation like this, where the personnel on the ground view you as armed and dangerous, and where your own actions of almost hitting the one officer who stepped out to try and stop you is going to be viewed (like it or not) by those officers as an immediate beforehand threat to their life, the only recourse in such a situation, particularly when they believe you are armed and dangers (and as I have said, Lavoy was armed...but I do not believe he was dangerous...though the officers could not ascertain that from his immediate actions)...as I say, the only recourse is to get down prone on the ground with arms outstretched.

Had he done that...he would be alive.

It is tragic. Lavoy was a good man. He had eleven kids. He had numerous grandkids. I learned from a friend here who knows his family that he recently had been taking care of foster kids on his ranch. He did not need to die. He did not deserve to die. But he put himself in a position by making three decisions, that led to his death.

1) He drove away from the initial stop.

2) He tried to go around the roadblock almost hitting an officer.

3) He came out of the car and acted erratically, and appeared to reach for a gun.

In such circumstances, there was a very high probability, even a likelihood that he would be shot.

I do not believe the Law enforcement personnel murdered Lavoy. I do not believe they had “blood in their eyes,”” or were looking forward to taking down and killing some “militia.”

If Lavoy had acted like the three in the first car, the one who got out earlier, and the three in his own car at the final scene...all of whom live...he would not have been killed, and probably not even injured.

it is a sad set of events, and tragic for Lavoy, his family, and friends.

The real culprits here are the people who decided to force this issue. There was no need for it. These people had harmed and threatened no one. Their presence at that remote refuge in Winter, when it is completely closed down, threatened no one. They had been allowed to attend numerous meetings, coming and going.

The wee lulled into this...and I believe falsely promised safe passage, in order for those in charge to end it as they desired...and without regard to the danger to either those people or their own personnel.

That’s okay if there is a critical, dangerous situation which has either already resulted in death and injury to American citizens, or threatens to do so at any time,. But that was not the case here.

So, IMHO, those managers are culpable in this death and should face criminal and hefty civil charges for it...and I believe they will, and most probably the latter.
