My answer is that it has never been adjudicated under the 14th amendment and therefore the question has noty been addressed.

You seem to be confused. Are you claiming Cruz entered the USA illegally or not? Or do you need to change the question so as at least appear to not seem so ignorant? Take all the time you need boy to answer that...you’ve already lost the argument so you can’t look any worse. LOl

Wrong. The CRBA is not required by law, but is recommended. In fact on the State department web site, it says the following:

A person born abroad who acquired U.S. citizenship at birth but who is over the age of 18 (and so not eligible for a CRBA) may wish to apply for a Certificate of Citizenship to document acquisition pursuant to 8 U.S.C. 1452.

So obviously, the US government recognizes that a child born to US parents abroad acquires citizenship at birth, regardless of whether or not the CRBA is filed. The CRBA is just one method, not the only method, of documenting that fact.

Lucyt, note this point:

That would have been when he was 16.

Dovetails with him being in high school and his folks doing the paperwork so he could get a passport to go to England for a competition.

Vattel can be an interesting source, but does not supersede the laws as written by Congress, empowered to do so under the Constitution itself.

If there is something more to the point, and in more readable format, then go ahead.

Otherwise what you're up to here may seem entertaining to yourself (if you're not being paid to stir the pot) but is just so much noise, nonetheless.

That paperwork would have included the crba, and proof he was their child, etc.

Because if it’s blind allegiance, this will be the last response! If it’s that you really care about law, and making sure we have the most conservative candidate possible, then you should really do more research.

1. Ted Cruz can release it whenever he chooses.

2. Also, ANY US State can subpoena as part of a case requiring citizenship or parentage to be verified.

That list of residents was just that, a census to see how many people were living there.

The next step would have been to check citizenship, and allow those folks to vote.

It doesn’t mean they voted, they hadn’t been in Canada long enough to get citizenship when Ted was born.
