Well we will see.

Maybe we do something like Ted Kennedy did when he made that half assed speech how in Robert Bork’s America, blacks would go the back of the bus, people would be hauled off in midnight raids and other such horse blank. Just have to update it to proclaim how this new obama appointed justice would force feed liberalism on us all.

Well it would take an act of Congress to increase the size of the Supreme Court. A new president can’t just appoint an unlimited number of justices.

I hate it when the commie libs wrap themselves in the U.S. Constitution WHEN IT SUITS THEIR NEEDS. The rest of the time, it’s just “an old, obsolete piece of paper written by a bunch of old, white European guys”.

This will be used as a wedge issue. The Dems have 2 terrible candidates. Thier only hope is turnout. They will drag this out until November of the GOP’s spine crumbles.

It’s a trap.

I note that they specifically called out the adjournment as a recess.

If the Senate does not reconvene this week, I get the impression the administration will actually attempt a recess appointment.

If Obama makes a Supreme Court appointment during an officially declared Senate recess, that appointee takes the seat and serves until the next President takes office, at which time the Obama appointment is terminated. As a former member of the Reagan Office of Presidential Personnel I can see no reason to block Mr. Obama from making a recess appointment if he wishes as is his privilege. His recess appointee would serve a temporary term only and would have the opportunity to demonstrate to the country his/her suitability for a permanent appointment and could be of great value to an incoming president as to whether to continue his/her service on the Supreme Court on a permanent basis...I believe an Obama recess appointment would be better for the country than a permanent appointment at this time between administrations and might prompt Mr. Obama to name someone like former Virginia governor Jim Gilmore to the US Supreme Court who is acceptable to both the Left and the Right because of his judicial mindset of fairness and openness to a variety of points of view...

There is an important immigration case coming up. It can’t go Obama’s way..and it will if he gets a SCOTUS on the court

Of course, the White House knows that the Senate is not in Recess. The Senate stands in adjournment as is clearly laid out in the Congressional Record.

The White House statement is political theater, believing that most people are too ignorant to discern the difference. They want us to buy into the false notion that the White House would never try a dirty trick to replace Justice Scalia. They would, and they will if they have an opportunity.

On the other hand a 4-4 per curiam decision leaves the case as it arrived at SCOTUS, unchanged.
Alternatively, his calculus may see a 5-3 decision in favor of the administration...if he can find those other video tapes.

Here is the question for politicians to consider...although it would do no good with Paul Ryan as Speaker

Paul Ryan could reconvene. He only has to consult with Minority not get approval.

So if they reconvened..what would that do to the Senate resolution since it was contingent on House approval? Would it turn into pro forma sessions etc?
