Montana AG Tim Fox weighs in on Keystone XL lawsuit

Montana and five other states say resident Barack Obama overstepped his power by rejecting the Keystone XL pipeline, whose developers are now suing four presidential cabinet members.

The states along the pipeline’s route filed a friend-of-the-court brief this week arguing that Congress, not the executive, has the right to regulate interstate and international commerce. The pipeline, which would have crossed the Canadian border, was being developed by TransCanada, which is now suing the government.

Because of the resident’s representations to the rest of the world that America would lead in reducing its carbon footprint, that that was the sole reason for denying the permit,” Montana Attorney General Tim Fox said. “That’s ludicrous because it’s outside the authority granted to the president and it’s the first time in history of these trans-border applications that one was denied for any reason.”

“There are over a 100 trans-border oil pipelines, gas pipelines and transmission lines, either over the Mexico-U.S. border of the Canadian-U.S. border,” Fox said. “All have been approved over the years, none of which have received the scrutiny the Keystone XL pipeline received and none of which were denied.”

State attorneys general have proven they can influence a judicial debate.. Attorneys general have for now halted a federal government attempt to extend federal control on streams, ponds and tributaries feeding U.S. waterways. States have for now halted the Clean Power Plan, as well. The interest in both cases is states’ rights.

“It’s an extraordinary time to live in,” Fox said. “We’ve never seen this amount, if you will, and level of federal overreach.”

Kansas, Nebraska, Oklahoma, Texas and South Dakota are the other state’s involved in the amicus brief. The attorneys general are all Republican.

Kansas, Nebraska, Oklahoma, Texas and South Dakota are the other state’s involved in the amicus brief. The attorneys general are all Republican.

I thought Nebraska opposed it.

Global “warming” caused by the burning of “fossil fuels” in the enjoyment of life, liberty and the pursuit of happiness, is a huge cruel hoax, and has no standing in an objective application of scientific thinking.

Those who fervently believe in anthropogenic climate change are not in the least troubled by the contradictions and inconsistencies of the explanations they put forth about “greenhouse gases”. There are only two “greenhouse gases”, carbon dioxide and water vapor. And of the two, water vapor is of a vastly greater magnitude of influence than the relatively insignificant amount of carbon dioxide in the air.

Insignificant in total quantity, the carbon dioxide is vitally important in one aspect - the very existence of breathable oxygen in our atmosphere. Green growing plants, through the very sophisticated chemistry of photosynthesis, convert this carbon dioxide and water vapor into many different permutations of carbohydrates (which we use for food, clothing, dwellings and sometimes as a power source) and free oxygen, an element that is the second most corrosive in the Universe (only fluorine is more reactive).

Carbon dioxide is PLANT FOOD, and at the present levels, plants are very close to starvation. Increased carbon dioxide only accelerates plant growth, and with it, part of the overall wealth storehouse of the planet.

True wealth comes not from possession of what are sometimes called “precious metals”, but from supplies of energy that may be readily converted to forms of useful work, vastly multiplying the productivity of the labor of just one lone person. Multiply this again by millions, if not of billions, or productive workers, and you see an accumulation of wealth on this planet beyond even dreams of avarice.

On the semi-trailers at work, I have recently seen aerodynamic panels added between the wheels. They have green lettering which says “reducing CO2”. My first thought was to spray paint “Why do you hate trees?” on them.
