This “never marked classified” is Hillary’s way of dodging the issue, and the enemedia have been perfectly happy to play along.

You are wrong. This matter came up years ago during the Clinton presidency. Prominent lawyers mentioned that this is a good and bad part of our Constitution; on the one hand “the will of the people” is supreme and avoids having presidents “chosen” for us, as is the case in many so called “Democracies”: On the other hand, in the worse case scenario, we could land up with a President serving the country from jail!

As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

They weren’t marked as anything because one of her minions removed the classification markings when they cut/pasted or retyped information from the secure system(s) to the unclass one.
