Ivanka Trump Sued : Shoe Competitor Wants Her Kicked to Curb
tmz ^ | 6/22 | tmz

Posted on 06/22/2016 9:35:03 AM PDT by RummyChick

Ivanka Trump's shoe line is a shameless knockoff of a wildly popular Italian stiletto ... so claims the Italian shoemaker.

Aquazzura claims in a new lawsuit, Ivanka's Hettie shoe is almost a carbon copy of its Wild Thing pump ... a shoe that protects the feet of the famous-ish, including Solange and Olivia Palermo. Aquazzura points to the color, shape and silhouette, as well the fringe covering the toes to the tassel on the heel.

Aquazzura says Ivanka jacked their shoes before ... copying its Belgravia shoe and calling it Necila, and also copying its Forever Marilyn shoe and calling it Teagin Pointy Toe Pump with Tassel.

That's shoe biz ...

I’m another stupid woman who wore high heels while working and ruined my feet. I’m suffering for it in my old age. Serves me right and I know it. Stupid women, the things we do to try to attract the rogue sector.

http://www.bw-iplaw.com/copyright-trademark-or-patent
“There is clearly overlap between trademarks, copyrights and design patents. Take, for example, a shoe. If used as a symbol of your business, the shoe design may be protected under trademark laws, while the ornamental design of the shoe may be protected through copyright laws as a work of art, and the placement of the straps, if new and unique, may be protectable under patent law. So, what should you do? It depends. But the most important thing to do is to present your design to an attorney and discuss your options. Then you will know the best route to take to protect your work.”

YSL cannot make a red lacquered sole black shoe. Already been decided.

fashion has no intellection protection.

anyone can copy any garment.

logos are their only protected ELEMENT. leave off the logo and it is 100% legal.

Oh yes, buy sketchers. I am wearing them for everything and who cares, they feel wonderful on my old hurting feet and they look quite nice.

If you want and can afford to buy the 450$ shoes there would be no way you would spoil their sales. Buying the “cheap” Ivanka ones...spoil your reputation! LOL

Remember Michelle’s 800$ or more sneakers worn to serve the homeless? Copies from KEDS would be too far beneath her!

Same deal with handbags. Daughter sold handbags @ Nordstrom. Probably the least expensive they sold was $400 (for a wallet, maybe). You could go out on the street and buy a Kate Spade or Louis Vuitton knockoff (for instance) for maybe $20-50, but those in the know, and who are willing to pay the $400-2000 can tell the difference from a mile away. Most don’t care.,

I have hard to fit feet. Stuart Weitzman works for me. I paid $300 for a pair of shoes. The first day I wore them the heel got stuck on a grate or something.. and ruined the heel.

From then on, I had a hard time justifying expensive shoes...and $300 is really not considered “expensive”.

In a just world, once a year, a 24 hour window permitting the hunting of lawyers, with no bag limit, would make the world a better place to live for all of us.

Need to modify that 24 hour window. Too many of the SOBs are on boats, planes, foreign islands and all. One week window on US territory under US jurisdiction. 365 days to catch them on arrival. That would make the long TSA lines and baggage claim lines entertaining at least.

I grew up on Long Island.

As a kid, my father worked in Manhattan and my family spent a lot of time there.

I remember being in Bloomingdale’s department store once with my mother and sister. The escalators there, instead of being made of metal, were made of wood and the slots...or slats...were wider than on metal escalators.

A woman ahead of us on the escalator had the heel of her high-heel shoe stuck in the groove....it broke the heel of shoe right off.

One quarter the price, and Ivanka’s are probably more comfortable because of the design difference. No wonder they are suing. Plus I wonder if Clintons have stock in the Italian company.

My guess would be her differences were designed into the shoe to make it a legal knockoff. That’s done in business all the time. You can imitate, but not copy exactly in a lot of this stuff, if the originals are properly protected.

I would guess the question would be whether the differences are substantial enough.

(But I’m not an attorney in this biz or anything.)
